Murphy, 19 Mar 2001] This Indenture made this twenty fourth day of September one thousand seven hundred and ninety four Between Richard Keesee and Sarah his wife of the County of Pittsylvania of the one-part and John Murphy of Bedford County of the other part WitneSseth that the sd. Richard Keesee and Sarah his wife for and in consideration of the Sum of Twenty seven pounds current Money of Virginia to them in hand paid by the said John Murphy before the enuating[?] and delivery of these presents have Granted Bargained and Sold, Alianed[?], released and confirmed and by these presents doth Grant bargain Sell release and confirm to the sd. John Murphy his heirs and aSsigns forever All that piece, parcel or tract of Land of the sd. Richard Keesee lying and being in the County of Pittsylvania on the branches of Tommyhawk Creek and bounded as follows (Viz) Beginning at a Chesnut tree on the branch thence new lines South fifty seven degrees West seventy poles to Muhhanes line thence with that line North foruty one degrees West one hundred and seventy six poles to a white oak on a branch thence up the same as it oneyonders[?] to two white oaks at the head of a Branch thence South forty eithg degrees Past thirty two poles to a red oak Saplin North Sixty one east thirty poles to a white oak South thirty East thirty six poles to a white oak South twenty three Wese one hundred and forty two poles to pointers South fifty West sixty poles to a black Gum and South thirty two West sixty poles to the beginning containing two hundred and eighty four acres together with all priveledges profits Heretotements[?] and Appirtenences whatsoever to this same belonging or in any wise appertaining and the reversion and the reversions, remainder and remainders rents ISsues and profits of premises and every part thereof, the right, claim and demands whatsoever in Save[?] or Equity of him the sd. Richard Keesee and Sarah his wife in and to the sd. premises or any part thereof to have and to hold all and singular the Land and premiSes and every part thereof unto the sd. John Murphy his heirs and ASsigns for ever And the sd. Richard Keesee and Sarah his wife doth hereby Grant for themselves their Heirs all and singular the above mentioned Land and premises and every part thereof with the appirtanences unto the sd. John Harris-- At a Court held for Pittsylvania County the 20th day of October 1794 The within Indenture together with the Memorandum herein indorsed were by the within named Richard Keesee acknowledged to be his several acts and Deed, and Sarah the wife of the said Richard she being first privately Examined as the Law directs came into Court and relinquished her right of Dower in and to the Land and premiSses conveyed by the said Indenture All which were Ordered to be recorded By the Court Ex. [end of record] Thomas Barnett Deed, 1795 Deed Book 10, p. 370 This Indenture made this third day of October one thousand seven hundred and ninety five between the Trustees appointed by an Act of Assimbly passed the twenty third day of November 1793 for...in the said Trustees twenty five acres of land the property of John Barnett adjoyning Wynne's falls on the south side of Dann River in the county of Pittsylvania to be by their or a majority of them laid off into lots of half an acre each with convient streets and establish a Town by the name of Danville of the one part and Thomas Barnett of the other part, Witnesseth that the said Trustees in conformity to the above recited act hath sold at publick auction on the fourth day of May 1795 two half acre lots in the said town of Danville numbered one and nineteen for and in consideration of the sum of twenty five pounds current money of Virginia to us in hand paid before or at the sealing and delivery of the receipt whereof we the said Trustees doth hereby acknowledge and thereof doth acquit and discharge the said Thomas Barnett his heirs and assignees To have and to hold the said two half acre lots to him the said Thomas Barnett his heirs or assingees against us...and our sucessors upon the express conditions that the said Thomas Barnett his heirs or assingees shall agreeable to the said recited Act erect or build thereon a Dwelling house sixteen feet square at least with a brick or stone chimney to be completed and finished fit for habitation with five years to be computed from the fourth day of May 1795 But should the said Thomas Barnett his heirs or assingees fail to build on said half acre lots within the time aforesaid the said half acre lots shall be forfeited and the said Trustees or their successors shall and may enter upon and sell the same for the benefit of the said Town in the manner the said recited Act prescribes and directs; But if the said Thomas Barnett his heirs or assingees shall well and truly build upon and improve the said half acre lots in the manner and within the limited time aforesaid he may enjoy the same with all the privileges and immunities of the said Town or other town not incorporated have, hold or enjoy in witness whereof we have hereunto set our hands and affixed our seals the day and year first above written.
