PATRICK COUNTY, VA - COURT - Order Book "5" (Selected Entries, 1842) ----¤¤¤---- APRIL COURT (14 April 1842) On the motion of Charles Thomas Jr. it is ordered that Saml. Rakes, Henry Crum, James Martin and Reuben Wright or any three of them be and they are hereby appointed commissioners to view a way for a road from the Franklin road through Capt. Wm. R. Youngs plantation by said Thomass mill on Smiths river at the White falls to intersect with Rakes road leading to Franklin between Saml. Boyds and Elisha Cockrans and report to Court their action thereupon. Harvey Fitzgerald esqr. produced in Court a commission under the seal of the commonwealth bearing date the 3rd day of December 1840 appointing him Sheriff of this County until the first quarterly term in 1842 and contd in office until March Court 1843 by the failure of the qualification of a successor, & thereupon the said Fitzgerald with A. Staples, Clk Penn, Thos. J. Penn, P.P. Penn & Haman Critz, Thos Penn [sic, insert] his securities entered into & acknowledged a bond in the penalty of $20,000 conditioned according to law having the oaths prescribed by law. The Court proceeded to appoint overseers of the poor to day and thereupon the overseers of the poor heretofore appointed were unanimously reappointed with the exception of Colo. Young to fill whose place Colo. Baines Carter was appointed. Ordered that Jesse Corn, Baines Carter and Grandison B. Leseurer do make a supplemental Inventory of the estate of William Via decd and return the Inventory under their hands to Court being first sworn before some Justice of the Peace. JUNE COURT (16 June 1842) To James Light for 3 days work on his road as surveyor .75 To G. P. Sandifur for 1 do do .25 To Spencer Nowlin for 2 days work as surveyor & 1 sign board 1.00 To William Shelton for 2 do do .50 To A. B. Clark for 1 day .25 To Spencer Cockram 2 days last year & 1 day this year 1.25 TO Aaron Dehart for 1 old & 1 young red fox scalp .75 To Hardin W. Reynolds for 6 days as surveyor on his road last year & this year 2.25 To William A. Sandifur 8 do do this & last year 3.00 TO Armstead W. Newman for 77 hours patrolling @ 1.61 To William Carter for his services as coroner 5.00 Comwealth vs. Pickeral nolle Prosequi AUGUST COURT (13 August 1842) Sharp vs. Hanby Death of defendant suggested and the cause revived in the name of said defendants administrator and Contd. NOVEMBER COURT (18 November 1842) Present: Richard Thomas, William Critz, Jesse Corn and John Turner -- Gentlemen Justices Ordered that the order made at last Court appointing a superintendant and hands to open and change the road leading from Mrs. Susan Penns by Jessee Murphys across spoon creek into the Courthouse road above said Murphys be so far amended as to include the hands of Prior Tatum as surveyor now under Walter Freeman(?), John France and his hands, Jesse Murphy Jr. and his hands, Clark Penn and his hands and John N. Kasey and his hands, who are thereupon ordered with P.O. Penn as superintendant to open said road according to law. It appearing by satisfactory evidence that John Sharp Sr. was a pensioner of the United States at the rate of twenty dollars per annum, was a resident of the said County and died therein on the 30th day of May 1834 and that he left a widow whose name is Frances Sharp and the same is ordered to be certified to the war department. (19 November 1842) On the motion of Greensville Penn, it is ordered that Frederick Critz, John G. Lee and Absalom W. Scales or any two of them being first sworn before some Justice of the peace be and they are hereby appointed commissioners to state and settle the account current of Richard Mills decd. and report said settlement to the Court. Jesse Corn one of the acting Justices of the peace in & for this County appeared in Court today and entered his protest against the proceedings of the Court on yesterday in reference to its action on the recommendation of a Justice to be commissioned as Sheriff of this County as irregular and prejudicial to his right. Fitzgerald exors et al vs. Sheltons heirs In Chy. Ordered that the decree entered in this cause at the March Term of this Court in the year 1830 be so far amended as that Alexander A. Moir be appointed commissioner to execute the said decree in place of Mathew Sandifur and it is farther ordered that the said Mathew Sandifur pay over to the said Alexr. A. Moir any money which he may have collected under said decree and deliver to the said Moir any bonds which may remain in his possession by Virtue thereof. (Transcribed by Mary C.
