PATRICK COUNTY, VA - COURT - Order Book "2" (Selected Entries, 1818) ----¤¤¤---- JUNE COURT (11 June 1818) Joseph Kennady foreman, Moses Harbour, Mathew Sandifur, Silas Carter, Jno. A. Corn, Jeremiah Burnett, Henry Hines, Elisha Collings, Nathan Hall, William East, Geo. Smith, James Morefield, Abraham Reynolds, James Ingrum, Stephen Atkinson, Elijah Dehart and Saml Flipping & Jesse Reynolds were sworn a Grand Jury of Inquest for the body whereupon after receiving their charge they withdrew to consult of their presentments. William Aryes is appointed Constable in place of Jno. Sneed whose Term of service expires this day and thereupon he gave bond and quallified according to law. On the motion of Thomas Sharp leave is Granted him to Keep a house of public entertainment at his own in this County whereupon he entered into Bond Conditioned as the Law Directs. Thomas Whitlock Gentlemen sheriff appeared in Court & Gave Bond with his received security Conditioned according to the act of assembly for the faithfull Discharge of his several Dutys as Sheriff of this County & for the Collection of the revenue tax, etc., etc. SEPTEMBER COURT (17 September 1818) The last will and Testament of Adrain Anglin was exhibited in Court & proved by on the witnesses thereto subscribed to be the act & deed & last will of the said Adrain Anglin decd. and ordered to be recorded. Greensville Penn the executor named in the last will and Testament of Adrain Anglin decd. appeared in Court quallified & gave bond with Jesse Reynolds his security according to law. George McCutchin, Charles Foster Jr., Jno. Harbour, and Francis Spaulding or any three of them are appointed Commisioners to View away for a road from the Bull Mtn near the foot of the B. Mountain to the road leading by Jas. Vias fence near Francis Spauldings & that they report to Court accordingly. Reubin Harris, Elijah Dehart, Jno. Tuggle and William Brammer or any three of them are appointed Commisioners to View away for a road from the said Brammers into the old road below the said Reubin Harriss and that they report to Court accordingly. Charles Sharp, William Elliot and Jesse Reynolds & David Taylor are appointed Commisioners to View away for a road from the road near Moses Reynolds into the road that runs by said Elliott. Jesse Dehart is appointed surveyor of the road in the room of John Brammer resigned and it is Ordered that the list of the hands filed be his Gang. James Boyd is appointed surveyor of the road in place of Adam Aheart resigned & it is ordered that the list of the hands filed be his gang. Administration of the estate of Gabriel Penn decd. is granted to Jane Penn, Clark Penn, and Greensville Penn, who Together with Abram Staples, M. Sandifur, P. Cardwell, James Penn, and Jno. Tatum their securitys entered into bond Conditioned as the law requires, after being duly quallified. M. Sandifur, Jno. Tatum, Thomas Cardwell & Andrew Joyce or any three of them are appointed Commisioners to appraise the estate of Gabriel Penn decd. and to report to Court accordingly. Thomas Sneed, William Crum, Jno. Sharp Jr., and David Taylor or any three of them are appointed Commisioners to appraise the estate of Adrain Anglin decd. & to report to Court accordingly. Thomas R. Hall is appointed surveyor of the road in place of Cornelious Thomas resigned and its ordered that the list filed be his gang. Ordered that the list of hands filed be hereafter the hands & Gang of John Burnett. Ordered that the list of the hands filed be the hands of William Via. Jacob Grigg & William Lyon Deputy sheriffs of this County are allowed their accounts of $10.08 as pr account exhibited which were Ordered to be Certified to the auditor of Public accounts. OCTOBER COURT (15 October 1818) Jno. A. Corn, George Lackey, Joel Chittwood & William Chittwood are each allowed Their accounts of 50 Cents each this day exhibited, which was ordered to be certified to the auditor of Public accounts. A Deed from Nancy Corn, Jno. A. Corn, Richard Sharp, William Corn, Jese Corn, James Sharp, Joel Chittwood, Samuel Corn, William Chittwood & William Hancock Guardian to Dicey Corn, to Richard Harbour acknowledged by Hancock & Jno. A. Corn & proved by 1 witness as to all the rest & certified for further proof. A list of Insolvent Lands and property in the County of Patrick for the year 1818 was exhibited in Court by Wm. Lyon and Jacob Grigg Deputy sheriffs for this County, examined & ordered to be Certified. Wm. Lyon Deputy sheriff of this County presented in Open Court a list of Insolvent fifas (?) put in his hands as sheriff in favor of the Commonwealth against W. Dinkin(?), Hamon Bowman, Harman Bowman, Solomon Keaton, William Burnett in 2 Cases and Solomon Keaton for the sums