Martin and Ella Martin, his wife, of the County of Patrick, Virginia, parties of the first part, and the UNITED STATES OF AMERICA party of the second part: W I T N E S S E T H That for and in consideration of the sum of Twenty-Five and No/100 Dollars ($25.00), cash is hand paid to the said parties of the first part, the receipt whereof is hereby acknowledged, the said parties of the first part do hereby BARGAIN, SELL, GRANT, and CONVEY, with general warranty of title, unto the UNITED STATES OF AMERICA and it assigns forever, the following described property, to-wit: ALL THAT CERTAIN tract of parcel of land lying and situate in Smith River Magisterial District, Patrick County, Virginia, bounded on the north by the lands now or formerly of Claude R. Hopkins, et us and Clarence E. Hopkins, et ux, on the east by others lands of C.B. Martin, on the southwest by the lands now or formerly of Sallie McAlexander, on the west by the Smith River, and is more particularly described as follows: Beginning at a point in the center of a branch, said point being in a common line with the lands of Claude R. Hopkins, et ux and Clarence E. Hopkins, et ux on the north and said point being 220 feet, more or less measured upstream along the center line of said branch from its confluence with Smith River, said point also being the most northeasterly corner of the lands herein described; thence, along a new line dividing other lands of C.B. Martin from the lands therein described due south 600 feet to a point in the dividing line between the lands of Sallie L. McAlexander and the lands herein described; then, North 33 degrees 35' West 300 feet along the dividing line between the lands of Sallie L. McAlexander and the lands herein described to a point in the center of Smith River; thence, northwesterly and downstream following the meanderings of the center line of Smith River a distance of 235 feet, more or less, to a point at the confluence of the center line of Smith River with the center line of a branch, said point being a common corner with the lands of Claude R. Hopkins, et ux and Clarence E. Hopkins, et ux and the lands herein described; thence, northeasterly and upstream following the meanderings of the center line of said branch, being the dividing line between the lands of Claude R. Hopkins, et ux and Clarence E. Hopkins, et ux and the lands herein described, a distance of 220 feet, more or less, to the point of beginning, containing one and seven-tenths (1.7) acres, more or less, as shown on map of said tract designated as Tract Map No. D-346 dated 10 August 1949, now on file in the Office of the Clerk of the Circuit Court of Patrick County, Virginia, and BEING a part of the same land as that conveyed to C.B. Martin by deed from James Hopkins and Nora Ella Hopkins, wife, dated 11 October 1919 and recorded in the Clerk's Office of Patrick County, Virginia, in Deed Book 46, Page 350. The said parties of the first part further grant to the UNITED STATES OF AMERICA, its employees, agents, representatives, contractors, licensees and assigns, the right, in common with others, to pass and repass on foot and by vehicle, with machinery and equipment, over and along such farm roads, paths, and trails as may now be established and existing, over and across other lands of the said parties of the first part, adjacent to the lands herein conveyed, to provide road access to the lands herein conveyed and to other lands of the UNITED STATES OF AMERICA for all purposes necessary to the use, management and control of the Philpott Dam and Reservoir and areas adjacent thereto, but not for any other purpose. The said parties of the first part, in further consideration of the sum hereinabove specified do hereby release and quitclaim unto the UNITED STATES OF AMERICA any and all rights, title, and interest which they may have, of whatsoever nature and howsoever arising, in the banks, beds, and waters of any river or stream located upon or bordering on the said land herein conveyed and also in any alley, road, path, stream, river, way, bridge, strip, gore, or railroad right of way abutting, adjoining or traversing said land and also in any rights or means of ingress or egress appurtenant thereto. The said grantors covenant that they are seized in fee simple to the said land and that they have the right to convey the said land to the aforementioned grantee; that they have done no act to encumber the said land; that the said grantee shall have quiet and peaceable possession and enjoyment of the said land, free from all encumbrances, and that they will execute such further assurances of the said land as may be requisite.
