INDENTURE BETWEEN JAMES BARNETT (Burnett?) & JOHN COX PITTSYLVANIA COUNTY, VIRGINIA COURTHOUSE Dated: 20 June 1769 Deed Book 1 pages 226, 227, 228 This Indenture Made this Twentieth day of June in the year of our one Thousand Seven Hundred and Sixty Nine Between John Cox of Pittsylvania of the one Part and Barnett of the said County of the other part Witnesseth that the said John Cox for and in Consideration of the Sum of Twenty Pounds Current Money of Virginia to him in hand & paid by the said Barnett at and before the Ensealing and delivery of these Presents the Receipt whereof he the said John Cox doth hereby Acknowledge and therefore doth Assign the said James Barnett his heirs Executors and Administors & Every of them forever of these Presents Hath Granted, Bargained and Sold Aliene & endorsed and confirmed & by these Presents doth grant Alien and Endorsed & Confirm unto the said James Barnett his heirs & assignes forever a certain tract or parcel of Land Situate lying & being in the said County of Pittsylvania on both sides of the south fork of Sugar Tree Creek & Bounded as followath to Wit Beginning at a Sorrell tree on the said Creek thence North thirty one degrees west forty six poles to a white Oak North ten degrees & West forty two poles to a white Oak North fifty degrees West Fifty Poles to a large fork of the said Creek thence down the Creek as it Meanders to the Mouth Crosses the main Creek to a white Oak south forty Eight forty one Poles to Poplar South Forty Eight degrees West Eighty Poles to the Begining the said containing by Estimation thirty six Acres and a half be the same more or less together with all Houses water ways or charted Water Courses Advantages & all other Advantages & appertenances to the same Belonging or in any wise appertaining & the Reversion & Divisions remainder & Remainders thereof and Every part and Parcel thereof to have and to Hold the said thirty Six & half Acres of Land sake the same more or Less with heirs and Every of this appertenancy unto the said James Barnett his heirs & assignes to the only Proper witnesseth of him the said James Barnett & of his Heirs and assignes forever and the said John Cox his heirs and assignes against the above hand and Promises with their and Every of their appertenances unto the said James Barnett and his heirs and assignes Against the Claims & demand of him the said John Cox his heirs Executors and Administators and against all other persons shall and will Warrent and forever defend and the said John Cox for himself and his Heirs Executors Administators & assignes doth forever grant and Agree and with the said James Barnett his heirs and assignes too & that to the said John Cox at the time of the Ensealing and delivery of these Presents is and ____________ & sealed of and indenture Estate of inhiretantes in fee simple in the said Land and Promises and that he hath full power and authority to sell and Convey the same to the said James Barnett in manner & Form aforesaid & that the said Barnett shall forever hereafter Peaceably have hold occupy Peaceably Enjoy the same and every Part and Parcel & hereof and lastly that the said John Cox his Heirs shall and will at anytime within Twenty years after the date of these Presents do and Execute any acts or acts convegance or Convegances Necessary in Law for the further Better Giving and conveying the said Land and Premises with the appeartences unto the said James Barnett his Heirs and assignes as by the said James Barnett his Heirs and assignes shall be Reasonable Devised Advised or Required at the cost and charges in the Law of him the said James Barnett his Heirs and assignes In Witnesses whereof the said John Cox hath hereunto set his hand and affixed his seal the day and Year above written Signed Sealed & Delivered In Presents of Peter Perkins Nicholas Perkins Signed: John Cox (his mark) (L S) Submitted by bjbrke@worldnet.att.net **************************************************************** USGENWEB NOTICE: These electronic pages may NOT be reproduced in any format for profit or presentation by any other organization or persons.