respectively inserted in said fifas (?) as appiariley said which was examined allowed & Certified to the Auditor of public accounts. It is Ordered that the Gangs of Jno. Burnett, Tho. R. Hall and Jese Dehart be appointed under the superintendance of Jno. Hall to cut & open a road from James Vias fence across Smith river to the road near the widow Wrights and immediately after its Completion to return to their respective road. It is Ordered That Thomas R. Hall and his Gang, Jese Dehart & his Gang & Reubin Harris and his Gang do open & clear the road from Jese Clarks old place fence leading up Hughes spur to the montgomery line and after its completion to return to their respective roads, under the Superintendance of Jno. Hall. The License of Roswell Bailey & Co. was presented, examined & Ordered to be recorded. It is Ordered that Charles Sharp, John Adams, George Harrison & Thomas Boulding & their respective Gangs do clear & cut the road from the road near Moses Reynolds into the road that runs by William Elliotts under the Superintendance of David Taylor and immediately after its Completion to return to their respective roads. David Taylor, Jese Reynolds and Charles Sharp are appointed commisioners to View away for a road from the race paths to the Creek near Camrons, & report to Court accordingly. NOVEMBER COURT (12 November 1818) Commonwealth v. Hamon Bowman a Jury sworn, to Wit, Thomas Harbour, Thomas Beazley, Jno. Smith, William East, Wm. Sharp, William McMillion, Thomas H. Watson, Thomas Baker, Jese Reynolds, Silas Carter, Leonard Owen and Jeremiah Burnett. Verdict returned for Defendant. [Commonwealth] v. Isham Burnett son of Obediah, on a rule to shew cause etc. Judgment is granted the plaintiff for $3.32 and Costs for swearing & profane oaths. A Deed from Henry Smith, Margrett Smith, Mary Parr, Nathl. Smith, Mary Smith, Harbard Smith, Elizabeth Smith, Bartholomew Smith, Daley Smith, Daniel France, Susannah Smith, Committee or Trystee for Munford Smith, & Jno. Smith for himself and as atto. infact for Isham Smith, Polley Smith, Mark Smith and Nancey Smith was presented in Court with Certificates of proof and acknowledgement and relinquishments of Dower by the said Henry Smith, Margrett Smith, Mary Parr, Nathl. Smith, Mary Smith, Harbord Smith, Elizabeth Smith, Bartholomew Smith, Daley Smith, David France, Susannah France, George Rogers, Ann Rogers, before competant authority in Different sections of the West as are described & stated specially in said deed, & Certified here for record in due form of Law and by Susannah Smith Trustee for Munford Smith & Jno. Smith for himself and as attorney in fact for Isham Smith, Polley Smith, Mark Smith and Nancey Smith to Andrew Joyce who personally here in Court acknowledged the same to be their acts and deed and the same was Ordered to be recorded. Also a deed from Nancey Corn admr., Richd. Sharp, Jno. A. Corn, William Corn, Jese Corn, James Sharp, Samuel Corn, Joel Chittwood, William Chittwood and William Hancock, Guardian for Dicey Corn an infant, to James Bolling, proved by 2 witnesses and Certified for further proof. Flipping, George Lemmon, Jacob Moreman, Henry Hines, Jonathan Landreth, Benja. Landreth, Charles Lewis, James Morrison, William Booker & George Carter were sworn a Grand Jury of Inquest for the body of this county whereupon they withdrew to Consult of their presentments. Also a deed from the same to the same, the same, same. (13 November 1818) Comwealth v. Charles Sharp on a presentment for profane swearing. Judgment is Granted the sd. plaintiff v Defendant for 83 Cents & Costs. Jese Corn is allowed 2 days attendance as a witness for Watson ads Stovall on an appeal. Mathew Sandifur is allowed 2 days attendance as a witness for Dillion ads Cummings. James Newman is allowed 4 days at this and previous Courts as a witness for Ingrum v. Corn, David Taylor, George Lemmon, Joseph Cummings, William Spencer, Thomas Sharp, Robert Boaz, Jacob Moreman, Alexander Joyce, and Samuel Corn senr. Verdict returned in the following words, to Wit, we of the Jury find for the plaintiff one cent damages. Ingrum v. Lyon. Defendant pleads not guilty and a Jury sworn, to wit, Joseph N. Grigg, Burwell Smith, Leonard Aryes, Thomas Harbour, Leonard Owen, Madison R. Hughes, Edmund Penn, Samuel Howell, George Carter, Ira Draper, George New, and William Witt. Verdict returned in favour of Plaintiff for two hundred Dollars and Costs, and the plaintiff here in Court volentarily relinquishes & releases one hundred & fifty Dollars of the said Damages. Lucinda Gilbert is allowed 6 days attendance at this & previous Courts as a Witness for Baker v. Owen. DECEMBER COURT (17 December 1818) ...a Deed from Eliphaz Shelton to George Layman Proved & O.R.
