PATRICK COUNTY, VA - COURT - Order Book "4" (Selected Entries, 1839) ----¤¤¤---- JANUARY COURT (17 January 1839) The Commissioners appointed at December Court last to View away for Turning the road from the foot of the Hill near Patsy Fulchers by A. Staples' new mill in to the public road near Patrick CtHouse reported today favorably to said Change, & the said A. Staples, John Cassell and William A. Sandifur the proprietors through whose lands the said road will run being in Court & giving their assent thereto the report is therefore adopted & it is ordered that John Cassell as superintendant with his own gang, Robert Johnson & his gang, Richard Ziglar & his gang, & John Clark do forthwith proceed to open the said road according to law, and then to return to their respective roads. George C. Dodson is appointed School Commissioner in place of C. Penn resigned. Wm. C. Shelton is appointed surveyor of the road in place of Saml. Clark removed & it is ordered that the hands who worked under the said Clark and constituted his gang, constitute the gang of the said Shelton and that they Keep the said road in repair according to Law. Ordered that C. Ziglar, John Clark Jr., John Cassell & William Critz or any three of them be appointed Commissioners to View a way for turning the road leading by C. Ziglars to Patrick CtHouse, so as to resume the old road leading from a point below said Ziglars into the road below Patsy Fulchers & report to Court their action thereupon. On the motion of C. Penn administrator of Joseph Kelly decd. ordered that John Prunty, John Koger and Benjamin Morriss or any Two of them be appointed Commissioners to settle with the said Penn his account with his intestates estate and report to Court.... JUNE COURT (13 June 1839) Commonwealth vs. Elisha Lyon. Defendant comes in Court & confesses Judgment for one Cent, therefore it is Considered by the Court that the Comwealth recover against the defendant the sum aforesaid in form aforesaid together with the Costs in this behalf expended & the Defendant in M..? & etc. John G. Lee, John D. Cheatham & Th. M. Clark or any three of them are appointed Commissioners being first sworn to state & settle the account current of William Collings decd. and report to Court their action thereupon. Thomas Penn, Th. M. Clark, John Koger and John Prunty or any three of them are appointed Commissioners to state & settle the account current of John G. Lee administrator of F. Trent decd. and report to Court their action thereupon. Overseers of the Poor vs. Wm. Turner in a Recognizance contd. for defendant and Rule against the Witnesses B. M. Price Jr., Polly James and John Burnett. John G. Lee, Joshua Adams and John Washburn Sr. or any three of them are appointed Commissioners to state & settle the account current of Meekins Reynolds, administrator of Moses Reynolds decd. & also of Susanah Reynolds decd. & report to Court their action thereupon. JULY COURT (11 July 1839) Tyler vs. Sharp on appeal Contd. Ordered that John G. Lee, D. Reid, F. Critz & H. C. Frans or any two of them be appointed commissioners to settle the account current of Th. Penn executor of Charles Foster decd. & report to Court their action thereupon. Jeremiah Burnett ..? appeared in Court in discharge of his Recognizance entered into before Jeremiah Burnett esq. for his appearance here today & for reasons appearing to the Court he is required to find security for his appearance at the next Court & thereupon the said J. Burnett, H & Jesse Chainy acknowledged themselves to owe & be indebted to D. Campbell Governor of the Comwealth of Va. & his successors in Office each the sum of Seventy five dollars to be levied of their respective goods & Chattels lands & tenements upon Condition that the said J. Burnett does not make his personal appearance at this place at Aug. Court next & abide by the decision of the court upon the Complaint of the Overseers of the poor agt said Burnett, if he does then this obligation is to be Void. SEPTEMBER COURT (12 September 1839) The account current of the administrators of Thomas R. Hall decd. was presented in Court examined & ordered to be recorded. William A. Sandifur is appointed surveyor of the road in place of John Clark resigned & it is ordered that the list of the hands filed be his gang & that they Keep the same in repair according to law. Ordered that A. H. Carter be allowed two dollars per day for seventy five days services as Commissioner of the Revenue for this County the present year which is ordered to be Certified to the Auditor of public accounts. A Deed from William Ayers & wife to Larkin Howell, Jeremiah B. Tuggle, & Henry Tuggle with the certificates thereon endorsed was presented in Court & admitted to record. Tyler vs. Sharp on appeal Dismissed for want of prosecution. DECEMBER COURT (12 December 1839) Administration of the estate of Obadiah Burnett Sr. decd. is granted to Valentine Burnett, who made oath according to law and together with John Conner and Gabriel Bolling his securities entered into and acknowledged a bond in the penalty of five hundred dollars conditioned according to law, letters of administration is therefore granted him in due form. Crawford Turner, Jesse Chainy and Daniel Conners or any two of them are appointed Commissioners, being first sworn before some Justice of the peace according to law, to appraise in current money the personal estate of O. Burnett Sr. decd. & report to Court accordingly. (Transcribed by Mary C.
