Deed - Nathaniel Cocke to William Cole (Hustings Court Deed Book 1, page 327, Petersburg,VA.) This Indenture made the twenty fifth day of may Anno Domini one thousand seven hundred and Eighty seven Between Nathaniel Cocke of the State of Georgia of the one part and William Cole of Prince George County of the other part, whereas William Thompson and William Tarry attorneys for the said Nathaniel Cocke have by their certain Indenture made & executed & bearing date the 25th Day of November, last past, conveyed to the said William Cole three Lotts of Land, situate in that part of the Town of Petersburg called New Blandford and distinguished in the plan of the same by the Numbers (32)(35) & (55) thirty two, thirty five & fifty five belonging to and the property of the said Nathaniel Cocke as will appear by a Deed from Charles Duncan to him bearing date the 3rd Day of May 1786 duly Recorded in the Hustings Court of the said Town, reference being thereto had: And whereas the Indenture made by the said attorneys hath been partly proved only, and lodged with the Clerk of the Hustings Court of the said Town, and as some difficulties may attend procuring the witnesses so as to have the same fully proved and the said Nathaniel Cocke being now present to act in his own person, and being willing and desirous of confirming to the said William Cole a sufficient Title to the three lotts of Land & premises aforesaid: and to avoid any disputes or doubts that may here- after arise respecting the same, this Indenture witnesseth that the said Nathaniel Cocke for and in consideration of the sum of Six Thousand Pounds Weight of Tobacco to him in hand paid by the said William Cole at and before the sealing and delivery of these presents the Receipt whereof the said Nathaniel Cocke doth hereby acknowledge, hath Granted Bargained and Sold, and by these presents doth Grant, Bargain Sell and confirm unto the said William Cole his heirs and assigns forever three lotts or parcels of Land situate and distinguished in the town of Petersburg as aforesaid, with Reversion and Reversions Remainder and Remainders, Rents, Issues and Profits thereof, and of any part and parcel thereof each and every of the said Lotts and their appurtenances: To have and to hold the said Three Lotts of land and all and singular the premises hereby Granted, Bargained and Sold with their appurtenances unto the said William Cole his heirs and assigns, to the only proper use benefit and behoof of him the said William Cole and his heirs and assigns forever.- And the said Nathaniel Cocke for himself & his heirs Executors and administrators, the said Three Lotts of land and premises with all and singular their appurtenances, to the said William Cole his heirs and assigns will warrant and forever defend against him the said Nathaniel Cocke his heirs and assigns, and against all and every person or persons whatsoever claiming by from or under him or them; And it is hereby covenanted and agreed by and Between the parties aforesaid to these presents,for themselves and their heirs and assigns that the conveyance made by William Thompson and William Tarry, attorneys of the said Nathaniel Cocke as hereinafter mentioned, of the Three Lotts of Land and premises, is hereby set aside, made void, null and of none effect, In witness whereof the parties aforesaid have hereunto set their hands and affixed their seals the Day and year first within written. It is agreed on by and with the parties that in case it should hereafter appear that Chas.Duncan's Title to the aforesaid Lotts should be contested & found insufficient, that then the said Nath'l.Cocke & his heirs shall not be answerable to the said Cole or his assigns, it being only intended that the said Cocke shall warrant from his heirs or any person claiming, under him or them} J.Hare, Thos.Rowlett, James Durell, Cad.Jones. At a Hustings Court held for the Town of Petersburg at the House of John Hare in the said Town Wednesday the fourth Day of July 1787. An Indenture of Bargain and Sale Between Nathaniel Cocke of the State of Georgia of the one part and William Cole of the County of Prince George of the other part was proved by the oaths of John Hare, Thomas Rowlett and Cadwallader Jones witnesses thereto and is ordered to be Recorded.
