Deed to Thomas HENDERSON from Elisha HARBOUR, 1769 Deed Book 1 pp 429-431 This Indenture made the 22d Day of September in the year of our Lord Christ one thousand Seven hundred and Sixty nine Between Elisha HARBOUR of the County of Pittsylvania and Colony of Virginia of the one part and Thomas HENDERSON Senior of the County and Colony of aforesd of the other part Witnesseth that the said Elisha HARBOUR for and in consideration of the sum of Thirty five pounds Virginia money to him in hand paid by the said Thomas HENDERSON Senr at or before the sealing & delivery of these Presents the Receipt whereof the said Elisha HARBOUR doth Acknowledge himself fully satisfied & content have given granted Bargained and Sold aliened enfeoffed and confirmed and by these Presents do give Grant Bargain Sell alien enfeoff and Confirm and to the said Thomas HENDERSON Senior one Tract or Parcell of Land Containing one hundred and fifty acres Lying and being in the County of Pittsylvania in the Colony of Virginia on both sides of Irvin River and Bounded as followeth to wit: Beginning at Charles Whits Corner White Oak the South side of the River thence South Sixteen degrees West Sixty Two poles to a white oak. Thence South forty Degrees West one hundred & thirty six poles to Two chesnutty trees on the side of an hill thence South Eighty five degrees west forty three Poles crossing the River to a Dogwood on a hillside thence north fifty Degrees west Eighty four poles to a white oak by a branch thence north forty Degrees East Two Hundred and Twenty poles to a red oak in the aforesaid Whits Line thence on his Line South fifty Degrees East Ninety poles crossing the said River to the first Station with all woods under woods, swamps marshes low ground, meadows Feedings and his due share of all vains mines Quarries whether discovered or undiscovered Orchards pastures, Fences Springs Houses Edifices and Buildings with all and Singular the priviledges and appurtenances belonging unto the said demised Premises whatsoever belonging or in any wise appertaining and all and Singular its profits and Hereditaments whatsoever To have hold and Injoy all and Singular the said demised one hundred and fifty acres of land and premises with the appurtenances thereunto belonging or in any wise appertaining to him the said Thomas HENDERSON Senior his heirs & assigns forever to his and their only use Benefit and behoof forever and that the said Thomas HENDERSON Senr his heirs and assigns shall and may at all times forever hereafter by Virtue of these Presents Lawfully and peaceably possess and Injoy the aforesaid Land and Premises with all the appurtenances and Previledges free and clear from all encumberances and demands whatsoever and further more the said Elisha HARBOUR for himself his heirs & successors doth Covenant Warrant and Engage the aforesaid hundred and fifty acres of Land and Premises with Benefits and Interests free and clear from all manner of encumberances and from all Persons Claiming or to claim by or from him the said Elisha HARBOUR his heirs Executors and Administrators and from all and every other person Whatsoever by any Lawfull claim to the same and further that the said Elisha HARBOUR hath ______ Right Lawfull and absolute power and authority in himself do grant Bargain Sell Alienate and Convey all and Singular the said Demised Land and premises unto the said Thomas HENDERSON Senior his heirs and assigns as above said and shall the said Thomas HENDERSON Senr his heirs and assigns and every of them Shall or may Lawfully from time to time and at all times forever hereafter freely quietly and peaceably have hold Occupy possess and Enjoy all & singular the said premises with every part and Parsell thereof Granted or intended to be granted with all the Rents and Profits thereof without the ________ Trouble Hindrances or Molestation of him the said Elisha HARBOUR his heirs Executors and Admrs or any other Person or persons whatsoever and also that the said promises and appurtenances now are and forever hereafter shall be and Remain unto the said Thomas HENDERSON Senr his heirs and Assigns free and clear from all manner of Incumbrance Mortgage Jointure Dower or Title of Dower and from all Incumbrance Whatsoever and that the said Elisha HARBOUR his heirs and assigns Shall at the Cost and charges of the said HENDERSON his heirs and assigns make and convey all or any such right or Instrument of Writing for the Better _________ the said Premises as the said HENDERSON his heirs and assigns Shall require In Witness whereof the said Elisha HARBOUR hath hereunto set his hand and Seal the Day and date above Written.
