PATRICK COUNTY, VA - COURT - Order Book "3" (Selected Entries, 1826) ----¤¤¤---- JANUARY COURT (12 January 1826) A deed from John Sharp to James Sto was exhibited in Court by the said John & acknowledged to be his act and deed & ordered to be admitted to Record. Frederick Critz is appointed surveyor of the road in place of Hardin Hairston and is is ordered that the hands of the said Hairston as overseer & the hands of the said Critz & also the hands of Joseph Stovall constitute his gang. Ordered that Austin Booth be appointed surveyor of the road in place of James Brammer resigned. Ordered that the order appointing Austin Booth surveyor of the road be for reasons appearing to the Court recended. MARCH COURT (16 March 1826) William Lyon and Hardin R. Hall are by Greensville Penn sheriff of this County appointed his undersheriffs during pleasure and thereupon the said William Lyon and Hardin R. Hall took the oath of fidelity to the Commonwealth, the oath of office and the oath to support the Constitution of the United States, and the antiduelling oath, it appearing to the satisfaction of the Court that they are men of Honesty, probity, and good demeanor. APRIL COURT (13 APril 1826) George Carter is appointed surveyor of the road in place of Silas Carter resigned, and it is ordered that the hands of the said S. Carter be the hands of George Carter. A deed of trust from Henry Crum & Wm. Lyon, Trustee to Hardin R. Hall proved and ordered to be recorded. JUNE COURT (15 June 1826) To George Lackey as surveyor of the road per acct filed 3.00 To Wm. Crum as per his account exhibited and filed 4.20 To John Sharp as surveyor of the road 4 days 2.00 To Thomas Sharp for 5 days as ditto 2.50 To John Gilbert for 5 days as ditto 2.50 To James Brammer for 4 days as ditto 2.00 To Jonathan Hubbard for 5 days as ditto 2.50 To James Lackey for 6 days as ditto 3.00 To Wm. Ayres as per his acct. exhibited and filed 1.49 To Wm. Clark Constable as per his acct exhibited and filed 8.40 (16 June 1826) To Wm. Sharp for 6 days work on his road since the last ret. 3.00 To the same for 2 sign boards 1.00 To A. Staples Clerk as per acct. filed 4.60 AUGUST COURT (17 August 1826) Present: John Hughes, John Hall, Jesse Corn & Charles Foster Sr. -- Gentemen Justices Richard Thomas Commissioner of the Revenue of this County is allowed seventy five days within which he was engaged taking the Land & property Lists of the present year and the same is ordered to be Certified to the Auditor of public accounts. Abram Staples, Clerk of this Court, is allowed twenty dollars for examining the Land and property Books of the present year, and the same is ordered to be Certified to the auditor of public accounts. The last Will and Testament of Eliphaz Shelton decd. was exhibited in Court by Harvey Fitzgerald and Claiborne Shelton the executors therein named, proved by the witnesses thereto subscribed to be the act and deed of the said Eliphaz Shelton decd., & ordered to be recorded, & upon the motion of the executors, John Tatum, Silas Carter, George Carter and John C. Staples or any three of them be appointed Commissioners to appraise the estate aforesaid & report the same to this Court without delay, being first duly sworn etc. Claiborn Shelton and Harvey Fitzgerald the executors named in the last Will and Testament of E. Shelton decd. appeared in Court were qualified & thereupon entered into & acknowledged bond Conditioned according to law with good & sufficient security in the penalty of four thousand dollars. Ordered that Major Clark Penn be & he is hereby appointed a Commissioner to purchase without delay a suitable Book for the Clerks office of this County for the Record of Wills etc., & that he draw an order in favor of the person from he purchases on the shff of this County for the amt. which said Book Costs & report etc. SEPTEMBER COURT (4 September 1826) A Relinquishment from William McAlexander, Alexander McAlexander, David McAlexander and Edmund McAlexander to John McAlexander Sr. acknowledged and ordered to be recorded. Thomas Sneed is appointed surveyor of the road in place of Costello Hill & it is ordered that the said Hills hands be the said Sneeds hands. John Lyon is admitted deputy sheriff of this County, it appearing to the satisfaction of the Court that he is a man honesty probity & good demeanor, whereupon he took the several oaths prescribed by law. On the motion of William Ayres it is ordered that Aaron Dehart, John S. Dehart, Alexander McAlexander, William Harriss & James Hatcher be and they are or any three of them appointed Commissioners to View away for a road from Mich Johnson Sr. a Cross Rock Cassle Creek & on to John McAlexander Sr. and report to Court. A deed of Gift from John McAlexander Sr. to Milley Lyon and the Heirs of her body acknowledged in Court and ordered to be recorded. William Lyon is allowed one days attendance as a witness for Ayres ads Penn. Thomas H. Watson is allowed one days attendance as a witness for Penn against Ayres. DECEMBER COURT (14 December 1826) Thomas Penn, John Sharp, William Elliott and William Crum or any three of them are appointed Commissioners to appraise the estate of Moses Reynolds decd. & thereupon report their proceedings to this Court.
