PATRICK COUNTY, VA - COURT - Order Book "3" (Selected Entries, 1830) ----¤¤¤---- FEBRUARY COURT (11 February 1830) A deed of trust from William Sawyers and William Lyon trustee to Harden A. Moore with the Certificate of acknowledgement thereon endorsed by the said Sawyers and Lyon before the Clerk of this Court was presented in Court and Ordered to be recorded. A deed from John Hall attorney for James Hall, John Turner for himself and as attorney for Crawford & Cornelious Burnett, Jesse Corn, and Shadrack Turner, Legatees and distributees of John Burnett decd. to Thomas R. Hall Proved by one Witness & Certified for further Proof. Ordered that the road upon which William Burge is surveyor be extended to the ford of Little Dan and the said Burge forthwith proceed to work thereon with his gang according to Law. A list of the sales of the Property of Jesse Reynolds decd. was returned into Court by the administrators thereof, examined & ordered to be recorded. Administration of the estate of William C. Herring decd. is granted to John ...? whereupon he took the oath of an Administrator and together with Archibald Stuart his security entered into and acknowledged bond in the sum of two hundred dollars conditioned according to law. A deed of trust from Absolem Shelton and Saml. Sharp Trustee to James M. Redd acknowledged and ordered to be recorded. MARCH COURT (11 March 1830) ...a Deed of trust from Herbert Shelton and Saml. Sharp trustee to Abram Staples, George Carter and Silas Carter, Commissioners acting under a decree of Patrick County Court, proved and ordered to be recorded. A deed from John Jones to Elum Newman with the Certificate of acknowledgement thereon endorsed before the Clerk of the Court was Presented in Court, Examined and ordered to be recorded. Also a Deed of Release from Elum Newman and Nancy his wife to John Jones with the Certificates of acknowledgement & relinquishment thereon endorsed was exhibited in Court, examined & ordered to be recorded. John Tatum Gentlemen Produced a Commission to be sheriff of this County and thereupon he together with Greensville Penn, Hardin Hairston, R. Thomas, Arch. Stuart, John A. Hairston, Gabl. Hanby, A. Staples & J. M. Redd his securities entered into and acknowledged bonds according to Law for the faithful discharge of the several Duties of the said office which bonds are Ordered to be recorded, and thereupon the said John Tatum took the oath of fidelity to the Commonwealth, the Oath of Office and the oath to support the Constitution of the United States & also the anti duelling Oath. Wm. Lyon, Saml. Sharp, John Lyon & Jackson Penn Are by John Tatum sheriff of this County appointed his under Sheriffs during pleasure and thereupon the said Wm. Lyon, Saml. Sharp, Jno. Lyon & Jackson Penn took the oath of fidelity to the Commonwealth the Oath of Office and the oath to support the Constitution of the United States and also the Anti duelling Oath, it appearing to the satisfaction of the Court that they are men of Honesty Probity and good demeanor. John Castle is appointed Surveyor of the road from the Bull Mountain fork to Patrick Ct.House & it is ordered that the list filed Constitute his gang. Britt Stovall foreman, Elijah Dehart, Barnabas Belisle, Jas. Dillard, Isham Bernard, Joseph Bredin(?), Thos. Harbour, Obediah Belcher, Wm. Joyce, Mekins Reynolds, James Newman, H. R. Hall, Wm. Ross, Elum Newman, Jona. Davis & Thomas Dehart were sworn a Grand Jury of inquest for the body of this County And after receiving their charge withdrew to Consult upon their presentments and after some time returned into Court with an Indictment against Archilous Bowman for an assault a true Bill & also an Indictment against Herbert Shelton, Eliphaz Shelton, Augustine Gunnell, John Helms, Moses Burnett and James Houchings for an assault & rescue of Property from Sheriff a true Bill, and having nothing further to Present were discharged. (12 March 1830) Fitzgerald et al Executor of E. Shelton v. Layman non assumpsit & Limitation and Continued. Frederick Critz, Madison R. Hughes & Joseph Kennerly & Ben Frasure any three to act are appointed Commissioners for superintending the election at Greensville Penns. Martin Cloud, Jacob Grigg, Wm. Carter and Thomas Whitlock any three of whom to act for the Hollow district. John A. Hairston, Jesse Corn, James Via, and John Turner any 3 of whom to act for the Election at Turners and Mat Sandifur, Jeremiah Burnett, Richard Thomas and Thomas Harbour any three of whom to act for the election at Adams. MAY COURT (13 May 1830) A deed from Saml. Nowlin and William Lyon trustee to Abram Staples with the Certificate thereon endorsed of its acknowledgement before the Clerk of this Court was presented in Court examined & ordered to be recorded. A Power of Attorney from Alexander Joyce to James Coffey with the several Certificates thereon endorsed was exhibited in Court Examined & ordered to be recorded. Solo. Washington, James Willis, James Reynolds & Wm. Spencer or any 3 of them are appointed commissioners to view a way for turning the road from the forks