Newman/Sharp Indenture, 1830 - Patrick County, Virgina Patrick County, Va., Deed Book 7, p. 389 Grantor: Winston Newman Grantee: Samuel Sharp, Trustee Date: 27 August 1830 This Indenture made this 27 August 1830 Between Winston Newman of the one part Samuel Sharp of the second both of the County of Patrick and state of Virginia and J. M. Redd of the third part Witnesseth that whereas the said Winston Newman stands Justly indebted to the said James M. Redd in the sum of forty dollars & thirty seven cents due by note dated 4th Sep. 1830 & also $ [blank] paid John King trustee for John Waller also seventy seven dollars sixty seven Cents paid Wm. Thompson also {blank] dollars paid Salmons for tireing waggon and also $ [blank] paid Obadiah Belcher for repairing said Waggon and he being desirous to make good & secure the payment thereof and for the further Consideration of the sum of One dollar to him in hand paid the receipt whereof is hereby acknowledged hath granted, bargained & sold and by these presents doth grant, bargain and sell, alien enfeoff & confirm unto the said Saml. Sharp the following Land Viz. The tract whereon the said Newman now lives, it being the land he bought of John J. Barrett which Land and boundaries will more fully appear refference being had to the deed of conveyance from the said John J. Barrett to him of record in Patrick Clerks office a small part being marked off to James Boaz. The tract now deeded is supposed to Contain One hundred and twenty acres, also one other tract containing fifty five acres held by patent now in the possession of said Newman in which the boundaries are particually described also one road waggon and five pair of gear and five horses which the said Newman has now in his possession four head of cattle marked with a crop & slit in the left ear with their increase. To have and to hold the above granted Land, Waggon & gear, horses and Cattle to the Only proper use behoof and benefit of him the said Saml. Sharp and his heirs forever and the said Newman doth Covenant and agree to and with the said Sharp and his heirs etc. to warrant and defend a good & lawful right & title to the above granted land & property with the increase of the property against himself his heirs and all and every person claiming the same either in Law or equity. In trust nevertheless that if the said Newman or his heirs shall well and truly pay to the said James M. Redd his heirs or assigns the sum of money above mentioned whenever required with the interest that may accrue thereon then this Indenture to be void: But if he shall fail to do so then the said Sharp doth oblige himself whenever thereto required by the said Redd to sell the said Land and property with the increase of the property to the highest bidder for ready money previously advertising the time and place of sale at some public place or places near the residence of the said Newman at least ten days the proceeeds of the sale of the Lands & property to be applied to the payment of the debt above with the interest and Cost attending this deed.
