Gholson Judge of the 2.nd Judicial Circuit of Virginia held at the Courthouse in the City of Petersburg on the 15.th December 1862, In Vacation, Be it remembered that G.W. Browder was this day brought before the said Thomas S. Gholson Judge &.c by W.m Pannill Provost Marshall and John. H. Patterson in pursuance of a writ of Habeas Corpus to them directed, issued on the 13.th December 1862 which said petition and writ are in the words following (Here insert the same) To which writ the said W.m Pannill & John. H. Patterson Jailer &.c made the following returns,. (Here insert the same) and with the return of the said Pannill P. Marshall, Maj. General French Commanding &.c endorsed on the writ, "It is not my intention to try the man by Court Marshall such being my orders from War Dept," It Also appeared that the said Browder after the decision of the Court on Thursday the 11.th to the effect, that he could not be tried before a Court Martial - to_wit on Saturday the 13.th Inst was ordered before a Court Martial, then sitting in this City to be tried, and that the said cause was Continued on account of the absence of his Counsel, It also Appeared, that a member of the Court Martial was ordered by General French on Saturday or Friday he thinks, He can't speak positively as to the time he was ordered by Gen.l French to have the said Browder tried for the charges preferred against him, That he supposed when he heard that the Court had remanded the petitioner, it was that he might be tried by Court Martial, But that, he had been ordered by Maj Genl French this morning, not to try the said Petitioner by Court Martial, and now no such purpose was entertained, and the petitioner also introduced the following letter from W.M. Braxton to R.R. Collier, (here insert the same) The Petitioner also proposed to the Court to give and bond or assurance which might be required to the effect that he would be of good behavior generally or would answer any prosecutions or indictment which might be ["required, to the effect that "he would be of good behavior" struck] presented against him in the Civil Courts, or would enter into any obligation with Security that he would not again enter the Camps, or offend in any way, Upon Consideration whereof the Court is of opinion and doth decide that the petitioner be remanded. Baker Dec.r 23.rd 1862, City of Petersburg Sc In obedience to the annexed writ of Habeas Corpus W.m Pannill and John. H. Patterson, this day brought before me the body of W.m H. Uzzell and return on the said writ of the day and cause of the Capture and detention of the said W.m H. Uzzell, whereupon the parties being heard, On consideration whereof it seems to me that the said W.m H. Uzzell is illegally detained in the custody of thte said Pannill and Patterson, Therefore it is ordered that the said W.m H. Uzzell be discharged from the custody of thte said Pannill and Patterson, which judgement together with the petition of the said W.m H. Uzzell, the affidavit thereto annexed, the writ of Habeas Corpus and the return thereto made, I Certify to the Clerk of the Circuit Court of Petersburg, to be entered of record by him According to law, Given under my hand this 6.th day of January 1863 Richard . The within named Marie Antoinette Alboni, Devries Boisvert was this day brought before me and admitted to bail in the sum of Two hundred and fifty dollars, with Security in the same Sum, which may be given before the Mayor of the City Tho.s S.
