Deed - William Cole to James Vaughan (Hustings Court Deed Book 2, page 319, Petersburg,VA.) This Indenture made the Seventh day of December Anno Domini one Thousand seven hundred and ninety three, between William Cole of the County of Prince George of the one part and James Vaughan of the Town of Petersburg of the other part, witnesseth that the said William Cole for and in consideration of the sum of thirty seven pounds ten shillings to him in hand paid by the said James Vaughan at or before the sealing and delivery of these presents the receipt whereof the said William Cole doth hereby acknowledge, hath granted bargained & sold and by these presents doth grant bargain and sell unto the said James Vaughan his heirs & assigns forever one Lot or Parcel of land situate in that part of the Town of Petersburg called New Blandford and distinguished in the plan of the same by the number (55) fifty five with the reversion & reversions remainder and remainders, rents, issues & profits thereof and of every part & parcel of the said Lot of Land and appurtenances. To have and to hold the said lott of land and all and singular the premises hereby Granted Bargained and Sold with the appurtenances unto the said James Vaughan his heirs and assigns to the only proper use & behoof of him the said James Vaughan and his heirs and assigns forever. And the said William Cole for himself his heirs Executors and administrators the said lott of land with all & singular the appurtenances to the said James Vaughan his heirs & assigns will warrant and forever defend against him the said William Cole his heirs, Executors & admrs., & against the lawful claim of all manner of persons whatsoever. In witness whereof the said William Cole hath hereunto set his hand & affixed his Seal the day & year first above written. Will'm. The Commonwealth of Virginia to William Robertson, Benjamin Harrison & John Baird Gentlemen Greetings: Whereas William Cole by his certain Indenture of Bargain & Sale bearing date the Seventh day of December 1793 hath sold and conveyed to James Vaughan of the Town of Petersburg one Lot or parcel of land situate in the part of the Town of Petersburg called New Blandford and distinguished in the plan of the same by the No.(55) fifty five and appurtenances. And whereas Nancy Cole wife of the said William Cole, cannot travel to our Court of Hustings in the Town of Petersburg to relinquish and make over her Right of Dower of, and in, the said Lott of Land and premises. Therefore we do give unto you or any two or more of you power to receive the acknowledgement which the said Nancy Cole shall be willing to make before you of the conveyance aforesaid contained in the said Indenture which is hereunto annexed and of her right and Title in the said premises. And we do Command you that you do personally go to the said Nancy Cole and receive her acknowledgement of the same, and examine her privily and apart from the said William Cole her husband whether she doth Relinquish her right of Dower of and in the premises aforesaid, and whether she doth the same freely and voluntarily without the persuasion or threats of her said husband and whether she be willing that the same should be recorded in the Hustings Court of the Town of Petersburg aforesaid and when you have received her acknowledgement & Examined her as aforesaid that you distinctly & openly certify us thereof in our said Hustings Court under your seals sending then there the said Indenture & this writ. By virtue of the Commission hereunto annexed this Indenture was acknowledged by Nancy Cole wife of the within named William Cole on the sixth day of January 1794. She the said Nancy being first privily and apart from the said William Cole her husband Examined, and did relinquish all her right & title of and in the lott of land & premises conveyed by this Indenture to the within named James Vaughan & his heirs & assigns forever and declared that she did the same freely and voluntarily without the persuasion or threats of her said husband & that she was willing & desirous that the same should be recorded in the Hustings Court of the Town of Petersburg. Town, Monday the 2nd Day of June 1794.
