PATRICK COUNTY, VA - COURT - Order Book "3" (Selected Entries, 1829) ----¤¤¤---- JANUARY COURT (15 January 1829) Present: Richard Thomas, Clark Penn, William Critz, Jesse Corn & M. R. Hughes -- Gentlemen Justices ...a Deed of trust from Samuel Nowlin and M. Sandefur trustee to Abram Staples with the Certificate of acknowledgement thereon endorsed was exhibited in Court examined and ordered to be recorded. Also a deed of trust from the same and Samuel Sharp trustee to James M. Redd with the Certificate of acknowledgement thereon endorsed was also exhibited in Court examined and Ordered to be recorded. Also a Deed of Release from Samuel Nowlin and Olive his wife to the same with the Certificate of acknowledgement and relinquishment of Dower thereon endorsed was exhibited [in Court examined and ordered to be recorded.] Ordered that the Clerk of the Court certify to the Auditor of public Accounts that Amelia Eaton a Lunatic confined in Jail by virtue of a warrant signed by Jesse Corn & others Justices of the peace And also Rhoda Martin a Lunatic confined in Jail by virtue of a warrant signed by Jno. Hall & others Justices of the peace were at the time of their commitment, & ever since, insolvent & unable to pay the fees of the Jailor. A Deed of Trust from Wm. Sans and Saml. Sharp Trustee to James M. Redd was acknowledged & ordered to be recorded. FEBRUARY COURT (12 February 1829) A deed of trust from William Nowlin and Samuel Sharp trustee to John Jones with the Certificate of acknowledgement thereon endorsed was exhibited in Court examined and Ordered to be recorded. Also a Deed of trust from Jacob Grigg and William Lyon trustee to A. Staples with the Certificate of acknowledgement thereon endorsed was exhibited in Court examined and Ordered to be recorded. On the Motion of John Burnett Jr. it is ordered that George Lackey, Micah Johnson and Shadrack Turner be appointed Commissioners to view a way for Turning the road across the head of his Mill pond and make report thereof to Court. Clark Penn esqr. is appointed Surveyor of the road from the fork of the South Mayo river near Penns plantation to Russells Creek on the east side thereof and that the list filed be his gang. Jacob Clark is appointed Surveyor of the road from the east side of Russells Creek near Majr. Stovalls to the forks of the road near William Clarks And that the list filed be his gang. Administration of the estate of Jesse Reynolds decd. is granted to Mekins Reynolds & Barnabas Belisle whereupon they together with James M. Redd & Madison R. Hughes their securities entered into & acknowledged bond for the sum of eight Thousand dollars conditioned according to law. A Deed from Wm. N. Sharp to Samuel Sharp acknowledged & ordered to be recorded. John G. Lee, Joshua Adams, William Crum & Wm. Critz or any three of them are appointed Commissioners After being first sworn to appraise the estate of Jesse Reynolds decd. and make report thereof to Court. On the motion of Gregory Hagwood it is ordered that Lewis T. Foster & John Parker be appointed Commissioners to Settle the Account current of the executors of Ignatius Sims decd.... MARCH COURT (12 March 1829) Philipena Sharp, wife of Wm. Sharp, comes into Court and voluntarily relinquishes her right of dower to a tract of land containing 100 acres lately sold by her said husband to Saml. Sharp. Frederick Critz and Jesse Corn esqrs. are recommended to the Executive, one of whom to be commissioned as Coroner of this County. Alfred C. Moore Upon the Motion of Archd. Stuart and upon the production of his licence took the oath of Office & the oath of fidelity etc. as an attorney at law, and thereupon is admitted to practice in this County. MAY COURT (10 May 1829) William Lyon exhibited in Court an account agt. the Public for four dollars and Twenty cents, which was examined, allowed & ordered to be Certified to the Auditor of P. accounts. Thomas Penn Gentleman produced a Commision to be sheriff of this County and thereupon he together Frederick Critz, Abram Staples, Reuben Hughes, Greensville Penn & H. Hairston his securities entered into and acknowledged bonds according to law for the faithfull discharge of the several duties of the said Office, which bonds are Ordered to be recorded and thereupon the said Thomas Penn took the oath of fidelity to the Commonwealth, the oath of Office and the oath to support the Constitution of the United States and also the antiduelling Oath. John Lyon is by Thomas Penn sheriff of this County appointed his undersheriff during pleasure and thereupon the said John Lyon took the oath of fidelity to the Commonwealth, the oath of Office and