All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beverly Watson beverly_wat@msn.com February 17, 2010, 8:42 pm Source: Pittsylvania Va Will Book 1, Pg 160 Written: January 27, 1824 Recorded: May 27, 1828 In the name of God Amen, I Thomas Wingo of Pittsylvania County, Virginia, being in good health of Body & Composure of mind yet unsertion of the time of my decease do think proper to make my Last will and testament my sole recommended to God in hope of Eternal life throw the Merits of Christ and my bodie I leave consined to the Grave till the Morning of the resurrection & what mortal Estate god has rested upon Mee I dispos as follows – I give and bequeath unto my Lawfull wife Mary all my estate until her deth to wit the land I now reside on negros Caton & Esex, Jinney, Fanny, Mercer, Hariatt & John there increase and my stock of all kinds that I now posess all of My house hold and kitchen furniture and all that I now posess I want my two sons Jerman Jedithan and William Tomas sons of my bodie educated out of my Estate as above mentioned such as common as My wife Ma think proper - after the decease of my wife Mary my wish is that all my lands shall bee eaquelly divided between my two sons Jerman Jedithan and William Thomas Lawfull airs of my Bodie if either of them should die without and air to be return to the surviving son if alive all the rest of My Estate to bee eaquelly divided between my three Lawfull Children to wit Jerman Jedithan, William Tomas and Lucinda Bolliner her part to the Lawfull airs of her bodie I also constitute an appoint My worthy friends Merideth Jennings and Daniel Vircer Executers of this My Last will and testament – in Confirmation of the hole I have hereunto set my hand and affixed My Seale this twenty seventh day of January one thousand Eight hundred and twenty four. Davis The Commonwealth of Virginia to the presiding Justice of the County of Maury in the state of Tennessee Greetings Know you that we trusting to your fidelity and provident circumspection in examining Ann C. Davis and Sarah M. Davis witnesses attesting the will of Thomas Wingo deceased hereunto annexed authorize and require you that at such certain day and place as you shall appoint the witnesses aforesaid before you, you call and cause to come and deligently examine on the Holy Evangelist of Almighty God touching the execution of the said will and their attestation thereto and their examinations into our Countys Court of Pittsylvania distinctly and plainly without delay you shall send and certify enclosed , returning also this writ together with the said will witness William Tunstall Clerk of our said County Court this 27th day of May 1828 in the 52nd year of the Commonwealth. William Tunstall State of Tennessee Maury County Pursuant to an order to us directed from the Commonwelth of the State of Virginia, Pittsylvania County to cause to come before us at some place for the purpose of examining them tutching a will signed by Thomas Wingo We do certify that we have this day caused to come before us at the house of Presly Dodson in the County of Maury, Ann C. Davis & Sarah M. Davis & after duly qualifying said Ann C & Sarah M., the filing questions was asked & answers given first question asked Ann C. Davis was you present at the time Thomas Wingo signed this will – answer I was – Do 2nd Did you see him sign the saim – answer I Did – quest 3rd Do you believe he was in his proper minde – he appeared as much so as I ever saw him & I believe he was perfectly so. First question asked Sarah M. Davis was you present at the time Thos Wingo signed this will – answer I was present & saw him sign the will 2nd Do you believe he was in his proper minde – answer I believe he was perfectly so. Given under our hands & seals this 20th Day August 1828 William Fly (Seal) James Forgey (Seal) State of Tennessee County of Maury I Joseph B.
