Will of Gabriel Hylton, 1875 - Patrick Co. VA January 8, 1875 Will Book 7, page 303 I, Gabriel Hylton of the County of Patrick and State of Virginia, being in feeble health but of a sound mind and memory, do make this my last will and Testament. My will and desire is, first that my burial expenses & all of my just debts be paid out of any money arising from my estate. I then will to my beloved wife Lucy A. Hylton during her natural life or widowhood that portion of land on which I now reside and bounded as follows to wit: Beginning in T. J. Clark's line one hundred yards north of the path leading from said Clark's to my residence, thence a straight line to the mouth of a gully near an old plant bed, thence a straight line to west end of my land, thence with the public road to a small poplar near a pair of draw bars, thence a straight line to Abner Hylton's corner sourwood. Pointers thence to my back line crossing the creek at Bever's ford thence same to the river. Thence up the same as the line of the estate of A. J. Hylton's Dec'd. Thence with the same to T. J. Clark's line thence with his line to the beginning. I then give to my son Abner Five Hundred dollars in lieu of the land bought by him from Mrs. Wanecott. I then give to my two sons Abner & George and their lawful heirs all of my land south of the land devised to my wife including the land bought by my son Abner from Mrs. Wanecott to be equally divided between them as they may think proper. I give to my daughter Virginia & the heirs of her body forever the remainder of the Bob Brown land east of the land sold to Joe and John Brown. I give to my daughter Nannie N. & the heirs of her body the land known as the Wilson land. I give to my son William & his lawful heirs the land known as the Harris land together with the remainder of the Brown land west of John Brown's. I give to my son Luther and his lawful heirs the property devised to his mother at her death, or sooner if she thinks proper and if she is living when he arrives at the age of twenty one years my desire is that he shall have half of the above property or its proceeds and at her death the remainder. I give to my daughter Nannie N. & my three youngest sons each a house & to the above married children & my son Abner such other property as I gave my daughter Virginia Nowlin. I wish my personal estate disposed of as my executor and my brothers Valentine & George Hylton may think best. I desire that all my money bonds & accounts be applied to the payment of my just debts. My will is that the property devised to my wife & sons remain in the possession of [my ?] executor until all of my just debts are paid. I then constitute my son Abner my Executor and desire that he shall give his individual bond without any security being required of him by the Court and that I further desire that any settlement of an account current made by my two brothers Valentine & George W. Hylton or any party they may designate shall be received by the Court as a lawful settlement. I also desire that if my wife at any time thinks proper to surrender all or any part of my personal estate left in his [sic] possession [End of sentence missing on copy]. To my executor that he shall equally divide the same amongst my children. Signed sealed and delivered this 8th. Day of January 1875 in the presence of: W. D. Smith W. W. Shelton Gabriel Hylton I make the following codicil to the foregoing will. My will and desire is that if any of my children die without all issue the property devised to them shall revert back to my estate and if any land is revert back to my estate my will is that the heirs whose land it adjoins shall have the privilege of taking the land at valuation first and if they decline any other child may do so. Any land so received together with the land heretofore willed shall descend to my Grandchildren. I further desire that in any matter of controversy or settlement or any arrangement or any other matter that may arise in connection with my estate (except to sell land) any decision or decisions given or as made by my two brothers Valentine & George W. Hylton shall be binding, as though it was provided for in my will and where they cannot agree touching any matter they shall have the power to call in a third party and their decision shall be binding.
