Will of Thomas Garrett, 1827 - Pittsylvania Co. VA PITTSYLVANIA COUNTY COURTHOUSE, CHATHAM, VIRGINIA March 9, 1827 LAST WILL AND TESTAMENT OF THOMAS GARRETT I, Thomas Garrett of Pittsylvania County & State of Virginia do make this my last Will & Testament in manner & form following, that is to say, First I desire that all my Just debts be paid out of my estate & Secondly, that my wife do peaceably enjoy & possess quietly & immediately all the residue of my estate both real & personal. To wit land, negroes, stock of all kind of household & kitchen furniture plantation utensils & every piece of property belonging to my estate or to come to use thereof during her natural life or widowhood excepting twenty-five acres of my land whereon my Grist Mill now stands Including the same which said land & mill I do give to my son Jesse Garrett after my decease for extra services rendered me by the sd Jesse the bounds of which sd 25 acres including sd mill is to be specified in a Deed of Conveyance hereafter to be made to the sd Jesse Garrett for the same. Thirdly after the death of my wife I give to my daughter Rebekah Jones, formerly Rebekah Garrett, fifty acres of land it being on entry & survey which I made in time past and joining the former line of Stephen McMillion, Isaiah Morton, James Strange and therein with the patent to the beginning. I also give to sd daughter Rebekah Jones formerly Rebekah Garrett one mulatto man named Sam which sd land & slave I do give to my sd daughter & to the heirs of her body if any & if she should have no offspring at her death sd land & slave is to go equally to her other blood kindred legal heirs & none else forever. Fourthly my will & desire is that the above land & mill given to Jesse Garrett nor the 102 acres of land & a mulatto named Peter which I have given to John Garrett on account of his infirmity share not be accounted for nor deprive neither of them, that is Jesse Garrett nor John Garrett of any interest in the future... of my estate that them or their heirs would otherways .. but that for certain good causes they are to possess the above mentioned property as extra being entitled to any distribution on any est.... In J... that they would have been if I had not ... them for that my will & desire is that Henry Jones the present husband of my daughter Rebekah nor his heirs is not to possess or hold any interest or claim into or against the above mentioned land and slave whatever. Fifthly my will & desire is that all the residue of my estate not otherwise named by these present both real & personal after my wife deceases be equally distributed among all my sons & daughters or their heirs as the case may be except Rebekah Jones before mentioned but that the above mentioned land & slave is to be her entire share of my estate forever & I do by these presents appoint my son Jesse Garrett sole executor of this my Last Will and Testament to Execute and carry the same into effect. In testimony whereof I do hereunto set & offer my hand & sine this ninth day of March in the year of our Lord One Thousand Eight Hundred & Twenty Seven. In the presents of Thos Garrett (seal) Richard B Beck William Davis John Garrett At a Court of Quarterly sessions continued and held for Pittsylvania County the 21st day of August 1827. This Last Will and Testament of THOMAS GARRETT dec'd, was exhibited in Court and it appearing from the oaths of Richard B. Beck and William Davis, two of the subscribing witnesses that the said Thomas Garrett, at a time when he was of sound mind, acknowledged the said Will as his Last Will. That he requested them to witness it That they did sign their names hereto as witnesses in the presence of the said Thomas Garrett, that the said Thomas Garrett had not signed the said Will at the time the same was witnessed by the said Richard B. Beck and that the said William Davies did not know whether the said Garrett's signature was to the said Will or not at the time he witnessed it and this being all the evidence the Court doth order that the same be recorded as the Will of said Thomas Garrett and on the motion of Jesse Garrett the Executor in the said Will named who made an oath thereto according to Law and together with Benjamin Walking, Walter Fitzgerald and Pandleton Burgap his securities entered into and acknowledged and in the penalty of $6000 conditioned as the law directs certificate is granted him for obtaining probate of said Will in due form.
