McAlexander Surveyor of a Road for 4 days services 0.50 To Francis Nowlin ditto for 1 day and 1 sign board 0.62½ To John Grady for guarding as per Acct. sent from the Superior Court for payment 9.75 To Wm. Tatum ditto 3 days 0.37½ SEPTEMBER COURT (11 September 1834) ...a Deed from Samuel Sharp trustee to John Cassle with the certificate of acknowledgement in Office thereon endorsed was exhibited in Court, examined & ordered to be recorded. An Account current of Nathan Hall and James Ingram Jr. Executors of John Hall Decd. was returned to Court examined and ordered to be recorded. Clark Penn who was appointed Commissioner of the Revenue for this County produced a certificate of his qualification as such before James W. Wauhop esq. one of the Justices of this County, which is ordered to be filed. The relinquishment of dower by Frances L. Sharp to a tract of land sold by Saml. Sharp her husband to Wm. Pickarel, mentioned in a deed bearing date the 14th decr. 1831 & recorded in this Office was presented in Court & ordered to be recorded. Joshua Harbour is appointed Surveyor of the road in place of Joseph Moles resigned And it is ordered that the hands assigned the said Moles constitute his gang and that he keep the said road in repair according to law. NOVEMBER COURT (15 November 1834) Fitzgerald exor. et al vs. E. Sheltons Heirs In Chy. Decree Nisi against the home defendants. Fitzgerald et al vs Sheltons Heirs In Chy. This day this cause came in to be heard upon the papers heretofore read & the report of Commissioner Sandifur and was argued by Counsel, and it appearing to the satisfaction of the Court that the decree entered at the May Term 1831 remaining unexecuted, and that Abram Staples one of the Commissioners appointed by the said Decree has since entering the same become interested in the estate of Eliphaz Shelton deceased, It is adjudged ordered and decreed that Matthew Sandifur who is hereby appointed Commissioner for that purpose, do proceed to execute the said Decree in lieu of the Commissioners therein named in the manner therein decreed, and that he do further collect by suit or otherwise as they are due or become due the sums for which the land decreed to be sold by another decree entered into at Nov Term 1831, were sold according to the report above referred(?) to. That as fast as he shall collect the same he shall pay over the same, after paying the Costs of this suit, to each of the Devisees of Eliphaz Shelton deceased or those claiming under them in equal portions according to the provisions of the Will of Eliphaz Shelton Provided that said Commissioner if it shall be more agreeable to the Divisees aforesaid may instead of collecting the said Sums, divide the bonds taken for the same among the said Divisees taking their receipts for the sums in so much money made. And the said Commissioner is ordered to report to Court how he has executed this decree. Ordered that George King, Surveyor of the road do hereafter work & keep in repair the road from the sign board at Thomas Beasleys to Peters Creek near Mrs. Hanbys instead of his former precinct. Ordered that Thomas Beasley Surveyor of the road do hereafter work & keep in repair the road from Dann near Majr. Carters to the ford of Little Dann river at the old Hollow road. Ordered that the account of Thomas H. Bray Constable for the sum of $3.15 be certified to the Auditor of public Accounts. (Transcribed by Mary C.
