Deed - William Cole to Antonio Separk (Hustings Court Deed Book 1, page 289, Petersburg,VA.) (A continuation of this deed appears on page 315) This Indenture made this 7th day of March One Thousand Seven Hundred and Eighty Seven Between William Cole of the County of Prince George of the one part, & Antonio Separk of the Town of Petersburg of the other part, witnesseth, that for and in consideration of the sum of Five Shillings by the said Antonio to the said William in hand paid at or before the sealing & delivery of these presents, the receipt whereof the said William doth hereby acknowledge.- He the said William hath granted bargained & sold & by these presents doth grant bargain & sell, unto the said Antonio Separk one lott of land lying & being in the said Town of Petersburg & in the part of town known by the name of New Blandford, & in the plan thereof known by the number (35) say thirty five, which said lott of land was drawn in the lottery for laying off New Blandford by Nath'l.Cocke as appears by the plan now of Record in the Court of Hustings of petersburg and was conveyed to him by the Deed from Charles Duncan & by the said Cocke's Attorneys to William Cole, reference being had to the several Deeds all of Record in the Hustings Court of Petersburg may more fully and at large appear.- The said lott of land & the Reversion & Reversions, Remainder & Remainders, Rent, Issues and Profits thereof & of every part and parcel thereof & all & singular the premises hereby granted bargained & sold unto him the said Antonio Separk his heirs & assigns forever & the said William Cole for himself, his heirs Executors & Adm'rs., The Said lot of Land unto the said Antonio Separk his heirs & assigns against the lawful claim of all persons whatsoever will warrant & forever defend. The Commonwealth of Virginia to John Baird, Christopher W.Connice & Isaac Hall, Gentlemen Greetings- Whereas William Cole of the County of Prince George by his certain Indenture of Bargain and sale bearing date the Seventh Day of March last (1787) hath sold and conveyed unto Antonio Separk of the Town of Petersburg, one Lott of Land lying and being in the said Town of Petersburg and in that part of Town known by "New Blandford" and in the plan thereof distinguished and known by the number (35) thirty five, and whereas Ann Cole wife of the said William Cole cannot conveniently travel to our Hustings Court of the Town of Petersburg to relinquish her right, and make acknowledgement of the said conveyance, therefore we do give unto you or any two or more of you power to receive such Relinquishment and acknowledgement as she the said Ann Cole shall be willing to make before you of the conveyance aforesaid contained in the said Indenture which is hereunto annexed, and we do therefore command you that you do personally go to the said Ann Cole receive her acknowledgement and relinquishment of the same and examine her apart from the said William Cole her husband whether she doth the same freely and voluntarily without his persuasions or threats, and whether she be willing that the same should be recorded in our Hustings Court of the Town of Petersburg aforesaid, and when you have received her relinquishment and acknowledgement and examined as aforesaid that you distinctly and openly certify us thereto in our said Hustings Court under your seals, sending then there the said Indenture and this writ. By virtue of the Commission hereunto annexed this Indenture was acknowledged by Ann Cole, wife of the within named William Cole,on the Second Day of June 1787. She the said Ann Cole being first privily and apart from the said William her husband Examined, and did Relinquish and make over all her Rights and title of, in, & to the premises and every part and parcel thereof in the said Indenture mentioned and declared that she did the same freely and voluntarily without the persuasion or threats of the said William Cole her husband, and that she was willing and desirous that same should be recorded in the Hustings Court of the Town of Petersburg.
