PATRICK COUNTY, VA - COURT - Order Book "5" (Selected Entries, 1840-41) ----¤¤¤---- 1840 MARCH COURT (12 March 1840) Harvey Fitzgerald esq. produced in Court a Commission under the seal of the Commonwealth bearing date the 20th day of December 1839 appointing him Sheriff of this County untill the first quarterly Term of this Court in the year 1841 and thereupon the said H. Fitzgerald together with P.P. Penn, A. Staples, Greensville Penn, Th. J. Penn, Isaac Adams, Clark Penn, and Richard Thomas his securities entered into and acknowledged three several bonds in the penalty of twenty thousand dollars conditioned according to Law and took the several Oaths prescribed by law. By consent of Harvey Fitzgerald Sheriff of this county Thomas M. Clark, Haman Critz, Robert Clark, William J. Robertson and George C. Dodson are permitted to act as his Deputies during pleasure & thereupon they severally took the oaths prescribed by law, it appearing to the satisfaction of the Court that they are all men of honesty probity and good demeanor. Jubal A. Early Gent. who hath been duly Licensed to practice the law in the Courts of this Commonwealth On his motion has leave to practice in this Court & thereupon he took the Oath of fidelity to the Comwealth, the Oath of an attorney at Law & the Oath to support the Constitution of the United States. 1841 FEBRUARY COURT (11 February 1841) On the motion of Clark Penn for leave to Keep a House of private entertainment in this County the same for reasons appearing to the Court is granted him, it appearing to the satisfaction of the Court that he is a man of honesty probity & good demeanor. Meekins Reynolds is appointed Surveyor of the road in place of J. Taylor resigned & it is ordered that the said Taylors hands be those of the said Reynolds & that they keep the said road in repair according to law. Asa Wood is appointed Constable in place of William A. Sandefur resigned, the Court voting Viva Voce, and thereupon the said Wood took the several Oaths required by law and entered into and acknowledged a bond conditioned according to law with William Spencer and William Martin his securities. Hatcher, Gabriel Critz, Jackson Penn, Clark Penn, Thomas Penn & Greensville Penn his securities entered into and acknowledged three several bonds in the penalty of $20,000 each Conditioned according to law and took the several Oaths prescribed by law. By consent of the said H. Fitzgerald Sheriff of this County, Th. M. Clark, Haman Critz, Wm. Robertson & D. B. Hatcher are permitted to act as his Deputies during pleasure and thereupon they severally took the oaths prescribed by law, it appearing to the satisfaction that they are all men of honesty probity and good demeanor. The declaration of Francis Sharp, an applicant for a pension under the laws of Congress was presented in Court, examined & ordered to be certified to the Department of War. The account current of Meekins Reynolds administrator of Moses & Susannah Reynolds decd. was presented in Court examined & ordered to be recorded. Nancey Eaton is appointed Guardian for her children namely Calvin N. Matilda Lethe Albert, and Susan Eaton, children under the age of twenty one years and thereupon the said Nancey Eaton entered into and acknowledged a bond conditioned according to law in the penalty of six hundred dollars. A. Stuart, William East and Isham East or any Two of them are appointed to settle the account of M. Cloud executor of John Eaton decd. and report to court their action thereupon. The account current of the executors of Ignatious Sims decd. was presented in Court examined & ordered to be recorded. JUNE COURT (18 June 1841) To Mark Plasters 28 hours patrolling $1.60 To Sam Gilbert 10 do do .62½ To John Cassell 4 days work on his road as surveyor 2.00 To Same for 131 hours patrolling 7.90 To David Rogers 3 do do & 3 signboards 3.00 To Herbert Shelton 1 do & 2 do 1.50 To William Houchens 5 do do 2.50 To John McAlexander 3 do do 1.50 To William A. Sandefur 3 do do 1.50 On the motion of A. Staples and Herbert Shelton and upon the production of the Sheriffs receipt for the tax imposed by law, leave is given them to keep an Ordinary at Patrick Courthouse in the County of Patrick, it appearing to the satisfaction of the Court that they are men of honesty probity & good demeanor and not addicted to gambling and thereupon they entered into and acknowledged a bond in the penalty of one hundred and fifty dollars with good and sufficient security conditioned according to law. DECEMBER COURT (16 December 1841) Ordered that Charles Wilson and James Joyce or any one of them be appointed Commissioners to state and settle the account current of James Craddock decd. and report to Court their action thereupon. Spencer Nowlin is appointed surveyor of the road in place of Harbert Shelton resigned and it is ordered that the hands of said Shelton be those of said Nowlin. Jackson Penn vs. Wright Moorefield Ordered that John G. Lee be and is hereby appointed a commissioner to settle with Wright Moorefield and ascertain what amount of the property of said Moorefield he has accounted for and what is the amount of the rent of the present year and that he also proceed to rent out the lands of Peter Boss and report to Court his proceedings therein. The last Will and testament of Thomas Whitlock decd. was presented in Court further proved by the oath David P. Stuart one of the witnesses thereto subscribed and ordered to be recorded. On motion of Brett Stovall chief surveyor for this County John N. Kasey is appointed a Deputy to said surveyor and thereupon the said Kasey appeared in Court and took the oaths prescribed by law.
