(City of Petersburg,VA.,Deed Book 78, pages 252 & 253) This Deed, made this 6th day of may, 1909, by and between Mary C. Wright, Augustus Wright,Jr., Howard E.Wright, and Grover C.Wright, Executrix and Executors of Augustus Wright, deceased, parties of the first part, and Sadie A.Howerton, of the second part, Whereas the said Augustus Wright departed this life on the 15th day of April, 1909, Testate, Seised in fee simple of certain real estate in the city of Petersburg, Virginia, of which that hereinafter described and conveyed is a portion,and by his said Last Will and Testament, bearing date on the 9th day of August, 1905, duly admitted to probate in the Hustings Court of the City of Petersburg, Virginia, on the 20th day of April, 1909, and recorded in the clerks office of said court, did constitute and appoint said parties of the first part his executrix and executors, under said will; and Whereas the said Mary C.Wright, Augustus Wright,Jr., Howard E.Wright, and Grover C.Wright did qualify as such Executrix and Executors in said court on said 20th and 21st of April,1909; And Whereas, said Testator, Augustus Wright, by said will, after having disposed of and making certain specific devises of certain other real estate, therein specifically mentioned, did by the 8th item of said will, direct and authorize his executrix and executors, if thought advisable,to sell all the balance of his estate, which item reads as follows: "All the balance of my property to be sold if thought advisable by my executors and to be divided among my six children", and said lot hereinafter described and conveyed being a portion of the real estate included in and under said 8th item of said will,and which was not specifically disposed of by said Testator in said will; And Whereas, The said Mary C.Wright, Augustus Wright,Jr., Howard E.Wright and Grover C.Wright Executrix and Executors as aforesaid, deeming it advisable to make sale of the lot hereinafter conveyed, and have, as such Executrix and Executors made private sale thereof to said Sadie A.Howerton, for the sum of Five Hundred Dollars ($500.00), cash: Now, therefore, this Deed Witnesseth: That for and in consideration of the premises, and the sum of Five Hundred Dollars $(500.00) cash in hand paid, the receipt of which is hereby acknowledged, they the said Mary C.Wright, Augustus Wright,Jr., Howard E.Wright, and Grover C.Wright, Executrix and executors of the said Augustus Wright, deceased, parties of the first part, do grant and convey, with special warranty, unto the said Sadie A.Howerton, the following property, to-wit: All that certain lot or parcel of land and appurtenances, on the East side of Chappell Street, in the City of Petersburg, Virginia, fronting on said street thirty-seven and one half (37-1/2) feet,and running back Eastwardly between parallel lines, one hundred and fifteen (115) feet and is known as lot No.49, on a plat made for W.W. Robinson, and recorded in the said clerks office aforesaid in Deed Book 70, at page 646, along with a deed from W.W. Robinson and wife to H.V. Parham, bearing date July 14th,1906, at page 645 of said deed book, to which plat reference is here made, said lot is also one of the lots described and conveyed said Augustus Wright, deceased, by deed from Mary E.Robinson and others bearing date June 30th,1908, and recorded in said clerks office in Deed Book 73, at page 472, and one of the lots of which said Augustus Wright died seised and possessed, and included under the said 8th item of his will, directing and authorizing the balance of his estate sold as aforesaid. Witnesseth the following signatures and seals: Mary C.Wright, Executrix (SEAL) Augustus Wright,Jr.,Executor (SEAL) Howard E.Wright, Executor (SEAL) Grover C.Wright, Executor (SEAL) State of Virginia, City of Petersburg, To-wit: I,C.L. Thomas, a notary public in and for the City of Petersburg, in the State of Virginia, do certify that Mary C.Wright, Executrix and Augustus Wright,Jr., Howard E.Wright and Grover C.Wright, Executors of Augustus Wright, deceased, whose names are signed to the above writing, bearing date on the 6th day of May 1909, have severally acknowledged the same before me in my city aforesaid. My commission expires on the 21st day of July 1913. Given under my hand this 6th day of May, 1909. C.L. Thomas, Notary Public. Virginia: In the Clerks Office of the Hustings Court of the City of Petersburg, the 23rd day of November, A.D. 1910, this Deed from Augustus Wrights Executrix and Executors to Sadie A.Howerton was this day lodged in the said office and, with the certificate annexed, admitted to record.
