All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beverly Watson beverly_wat@msn.com February 17, 2010, 6:17 am Source: Pittsylvania County Va Will Book 2, Pg 128 Written: August 1, 1849 Recorded: July 24, 1851 I Miles Holt of the county of Pittsylvania & State of Virginia being of sound mind & disposing memory do make this to be my last Will & Testament in manner & form following – 1st I give bequeath to my beloved wife Wilmoth one negro boy “Bob” and one negro girl “Lucinda Frances” & the future increase of said girl, 4 choice head of cattle, one ox cart & one yoke of oxen, 6 choice sheep, 500 lbs Pork or bacon & 15 choice hogs, 2 choice feather beds, bed steads of furniture, one blue cupboard & contents, one wood clock, one carryall & harness, 2 pots, one frying pan, one black & one sorrel mare, 2 dutch ploughs, one dagon plough, 2 w--ding & 2 hilling hoes, 6 chairs & one arm chair to her, my said wife Wilmoth & to her heirs forever, I give & bequeath, the Same. 2nd I Loan to my said wife Wilmoth for & during the term of her natural life one certain piece or parcel of land to be cut off of my tract and bounded as follows, beginning at Jerry Thompson’ corner & running a straight line to the fence of my new ground of 1848 & along the said fence to a spring branch, thence up the said branch to Geo Fowlkes’ line, thence with the same to the line of Morris Pollok Jr. thence with the same to the line of Henry Motley or Morris Pollok or thence to said Thompsons’ lines & with the same to the beginning, supposed to contain 300 acres more or less, and after the death of my said wife Wilmoth, I give & bequeath the said land to my son Yancy A. Holt his heirs to forever. 3rd I loan to my said wife Wilmoth for and during the time of her natural life, one negro man “Braxton”, one negro woman “Lucinda”, one negro girl “Mary Ann” & one negro girl “Kindra” and after the death of my said wife Wilmoth, I give & bequeath the said negroes named in this clause together with the increase of the females thereof to my daughter Jane Chaney, my son Yancy A. Holt and the children of my daughter Polly Thompson to be equally divided between the three share and share alike. 4th I give & bequeath to my son Yancy A. Holt all of my Landed estate not heretofore disposed of together with all and singular the appurtenances thereto belonging or in any way apportioning to him my said Son Yancy his heirs to forever. I also give and bequeath to my said son Yancy four negro slaves namely Jack, Edwin, Dick & Malinda (alias) “Molly”, together with the future increase of said Slaves. 2 feather beds, bedsteads & furniture, one walnut cupboard, one arm chair, the balance of my chairs, one cow & calf, 20 sheep, one sow & pigs, one pot, one oven, one roan colt Washington, one bridle, saddle & to him the said Yancy A. Holt, his heirs to forever I give & bequeath the same. 5th I give & bequeath to my Daughter Jane Chaney (the wife of Calvin W. Chaney) her heirs to forever 3 negro slaves (namely) Bill, Judith & Jas. K. Polk together with the future increase of said slaves, also one grey mare. 6th I give and bequeath to my Daughter Polly Thompson for and during her natural life & after her death to her children the following property, to wit: two negro slaves (namely) Rachel & Mary with the future increase also one bay horse Rames (sic). 7th I give & bequeath to my Grand Daughter Sally Jane Thompson one negro girl “Clowey” & her increase. 8th I give and bequeath to my son in law Calvin W. Chaney & son Miles A. Holt jointly, my 2 shares in the Richmond & Danville Railroad. 9th I give and bequeath to my son Williamson D. Holt, my son James F. Holt, my son Miles A. Holt, my son Giles S. Holt, and my Grand Son Miles F. Tyler each one dollar, this together with what they have already had is all that either of them is to have of my estate, in any way shape or manner. 10th It is my will & desire that my executors hereinafter to be named shall, after my death, sell all other property that I may own at the time of my death not above disposed of and out of the monies arising therefrom pay all my just debts and the legaceys above named and the residue if any, I give and bequeath to my son in law Calvin W. Chaney & my son Yancy A. Holt. 11th It is my will & desire that if my estate above willed to be sold should prove insufficient to pay all of my just debts & the Legacies, that my Executor shall sell negro man Dick, to pay the balance if any left give the balance to my son Yancy A. Holt and if the money arising from the sale of Dick proves insufficient to pay debts & it is my will & desire that negro man, Bill be sold by Executor to pay the balance and the residue of the money arising from the sale of Bill I give & bequeath to my son in Law Calvin W. Chaney. 12th It is my will and desire that my Executor shall have full power to manage all of the property willed to my son Yancey A. Holt during the lifetime of my said Executor to be held in Trust by him for the use and benefit of my said son, Yancey and give him the profits arising from the same for the benefit of the property, but to prevent any sale or transfer of the said property. 13th It is my will and desire that my Executors shall have the management of the negro girl Clowey until my Grand Daughter Sally J. Thompson shall marry or arrive at the age of 21 years & if she, the said Sally J. Thompson shall die before marriage or lawful age, I give and bequeath the said negro Clowey to her brothers & --- their heirs. 14th It is my will & desire that if my son Yancy A. Holt shall die without lawful children that all of the property I have willed to him to be given & I do hereby give the same to the children of my daughter Jane Chaney & my daughter Polly Thompson one half to Jane’s children & the other half to Polly’s children. Lastly, I do hereby constitute & appoint my friend William Chaney near --- Grove my Executor to this my last Will & Testament hereby revoking all others or former will or wills heretofore by me at any time made. In Testimony whereof I have hereunto set my hand and affixed my seal this the first day of August 1849 – signed, sealed, published & declared By the testator Miles Holt to be § Miles Holt (seal) His last Will & Testament in the § Presence of R. M. Kirby, Jr. John J. Anderson George W. Jones Miles Holt of the County of Pittsylvania and State of Virginia do hereby confirm my wills as written by Richard M. Kirby (the date of which is not mow recollected) but wish to make the following alteration – Item 1st I make this gift of negro man Jack to my son Yancy A. Holt and Item 2nd It is my wish that my son James F. Holt have during his lifetime the use benefit and control (?) of said negro man Jack But in the event of the death of said James F. Holt then it is my Will that said negro be the property of Yancy A. Holt as provided in the will above alluded to. This the twenty sixth day of February one thousand eight hundred and fifty one. Pain § At a Court held for the County of Pittsylvania this 24th day of July 1851, A writing dated the first day of August eighteen hundred and forty nine purporting to be the will of Miles Holt Decd with a codicil thereto dated the 26th day of February 1851 was presented to the Court for probate by William Chaney the Executor therein named whereupon came James Holt and Samuel H. Thompson by their attornies & opposed the same and for reasons appearing to this Court the motion aforesaid is continued till the next Court. And at a Court held for the county aforesaid the 18th day of August 1851, the Last Will & Testament of Miles Holt Decd with a codicil thereto was presented in Court and the said codicil being fully proved by the two subscribing witnesses was ordered to be recorded, and the will aforesaid being proved by Richard M. Kirby a subscribing witness, it is ordered that the same be continued till tomorrow for further proof of the same, James Holt and Samuel H. Thompson withdrawing their opposition. And at the same Court continued and held in the county aforesaid the 19th day of the month and year last aforesaid the Last Will & Testament of Miles Holt senr Decd was again presented in Court and being proved by George W. Jones & subscribing witnesses was ordered to be recorded.
