Allen and Mary his wife, Andrew J. Allen and Susannah his wife, Thomas Shelton and Elizabeth D. his wife, David Rodgers and Martha his wife. Asa Wood and Polly S. his wife, Sarah Allen and Martin Mabe and Lucretia his wife all of the county of Patrick and state of Virginia of the first part and Benjamin Frasure of the same county and State of the other part. Witnesseth, that whereas Anthony M. Dupry as commissioner under and interlocutory decree of the county Court of Henry , pronounced in the case of John Le Blum (Jr?), against the heirs of Edward C. Staples did on the 24th day of August 1844 convey by deed of that date to Anderson Allen of the County of Patrick a certain tract of land lying in the County of Patrick and designated and known as the Spring Tract containing 183 acres as by a survey made and bounded as laid down in said Deed to which reference is hereby made and which is of record in the county south of Patrick County and whereas the said Anderson Allen did sell to Martin S Spencer of the said County of Patrick fifty acres a part and parcel of said tract of one hundred and eighty three acres and taken off from the lower end thereof and whereas the said Anderson Allen has since departed this life leaving the said parties of the first part his heirs and representatives at law. And a portion of them his assignees or grantees of his said heirs and representatives and whereas the said parties of the first part have sold to Benjamin Frasure of the County aforesaid all their rights title and interest in and to the residence that is to say one hundred and thirty three acres more or less of the said tract of one hundred and eighty three acres conveyed as aforesaid by the said Anthony M Dupry and whereas no survey of the said one hundred and thirty three acres more or less, since the sale of the said fifty acres to the said Martin Spencer has been made so that the precise boundaries corners and distances of the same are unknown to the said parties and they having agreed upon a certain line of boundary of that part of said tract from which said fifty acres was taken off. Now therefore this Indenture Witnesseth that the said Charles M. Allen and Mary his wife, Andrew J. Allen and Susannah his wife, Thomas Shelton & Elizabeth D. his wife, David Rodgers & Martha his wife, Asa Wood & Polly S. his wife, Sarah Allen, Martin Mabe and Lucretia his wife for and in consideration of the sum of nine hundred and ninety five dollars to them in hand paid at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, granted bargained and sold and by these presents as granted, bargained and sold unto the said Benjamin Frasure his heirs and assignes forever all their right tittle and interest in and to the aforesaid tract of one hundred and thirty three acres more or less lying and being in the County of Patrick as aforesaid and bounded by the metes and bounds laid down and described in the deed aforesaid from Anthony M Dupry to the said Anderson Allen to which reference for a more particular description of the same is hereby made. So far as the said metes and bounds may be applicable and bounded on the lower part of said tract by a certain boundary as agreed upon by said parties as follows to wit; Beginning at a Maple on the north side of the old road a new corner agreed upon by the said parties , thence running to a black Gum -- [[ pg. 535-b]] on a tract being the main tract below the spring thence nearby a stone line to a Spanish Oak in the back line, together with all the estate rights, title, interest and property claim. And demands whatsoever of them, the said Charles M. Allen, Mary his wife, Andrew J. Allen and Susannah his wife, Thomas Shelton and Elizabeth D. his wife, David Rodgers and Martha his wife, Asa Wood and Polly S. his wife, Sarah Allen. Martin Mabe and Lucretia his wife; in law or (?equal) or other wise however of in to or out of the same to have and to hold the said tract or parcel of land and every part and parcel there of with their appurtenances unto the said Benjamin Frasure his heirs and assignes forever and to the only proper use and behoove of him the said Benjamin Frasure, his heirs and assignes forever. And the said Charles M. Allen & Mary his wife, Andrew J. Allen & Susannah his wife, Thomas Shelton & Elizabeth D. his wife, David Rodgers & Martha his wife, Asa Wood & Polly S. his wife, Sarah Allen, and Martin Mabe & Lucretia his wife for themselves their heirs executors and administrators do covenant promise and agree to and with the said Benjamin Frasure, his heirs and assignes to warrant and forever defend the said tract or parcel of land and promise hereby granted with it's appurtenances unto the said Benjamin Frasure his heirs and assignes against them the said Charles M. Allen & Mary his wife, Andrew J. Allen & Susannah his wife, Thomas Shelton & Elizabeth D. his wife, David Rodgers & Martha his wife, Asa Wood & Polly S. his wife, Sarah Allen and Martin Mabe & Lucretia his wife and their heirs and assignes and against all and every person or persons whatever, will warrant and forever defend by these presents. In writings whereof the parties have hereunto set their hands and affixed their seals this day and date first above written. Signed, sealed and delivered in the presence of R. Thomas, J Tatum, M S. Allen and Susannah Allen the wife of Andrew J. Allen parties to a certain deed bearing date on the 21st day of June 1850 and hereunto (? acknowledged) personally appears before us in our County aforesaid and being examined by us privately and apart for their husbands and having the deed aforesaid fully explained to them. They the said Mary Allen and Susannah Allen acknowledged the same to be their act and deed and desire that they had willingly signed sealed and delivered the same and that they wished not to retract it. Shelton the wife of Thomas Shelton, Polly S. Wood the wife of Asa Wood, Lucretia Mabe the wife of Martin Mabe, parties to a certain deed being dated on the 21st day of June 1850 and here unto (?announces) personally appeared before us in our County aforesaid and being examined by us privately and apart from their husbands and having the deed aforesaid fully explained to them they the said Polly Allen, Susannah Allen, Elizabeth D. Shelton, Martha Rodgers, Polly S Wood and Lucretia Mabe, acknowledges the same to be their act and deed and declare they had willingly signed sealed and delivered the same and that they wish not to retract it. Given under our hands and seals this 21st day of June in the year 1850. R. Thomas-(Seal) Silas Carter-(Seal) Patrick County, To Wit; We John Tatum and Richard Thomas Justices of the peace in and for the County aforesaid in the State of Virginia do hereby certify that Martha Rodgers the wife of David Rodgers party to a certain deed being dated on the 21st day of June 1850 and hereunto (?announced) personally appeared before us in our County and being examined by us privately and apart from her husband and having the deed aforesaid fully explained to her, she the said Martha Rodgers acknowledged the same to be her act and deed and declared she had willingly singed sealed and delivered the same and that she wishes not to retract it.