below Jno. Tuggles & up the Creek near to said Tuggles and make report thereof to Court. An account current of the estate of John Ingram Decd. was returned into Court by the Commissioners examined & ordered to be recorded. Jno. W. Ivy is appointed survey of the road in place of Wm. Murphy resigned & that the same hands constitute his gang. On the motion of John Sharp senr. and Andrew Chivers they are each exempted for the future from the payment of County levies. On the motion of James Lawson Senr. It is ordered that he be exempted from the payment of County Levies for the future. JUNE COURT (17 June 1830) To Abr. Carter having produced the Sheriffs receipt for the tax imposed by Law, license is granted him to keep a house of private entertainment in his own house in this County till the 1st day of May next. William Sawyers is appointed surveyor of the road in place of John Eaton resigned. And it is ordered that the hands which were under the said Eaton constitute his gang. William Lyon having produced the Sheriffs receipt for the tax imposed by law, licence is granted him to keep a house of private entertainment at his own house in this County till the first day of May next. JULY COURT (15 July 1830) Saml. M. Flipping Jr. comes into Court and made choice of his father Saml. Flippin, whereupon he was appointed Guardian for the said Saml. M. Flippin and he together with Abram Staples his security enters into bond in the sum of fifty dollars conditioned according to law. John B. Williams is appointed Surveyor of the road from the Creek near Conrad Plasters to the sink holes, and that Marvel Bolling & sons, Hudson Shelton & sons, Haman Shelton, Wm. Griffith, Lewis Arrington, John Handy & John Helm constitute his gang. AUGUST COURT (12 August 1830) A deed from William Collings and Martha Collings to Edmund Collings further and fully proved & ordered to be recorded. Also a Deed from Edmund P. Wells, Mary M. Wells and Jefferson R. Hughes to James M. Redd proved & ordered to be recorded. An Inventory and appraisement of the estate of William Collings sr. decd. was returned into Court by the Commissioners appointed to take the same Examined & ordered to be recorded. Also a Deed of Trust from Thomas Sharp and Jesse Corn trustee for John A. Hairston acknowledged as to Hairston and Corn and certified for further proof as to Sharp. Columbus Penn Commissioner of the Revenue of this County is allowed seventy five days within which he was engaged taking the land and property lists in this County the present year, And it is ordered that the same be certified to the Auditor of Public Accounts. (13 August 1830) Newman for et al v. Newman. A Jury sworn to wit, Saml. Gilbert, Joseph Edwards, Wm. Parker, John A. Cloud, Rowland Hurt, Peter Critz, James Bolt, Saml. Harriss, Wm. Rainey, Joseph Cox, Wm. Conner and Charles Botts, who being elected tried and sworn the truth to speak upon the issue joined went out of Court to consult upon their verdict and after some time returned into Court and declared they could not agree And thereupon by consent of the parties Saml. Gilbert one of the Jurors aforesaid was withdrawn and the rest from rendering their Verdict discharged and the Cause continued till the next Term. Hall v. Lyon Dismissed by pliffs directions. Sheltons exors v. Layman Contd. Massey (Manning?) for et al v. Hill a Jury sworn to wit Jonas Plasters, Samuel Morris, Pryor Pendleton, Jona. Elgin, James Conner, John Hubbard, Wm. A. Sandefur, Jona. Hubbard, George Rogers, Jeremiah W. Hylton, George Wiggenton and John Davis, who being elected tried and sworn the truth to speak upon this issue joined upon their oath do say, "We of the Jury find for the plaintiff & assess his damages at thirty dollars with Interest from 25th Decr. 1820." Therefore it is considered by the Court that the plff. recover of the Deft. the damages aforesaid in form aforesaid assessed together his Costs etc. and the Deft. in money etc. SEPTEMBER COURT (16 September 1830) A deed of trust from Winston Newman and Saml. Sharp trustee to James M. Redd with the Certificate of acknowledgement thereon endorsed was exhibited in Court examined & ordered to be recorded. A Deed from Fleming Harris to James Conner with the certificate of acknowledgement before the D.Clerk together the certificate of John Hall and Jesse Corn esqrs. two Justices of the peace for this County of the relinquishment of Dower by Nancy Harris wife of the said Fleming to the land in the said Deed mentioned was exhibited in Court, examined & ordered to be recorded. A certificate of the relinquishment of Dower by Sally Carter wife of George Carter before Harvey Fitzgerald and Wm. Critz two of the Commonwealth Justices of the peace to certain Lands contained in a certain Deed in the said certificate expressed was exhibited in Court & ordered to be recorded. OCTOBER COURT (14 October 1830) ...a Deed from William McAlexander to Edmund McAlexander with the the Certificate of acknowledgement thereon endorsed was exhibited in Court examined & ordered to be recorded. A deed from A. Staples, George Carter