Will of Albert Newby, 1890 - Pittsylvania Co. VA Written Dec 20, 1890 & Probated Jan 19, 1891 I, Albert Newby of the County of Pittsylvania, State of Virginia, being of sound mind and memory do declare this to be my last will and testament. I give and bequeath to my son William J. Newby fifty acres of land off the upper end of my Land lying on both sides of road leading from Mt Tabor to Mountain road including the house whitch I now live, and allso one yellow mule name Bill, all my plantation tools and one Bedstid and beding. I give and bequeath to my son Rolley M. Newby fifty dollars in current money. I give and devise all the reaminder of my real and personal propity to be eaqually devided between Elisha C. Newby and John W. Newby and Samuel H. Newby and Jane Boothe and William J. Newby, Champ W. Newby and George W. Newby and Marry E. Vaden and Rolley Newby after my just debts is paid. I appoint C.S. McLaughlin my executor of this will and devise nor shal he be required to give any security for the performance of his duties and said executor shal not have any thing to do with the Crop made by William J. Newby and Rolley Newby made in the year 1891. In witness whereof I Albert Newby have hereinto sett my hand and seal this the 20th day of December in the year of our Lord 1890. his Albert X Newby seal mark Subscribed by the Testator in the presence of each of us and at that time declard by him to us as his last will and testament Joseph H. Turner seal Abraham C. White seal At a County Court held for the County of Pittsylvania at the courthouse thereof on Monday the 19th day of January 1891. The last will and testament of Albert Newby deceased was proven by Abraham C. White one of the subscribing witnesses thereto that said will was signed and acknowledged by the testator in the presence of himself and Joseph H. Turner the other subscribing witness thereto present at the same time and then the said witnesses subscribed the said will in the presence of the testator and of each other and it is ordered that the same be recorded & on motion of C.S. McLaughlin the executor in said will named who made oath and entered into and acknowledged a bond in the penalty of two hundred..... (last line was not on my photocopy).
