McCAUL, James SYLE This Indenture made this 31st Day of Jany in the year of our Lord Christ one thousand Seven hundred and Seventy two - Between Jno. BYNUM Senr and Arther BYNUM of the County of Pittsylvania of the one part and Alexr McCAUL James SYLE & Co of the other part Whereas the aforesaid Jno & Arther BYNUM'S hand, Justly indebted to the said McCAUL & SYLE the sum of Two hundred and forty six pounds Ten Shillings and Sixpence Current money of Virginia Current Money of Virginia and is Willing and Desirous to Secure the aforesaid sum of money to the said McCAUL & SYLE Now this Indenture Witnesseth that the said Jno BYNUM and Arther BYNUM for the consideration of the aforesaid sum and also for the further Consideration of the sum of five pounds Current money of Virginia to them in hand paid at and before the Ensealing and Delivery of these Presents the Receipt whereof is hereby acknowledged hath granted bargained and sold alinated Enfeoffed Released and Confirmed and by these doth grant bargain and sell alien enfeoff release and confirm unto the said McCAUL & SYLE their Heirs Executors Admrs or assigns forever one Tract or parcel of land Situate lying and being in the County of Pittsylvania Containing Two hundred acres Bounded on Hugh MOHOONS [?] line Saml BYNUMS line Jacob SALTWELLS line Excepting the Mill and two (crossed out) and on both sides of Rutleges Creek That is to say one acre on each side of the creek be the said more or less which is the Remainder of a larger Tract that the said BYNUM Bought of Col. William WYNNE Peferance this unto being had will more fully appear and also the Reversion and Reversions Remainder and Remainders ____ Issues and Services of the aforesaid Tract of Land to them the said McCAUL & SYLE their heirs Exers Admrs or assigns upon Special Trust and Confidences Never the less and to and for the use and Intent and purposes Following that is to say that the said McCAUL & SYLE shall at the end of three years after the date of these presents sell and dispose of the said Tract or parcel of Land for the most that can be got for the same and out of the money arising from the sale of the same to pay and satisfy themselves the aforesaid Sum of Two hundred and forty six pounds ten Shillings and Sixpence ____ Money with lawfull Interest from the date hereof till paid and if their should be any overpluse Remaining from such sale that then and in that case the said McCAUL & SYLE shall pay as Cause to be paid unto the said Jno & Arther BYNUM their heirs Execrs Admrs or assigns the residue of the said money arising from the sale of the said Tract of land and that the said McCAUL & SYLE shall after raising and paying themselves the aforesaid sum of money with Interest from the date of these presents and Reimbursing themselves out of the Sale of the Expenses of Drawing and Recording these presents and the Contending charges of the sale aforesaid Recovery and Release to the said Jno & Arthur BYNUM their heirs Executors Admrs or assigns all Claims Interest or Demand of in and to all and all and every part of the said Tract or parcel of Land that may remain undisposed of In Witness whereof the said Jno & Arther Bynum hath hereunto set their hands and affixed their seals the Day and year first above written.
