Thomas Barnett/John Eyrs Deed, 1795 Here is a deed from Deed Book 10 p. 346. It is for Thomas Barnett. Pittsylvania County, Virginia Deed Book 10, p. 346 This deed made this sixth day of December in the year of our Lord one thousand seven hundred and ninety five between Thomas Barnett of the county of Pittsylvania and state of Virginia of the one part and John Eyrs of the county of Lancaster and state of Pennsylvania of the other part. Witnesseth and sayeth that for and in consideration of the sum of five shillings lawful money of Virginia to him the said Thomas Barnett in hand paid and a further consideration of the sum of one thousand seven hundred pounds four shillings current money of the state of Pennsylvania which the said Thomas Barnett owes to Micajah Richard and Reuben Ford of the state of Pennsylvania and co partners, the said Thomas Barnett hath this day sold and delivered to the said Eyrs the following property to wit, twenty three negroes namely, George, Tom, Isham, Peter, George, Jr., Phill, Reuben, Ambrose, Sarah, Rachel, Milley, Salley, Letty, Grace, Will, Friday, Sam, Cesar, Peter, Jr., Dick, Harry, Jack and Jordan together with twenty one head of cattle, four head of horses, charriot, waggon and gear, and two stills, and all the stock of goods on hand together with all my household and kitchen furniture of every kind whatsoever on the following terms that is to say, that whereas the said Thomas Barnett did on the fourth of October 1794 assign a bond of John Nicolson of the state of Pennsylvania to the said Micajah Richard, Reuben Ford to the amount of one thousand seven hundred pounds four shillings current money of Pennsylvania and there being a likelihood of said Nicolson becoming insolvent before a judgement could be obtained against him and thereby the said Thomas Barnett may loose his debt as assignee of the said bond, and in order to secure the debt aforesaid the said to Micajah Richard, Reuben Ford for the said Thomas Barnett have made this deed of Trust to the said John Eyrs as a trustee for the said Richard Ford on the following condition that is to say if the said Thomas Barnett do well and truly pay to the said Richard Ford the annual payment of three hundred pounds current money of Pennsylvania till the whole debt be discharged then the said property aforesaid is all to be reconveyed to the said Thomas Barnett again. But if the said Thomas Barnett do fail to make the annual payment of three hundred pounds as aforesaid then the said Eyrs as trustee is to sell and pay the annual payment to the said Richard Ford on giving ten days notice any part of property the said Eyrs shall think fit to satisfy the same and the said Richard Ford has reassinged the said Bond to Thomas Barnett again as he may do the best he can to recover the money due on the bond aforesaid and make such other bargain as he may think fit, Witness whereof I have hereunto set my hand and seal the day and year above written.
