PATRICK COUNTY, VA - COURT - Order Book "3" (Selected Entries, 1827) ----¤¤¤---- MARCH COURT (15 March 1827) An Inventory of the estate of Moses Reynolds decd. and also an account of sales was returned into Court by Meekin Reynolds, administrator thereof, examined and ordered to be recorded. (16 March 1827) Wm. Crum is allowed one days attendance as a witness for Craddock ads Thomas Sharp. Wm. Crum, Thomas Sharp, Thomas M. Clark and Wm. Elliott or any three of them are appointed Commissioners to View away for a road from the river ford at the lower end of Capt. Th. Penns plantation into the road near Samuel Crutchers old place and thereupon when Completed report their proceedings to this Court. Sandifur v. Anglin on the motion of the Plaintiff by his Counsel for leave to amend his declaration, the same for reasons appearing to the Court is granted him. MAY COURT (17 May 1827) ...a deed of trust from Joseph Sharp and John Tatum Trustee to A. Staples proved and ordered to be recorded. Also a deed of Trust from the same to James W. Waup proved and ordered to be recorded. Ordered that Wm. Ayres surveyor of the road hereafter work from the fork of the road below Micah Johnsons Senr along the new road to the branch above the Widow McAlexander thence down the Rock cassle creek road to the Mill path leading from Wm. Martins to Nathl. Akers Mill instead of the road he formerly worked; And that Fleming Johnson, Micah Johnson Senr & his hands, George Davis, Thomas Vaughan, John Massey, Jubal Massey, Jacob Wade, Saml. McAlexander Jr., Levi Smith, Wm. Roberts, Reuben Green, Jona. Gram(?), Wm. Harris, John Mobb, Lewis Bryant, and Aaron Dehart be his gang. Ordered that Wm. McAlexander Senr. surveyor of the road hereafter work from the fork of the road below John Brammers, down Rockcastle Creek to the branch above the widow McAlexanders thence the new road towards Elijah Deharts, to the upper end of the water lane between E. Deharts Senr. and John McAlexander Senr. instead of the road heretofore worked on by him -- And that Jas. Hatcher, Ammon Hatcher, Elijah Dehart Senr. & his hands, John Dehart Jr., Wm. McAlexander Jr., David McAlexander, Edmund McAlexander, Jno. McAlexander Jr., Danl. McAlexander, Hudson Akers & his hands, John Akers & his hands & Moses Martin Senr. be his gang. On the motion of Wm. Ayres to establish his Grist Mill already built on Rockcastle Creek ordered that the same be granted him. JUNE COURT (14 June 1827) To Hardin R. Hall for 1 lock for the Jail 0.37 1/2 To James W. Warhop for 1 padlock furnished for the jail 0.37 1/2 To Wm. Lyon for 6 chairs furnished the Clerks Office 3.00 To John Ivy for 12 hours patrolling .75 To Benja. E. Buttman a balance for building the Clerks office 483.82 To Thomas Reynolds surveyor of the road for 4 days 2.00 To John Gilbert for 5 days work 2.50 To William Sharp surveyor for 5 days 2.50 To George Carter for superintending the building the Clerks office & for settling with the Sheriff 6.00 Adam Turner Sr. is appointed surveyor of the road from the ford of the river near the Widow Houchins to Jno. Burnetts bridge on Sycamore Creek, and John Burnett & his hands, James Foley, Micah Johnson Jr., Richard Houchins, and the said Adam Turners hands be his gang. Ordered that the hands of James M. Redd and George Waller & his hands who are in their possession at Patrick Courthouse be added to the list of George Carter Surveyor of the road. Ordered that Wm. Crum, Thos. M. Clark & Thos. Sharp view a way proposed to turn the road which leads by Capt. Thos. Penns and report the conveniences & inconveniences resulting thereby as well to individuals as the publick. James W. Warhop is recommended to the executive as a fit person to serve as appointed Captain of the Militia in place of John Boyd superceded. (15 June 1827) Sharp v. Craddock The Defendant has died since the last Court. JULY COURT (12 July 1827) Ordered that Lewis T. Foster, John Parker and Warren Massey be appointed Commissioners to settle the account current of Saml. Packwood decd. and thereupon report said settlement to Court. On the motion of the Executor to the last Will and Testament of John Burnett decd. for admitting said Will to record, the same for sufficient reasons appearing to the Court is refused, it appearing to the Court from the examination as well of the subscribing witnesses to the said Will as other witnesses that the said John Burnett was not of disposing mind & memory. Abel Pedigo is allowed 2 days attendance as a witness for the Executors of John Burnett decd. to Prove his Will. Administration of the estate of John Burnett decd. is granted to Stephen Hubbard and John Turner who after being qualified according to Law entered into and acknowledged a bond Conditioned as the Law directs. John Hancock is allowed 2 days attendance as a witness for the executors of John Burnett decd. to prove said Burnetts Will. David Ross is allowed 2 days attenance for the same. An Inventory of the estate of John Burnett decd. was returned into Court by the Commissioners appointed to take the same, examined and ordered to be recorded. OCTOBER COURT (11 October 1827) Ordered that the Sheriff of the County pay George Lackey the sum of sixty Cents out of the depositum in his hands for 1827 for taxes improperly paid by him on a certain tract of land. A list of sales of the property of Hannah Smith decd. was exhibited in Court, examined and ordered to be recorded. A Deed from Elijah Harris & Nancy his wife to Jeremiah W. Hylton was acknowledged in court and Nancy Harris the wife of the said Elijah Harris, voluntarily and of her own free will relinquished her right of dower in the tract of land hereby conveyed to said Hylton. Richard Thomas is appointed Commissioner of the Revenue for the Auditor of Publick Accts. NOVEMBER COURT (15 November 1827) The rule pr. John Collins as administrator of Hezekiah Collins decd. for reasons appearing to the Court is discharged. Archebald Stuart, John Staples, John King and Saml. Flipping or any three of them are appointed Commissioners to settle the acct. current of Wm. Carter admr. of Wm. Moore decd. and also his acct. current as Guardian for Madison T. Moore & William H. Moore -- and make report thereof to Court. Cloud v. Dudley on attachment ordered to be docketed and continued until March Court next --- And Stephen Lyon comes into Court & files his interpleader whereupon the said S. Lyon being a non resident is ruled to security for costs within sixty days. (16 November 1827) Ordered that John Sharp & his hands, Thos. Reynolds & his hands, & Thos. Sharp & his hands do attend and clear out the roads, one from the forks of the road near John Conner(?) into the Courthouse road near the race paths above Cammeron old place and the other from the forks of the road near Thomas Penns Mill into the said Courthouse road near Mekins Reynolds under the superintendance of Thomas Penn & Hardin Hairston or either of them.
