Chambers Judge. Thomas Lufsey (white) who stands jointly indicted with Burwell Belcher & W.m Gill was this day set to the bar in the Custody of the Jailer of this City (the Attorney for the Commonwealth electing to try them separately) and being arraigned pleaded not guilty Whereupon the veniremen Summoned for the trial of the prisoner and attending Seventeen only were found duly qualified, and to make up and complete a panel of twenty four qualified jurors free from exception ["being completed" struck] for said trial, it is ordered that a writ of venire facias be issue directed to the Sergeant of this City Commanding him to Summon Seven other freeholders of his Corporation, qualified as law directs, to attend Court for that purpose, and the said Sergeant having returned the names of Seven other persons Summoned by him in pursuance of said writ, and a panel of twenty four qualified Jurors free from exception being completed, and the prisoner having exercised his privilege under the Act of Assembly, of striking from the said panel the names of eight of the said jurors, from the remaining Sixteen a Jury was thereupon selected by ballot to=wit: J.T. Quarles, S.G. Brister, B.S. Turner, W.m Partin, Augt: Gerecke, J.W. Mangum, J.B. Prosser, J.M. Rappold, W.J. Malone, A.I. Baiscan[?], John White, & N.M. Tanner, who being duly sworn, returned their verdict in these words, "We of the Jury find the prisoner "Thomas Lufsey guilty as charged in the within indictment and affix the "punishment at imprisonment in the Penitentiary for three years," and the said Lufsey is remanded to Jail. Ramkey, T.A. St Clair, W.T. McCandlish, Sam.l Watson Jr A.M. Green, Warren Russell, J.P. Avery, R.D. Grigg, A.W. Snyder, L.A. Marbury & W.J. Branch, who being duly Sworn, returned their verdict in these words, "We of the Jury find the prisoner Thomas Lufsey guilty of "the charge in the indictment and affix the term of imprisonment in the penitentiary for four years (4) & Six months" [page break] [p.] 498 and the said Lufsey is remanded to Jail. [The crimes are not specified in the court records, but were reportedly the burglary of a storehouse and a smokehouse {22 Feb 1867}. Two indictments against each of the three defendants were all deemed true bills, on Wednesday, 22 May 1867.
