Martin, Et. Als. THIS DEED, made on this the 26th day of July, 1962, by and between A.C. MARTIN and SHIRLEY S. MARTIN, his wife, AMOS L. MARTIN and NEVA S. MARTIN, his wife, and HALLIE M. LAWSON and HENRY R. LAWSON, her husband, sole heirs at law of Charlie B. Martin, deceased, parties of the first part and PAUL COX, party of the second part; WITNESSETH: THAT FOR AND IN CONSIDERATION of the sum of Ten ($10.00) Dollars, cash in hand paid by the party of the second part to the parties of the first part, and other good and valuable considerations, the receipt of all of which is acknowledged by the parties of the first part upon the execution and delivery of this deed, the said parties of the first part do hereby bargain and sell, grant and convey unto the said party of the second part, with General Warranty of Title, all of those two (2) certain tracts or parcels of land lying and being in Smith River Magisterial District of Patrick County, Virginia, and described as follows: TRACT NO. 1: All of that certain lot or parcel of land lying and being in Patrick County, Virginia, on the waters of little Goblintown Creek, in Smith River Magisterial District, which is known as the "storehouse lot" and bounded as follow, to-wit: Beginning at a bunch of white oak sprouts or saplings on public road, thence running south of storehouse, supposed Southwest corner 40 or 50 yards to a planted rock corner thence, West 30 feet to a sycamore stump, thence Northwest supposed 20 yards to public road, thence supposed East course to the beginning containing 1/4 acre, more or less. This being the same tract of land, that was conveyed to John I. Wood by John L. Wood and Della Wood by a deed dated July 8th, 1932, which is of record in the Clerk's Office of Patrick County, Virginia, in Deed Book No. 61 at page No. 278. TRACT NO. 2: All of that certain tract of parcel of land lying and being in Patrick County, State of Virginia, situated on the waters of Little Goblintown Creek in Smith River Magisterial District, and known as the "Hall Mill Site", together with the mill and all appurtenances thereunto belonging, containing five acres, more or less. This being the tract of land that was conveyed to John I. Wood by H.H. Hall, Sr. by a deed dated March 24, 1911, which deed is of record in the Clerk's Office of Patrick County, Virginia, in Deed Book No. 38 at page No. 395. For a more accurate and complete description of said land reference is here made to the aforesaid deed. By a deed dated October 26, 1961, Charlie B. Martin, now deceased, conveyed 1 1/2 acres of this tract to Grady Henry Booth, said deed being of record in the aforesaid Clerk's Office in Deed Book 126, Page 286, leaving 3 1/2 acres conveyed by this deed. It is agreed and understood that these lands are conveyed by the boundary and not by the acreage and the acreage contained herein is by estimation only. The two tracts or parcels of land hereby conveyed are the same and identical tracts or parcels of land, with the exception of the heretofore conveyance mentioned, to Charlie B. Martin by a deed dated January 21, 1942, from James L. Walker and Annie Walker, his wife, and of record in the aforesaid Clerk's Office in Deed Book 77, page 233. Reference is hereby expressly made to the aforementioned deeds for a more particular description and derivation of title of the lands hereby conveyed. The parties of the first part hereby covenant that they have a right to convey the aforesaid lands to the party of the second part; that they, the said parties of the first part, have done no act to encumber the said lands; that he, the said party of the second part; shall have quiet and peaceable possession of the said lands, free from all liens and encumbrances; and that they, the said parties of the first part, will give such further assurances of the said lands as may be requisite. Clark, a Commissioner in Chancery in and for the Circuit Court of the County of Patrick, in the State of Virginia, do hereby certify that A.C. MARTIN and SHIRLEY S. MARTIN, his wife, AMOS L. MARTIN and NEVA S. MARTIN, his wife, and HALLIE M. LAWSON and HENRY R. LAWSON, her husband, whose names are signed to the foregoing writing bearing date on the 26th day of JUly, 1962, have each this day personally appeared before me in my County and State aforesaid and acknowledged the due execution thereof.
