Petersburg, VA Miscellaneous Deeds Deed - Anthony Separk to Lucy Bailey 1799 (Hustings Court Deed Book 2, page 601, Petersburg,VA.) THIS INDENTURE made first day of July in the Year of our Lord one thousand seven hundred and ninety nine Between Anthony Separke of the one part and Lucy Bailey of the other part both of the Town of Petersburg Witnesseth that for and in consideration of the sum of one hundred and fifty pounds current money of Virginia by the said Bailey paid or secured to be paid to the said Separke before ensealing and delivery hereof He the said Anthony Separke hath granted bargained and sold and by these presents doth grant bargain and sell alien and confirm unto the said Lucy Bailey and her heirs and assigns forever,one certain Lot of Land containing half an acre or thereabouts situated lying and being in that part of the said Town of Petersburg called & known by the name of New Blandford or Blandford Hill and distinguished in the plan or platt of New Blandford aforesaid by the number 36(thirty six)which lot of land the said Separke purchased from Thomas Griffin Peachy as by the records of the said Town of Petersburg reference being had thereto will more fully appear, TO HAVE and to hold the said Lot of Land with the houses thereupon and all its appurtenances unto the said Lucy Bailey her Heirs & assigns forever. KNOW YE that I the said Anthony Separk of the County of Prince George and Town of Blandford for and in consideration of the love good will and affection which I bear to my Sister in Law Susanna Hughes and for and in consideration of the sum of five shillings in hand paid the receipt whereof is hereby acknowledged have granted bargained and sold and by these presents, do grant bargain & sell unto Sarah Goody of the Town aforesaid,(but to and for the only use and behoof of the said Susanna during her natural life and at her death to the only use and behoof of those to whom the said Susanna may will it and to her the said Susanna's Heirs Executors and administrators in case she should die without will) the following property now being in my possession and conveyed to me by Bailie Hughs of Petersburg per deed records in Prince George County viz. THIS INDENTURE made the twentieth day of April in the year of our Lord one thousand Eight hundred and one Between Anthony Separke and Sarah his wife of the Town of Petersburg of the first part, John Mason Senr. of the County of Sussex of the second part, and John Osborne of the said Town of Petersburg of the third part, WITNESSETH that the said Anthony Separke and Sarah his wife in order to service the payment of the sum of two hundred Dollars justly indebted and owing by them the said Anthony and Sarah his wife to the said John Mason as appears by a Bond executed on the day and year aforesaid by the said Anthony Separk to the said John Mason with legal interest thereon from the fourteenth day of March last past, and in consideration of the sum of one Dollar to them in hand paid by the said John Osborne at or before the ensealing & delivery of these presents, the receipt whereof is hereby acknowledged, they the said Anthony Separk and Sarah his wife, have granted, bargained & sold, and by these presents do grant, bargain and sell unto the said John Osborne all that lot or tenement of Land lying and being in that part of the Town of Petersburg called New Blandford containing one half of an acre be the same more or less, and designated in the plan of the said Town by the number thirty six (36) with all the Houses and improvements thereon, and the appurtenances thereunto belonging, and also all the Estate Right, Title, Interest, claim or demand whatever both at Law and in Equity of them the said Anthony Separk and Sarah his wife, in, to, or out of the said lot and premises. TO HAVE & TO HOLD the said Lot or tenement herein mentioned, to be hereby granted, with all the appurtenances unto the said John Osborne, his Heirs Executors, Administrators and assigns forever UPON TRUST nevertheless, that the said John Osborne shall on or before the first day of January in the year one thousand Eight hundred and two, give ten days previous notice by advertisement in the Petersburg Gazette, proceed to sell the same to the highest bidder for the best price that can be obtained, and out of the money arising from the sale in the first place, to pay and satisfy all reasonable charges attending such sale, and then the aforesaid sum of Two Hundred Dollars with legal interest thereon from the fourteenth day of March last past, to the said John Mason his Heirs or assigns, and the residue of the money arising from such sale as aforesaid to the use of the said Anthony Separk and Sarah his wife, their Executors, Administrators or assigns, or to such person or persons as they by writting under their hand shall appoint. PROVIDED always, and upon condition, it being the intent and meaning of these presents, that if the said Anthony Separk and Sarah his wife, their Heirs Executors or Administrators shall well & truly pay or cause to be paid unto the said John Mason his heirs, executors, Administrators or assigns the full and just sum of two hundred dollars, with the legal interest accruing thereon from the fourteenth day of March last past on or before the first day of January in the year one thousand Eight hundred & two, then and in such case, and at all times from thence forth these presents, and all the Estate hereby granted, and every clause and sentence herein contained, shall cease determine & be utterly void to all Intentions and purposes, and the said Bond executed by the said Anthony Separk to the aforesaid John Mason for the said sum of Two Hundred Dollars shall also be null and void and cancelled, anything herein contained to the contrary notwithstanding. THIS INDENTURE made the Eighteenth day of March in the year of our Lord one thousand Eight hundred & three Between John Osborne of the Town of Petersburg of the one part, and Obadiah R.Harrison of the same Town of the other part: WHEREAS Anthony Separke late of the said Town now deceased being in his lifetime indebted to John Mason of Sussex County in the sum of two hundred dollars did to secure the said Debt to the said Mason with legal interest thereon from the fourteenth day of March preceeding, together with his wife Sarah Separke, Execute to the said John Osborne, a deed in fee simple for one certain lot or tenement of land lying & being in that part of the Town of Petersburg called Blandford, containing one half of an acre, be the same more or less, and designated in the plan of the said town by the number thirty six (36), TO HAVE AND TO HOLD the said lott or tenement therein mentioned to be thereby granted, with all the appurtenances unto the said John Osborne his heirs, Executors, Administrators and assigns forever, UPON TRUST that the said John Osborne should on or before the first day of January in the year one thousand Eight hundred & two, giving ten days previous notice by advertisement in the Petersburg Gazette proceed to sell the same to the highest bidder for the best price that could be obtained, and out of the monies arising from the sale in the first place to pay and satisfy all reasonable charges attending such sale, and then the aforesaid sum of two hundred dollars with legal interest thereon from the fourteenth day of March the last past, to the said John Mason, his heirs or assigns, and the residue of the monies arising from such sale, as aforesaid, to the use of the said Anthony Separke and Sarah his wife their Executors Administrators or assigns, or to such person or persons as they by writing under their hands should appoint. AND whereas the said John Osborne by virtue and in persuance of the deed aforesaid after giving due notice in the Petersburg Intelligencer of the time and place of sale of the same,at the instance of John R.Mason executor of the said John Mason dece'd. did proceed on the Twenty Second day of January last past to sell the said lott or tenement of Land with its appurtenances to the highest bidder for the best price that could be obtained therefor, at which said sale the said Obediah R.Harrison became the purchaser of the said lot and tenement with its appurtenances for the price of sixty pounds one shilling in ready money which said sum he hath paid in hand to the said John Osborne for the benefit of the legal representatives of the said John Mason deceased. NOW this Indenture WITNESSETH that for and in consideration of the premises, the said John Osborne by virtue of the authority vested in him by the deed aforesaid, hath given, granted, bargained and sold aliened enfeoffed and confirmed, and by these presents doth give, grant, bargain & sell, aliene enfeoff and confirm to the said Obediah R.Harrison, his heirs and assigns, the lott or tenement aforesaid with its appurtenances. TO HAVE and to hold the said lott or tenement with its appurtenances to the said Obadiah R.Harrison his heirs and assigns, to the only proper use and behoof of the said Obadiah R.Harrison, his heirs and assigns forever.