the oath to support the Constitution of the United States and the antiduelling oath, it appearing to the satisfaction of the Court that he is a man of honesty probity and good demeanor. On the Motion of A. Staples and John Cassell for leave to Keep a Tavern in the [town] of Taylorsville, and upon the production of the sheriffs receipt for the tax imposed by law, the same is granted them.... East ditto 12 days & 2 sign boards - 2 years 8.00 To Jno. King ditto 3 days 1.50 JULY COURT (17 July 1829) On the motion of James W. Wauhop it is ordered that John Scott, Eleanah Ayres and Martin Cloud or any two of them do view a way for turning the road near Penns old place from the branch to the top of the Hill at the Burnet house and make report thereof to Court. On the motion of Wm. Lyon it is ordered that Claiborne Shelton, Conrad Plasters, Wm. Griffith & Jno. B. Williams or any three of them be appointed Commissioners to view a way for a road from the Creek near Conrad Plasters to the sinque holes on the Bull Mountain road and make report thereof to Court. AUGUST COURT (13 August 1829) Present: H. Fitzgerald, Adam Turner, George Carter, and Joseph Kennerly -- Gentlemen Justices Read et al vs. Fitzgerald Executor et al et al in Chancery dismissed agreed at the Defendants Costs. Gilbert v. H. Fitzgerald dismissed agreed. The Commissioners appointed to view a way for a road from the Creek near Conrad Plasters to the sink holes on the Bull Mountain road having made a report that a road may be had advantageous to the public and without injury to any individual, On the motion of Wm. Lyon it is ordered that Wm. Witt & his gang, the said Lyon & his and James Akers & his gang under the superintendance of Wm. Lyon and Wm. Witt clear and open the said road. Frederick Critz who is appointed Coroner by the Commission of the Governor of this Commonwealth bearing date the 27th March 1829 Appeared in Court & took the oath of office and the several oaths prescribed by law and thereupon he together with Joseph Kennerly & R. Thomas his securities entered into and acknowledged bond conditioned according to law. (15 August 1829) Martin v Thomson & others In Chancery The bill of the Complainant dismissed as to Alexr. Murphy, and leave given the complainant to amend his Bill and the suit revived against A. Staples exor of S. Staples decd. by consent and Continued. Shelton exors v. Sheltons Heirs In Chancery. This day came on this cause to be heard on the bill answers and exhibits and was argued by counsel whereupon it is adjudged ordered and decreed that Abram Staples, George Carter and Silas Carter who are appointed commissioners for that purpose do divide the lands in the Bill mentioned among the devisees of Eliphaz Shelton and if they find it necessary in order to effect said division they are authorized to sell any part or the whole of said lands privately or publicly as they may think proper, And they are hereby required to report to Court how they have executed this decree. NOVEMBER COURT (12 November 1829) ...a deed of trust from Joseph Sharp and M. Sandefur trustee to Abram Staples with the like Certificate of acknowledgement therein endorsed was presented in Court, examined & admitted to record. A Deed of Bargain and sale from George Rogers and Ann his wife in connection with Jno. Smith & others to Anthony Overby with the several certificates thereon endorsed was exhibited in Court examined and ordered to be recorded. James Lyon esq., Wm. Moore esq., Joseph Cloud, Henry Hurt, Cornelius Hurt, Nathl. Shelton, Larkin Burige, Jesse Radford, Joseph V. Grigg esq., George Hart, Milton Hart, Tabitha Greenwood, David Hall, Greensville Hall, John Webb, and Martin Burge appeared in Court and each acknowledged themselves severally endebted to his excellency William B. Gates esq., Governor or chief Magistrate of this Commonwealth in the sum of One hundred dollars upon their respective goods and Chattels lands and tenements to be levied upon Condition they shall not appear appear at the next Court to be holden for this County in the month of December next and their and then give Testimony on behalf of the Commonwealth against a certain Edmund Beasley charged with the murder of John Hurt on the [left blank] day of May 1828, and not depart thence without the leave of the said Court. DECEMBER COURT (17 December 1829) On the motion of Haman Critz one of the Admrs of H. Critz decd. It is ordered that Greenl. Penn, C. J. Terrell & Hardin Hairston or any 2 of them be appointed Commissioners to settle the Acct. current of the sd. Haman Critz & Wm. Critz admrs of H. Critz decd. & make report thereof to Court.