and Silas Carter Commissioners acting under a Decree of the Court of this County in Sheltons heirs agt. Sheltons to William A. Sandifur with the Certificate of acknowledgement thereon endorsed was exhibited in Court further acknowledged by the said A. Staples & Silas Carter & ordered to be recorded. Also a Deed from the same Commissioners to Sebird Webb with the like Certificate of acknowledgement thereon endorsed was also exhibited in Court further acknowledged by the said A. Staples & Silas Carter & ordered rec. Also a deed from William Griffith to William Cassell Acknowledged & Nancy Griffith, wife of the said William Griffith..... On the motion of William Spencer Sr. it is ordered that he be exempted from Paying County and parish Levies in the future. A list of Insolvent Property and Lands returned into Court by William Lyon deputy sheriff for John Tatum was examined passed & ordered to be Certified to the Auditor of public accounts. On the motion of Shadrack Overby (Oglesby?) it is ordered that he be exempted from Paying County & Parish Levies in the future. NOVEMBER COURT (11 November 1830) A deed of trust from William A. Sandifur & Wm. Edwards Trustee to A. Staples, Silas Carter & George Carter, Commissioners acting under a decree of this Court in Sheltons vs. Sheltons, with the Certificate of acknowledgement thereon endorsed was exhibited in Court examined & ordered to be recorded. Also a deed of trust from Sebird Webb and Wm. Edwards Trustee to the same Commissioners with the like certificate of acknowledgement thereon endorsed was exhibited in Court, examined & ordered to be recorded. Also a Deed from Wm. McAlexander & Nancy his wife and John McAlexander Senr. to Henry Rakes with the certificate of acknowledgement thereon endorsed before the deputy Clerk as also the relinquishment of the dower of the said Nancy before Jesse Corn & John Hall, esqrs. thereon endorsed was exhibited in Court examined and ordered to be Recorded. William Ross is appointed Surveyor the road in place of James Via removed & It is ordered that the list filed be his gang. Frederick Critz who was heretofore appointed Coroner appeared in Court and together with Richd. Thomas his security entered into and acknowledged bond conditioned according to law. Hudnal, Madison Fitzgerald, Frederick Gilbert & James Nowlin, who being elected and sworn according to law went out of Court to consult upon their verdict and after some [time] returned and declared they could not agree and thereupon by consent of the parties John Duvall one of the Jurors aforesaid is withdrawn and the rest from rendering their Verdict discharged. DECEMBER COURT (16 December 1830) Present: John Tuggle, Jesse Corn, Richard Thomas, Norman Staples -- Gentlemen justices A Relinquishment of Dower from Rosannah Jones wife of John Jones to Elum Newman was returned to Court, exmained & ordered to be recorded. John Conner, William Conner & Wm. Lawson are appointed Commissioners to view a way for a road from Isaac Adams up the mountain ...(?) John Conners so as to meet a road cut by the Citizens of Grayson to the county line and make report thereof to Court. A Deed from Jesse Corn & Elizabeth his wife to James Via with the certificates thereon endorsed as well by the said Jesse as the said Elizabeth his wife relinquishing her dower to the land thereby conveyed was exhibited in Court examined & ordered to be recorded. Wm. Critz, John G. Lee & Bara. Balisle or any two of them are appointed Commissioners to settle the Acct current of Joshua Adams exor of John Bolt (?) decd. and make report thereof to Court. Addison Philpott is appointed Guardian for Sarah Philpott and infant daughter of Benjm. Philpott decd. Whereupon he entered into & acknowledged bond with John Massey his security in the sum of One hundred dollars Conditioned according to law, & took the oath of an Administrator. An article of agreement between Abr. Staples & James M. Redd of the one part and Hudson Shelton & Claiborne Shelton of the other part, with the Certificate affixed thereon endorsed was exhibited in Court examined & ordered to be recorded. Francis Nowlin appeared in Court in discharge of his recognizance entered into before Clark Penn esq. as well for his appearance here today as for keeping the peace towards the Citizens of this Commonwealth Generally & particularly towards Peter Keaton of this County, it is the opinion of the Court that the said Francis Nowlin be bound in the sum of fifty dollars & two securities in the sum of twenty five each, And thereupon the said F. Nowlin and A. Staples & Jefferson Court [sic] his securities acknowledge themselves indebted to John Floyd esq. Governor of Virginia & his successors Viz. the said F. Nowlin in the sum of fifty dollars and the said Staples & Hughes each in the sum of twenty five dollars upon their several goods and Chattels land & tenements to be levied upon Condition that the said Francis Nowlin shall not be of good & Keep the peace for twelve months towards the Citizens of the Commonwealth generally & particularly towards Peter Keaton of this County.
