GOODMAN Trustee James H. GOODMAN Trustee Zachariah GOODMAN July 23, 1846 Powhatan County, Virginia Book 17 page 159 This Indenture made this 23rd July 1846 between Littleton B. GOODMAN and Ellen T. His wife of the first part, James H and Charles J. GOODMAN of the second part and Zachariah GOODMAN of the third part; Whereas the said Littleton B. GOODMAN is justly indebted to the said Zachariah GOODMAN in the sum of Eighteen hundred and seventy six dollars and 44 cents to be paid on or before the 1st day of July 1857 as by bond bearing even date with this Indenture more fully appears which debt the said Littleton B. GOODMAN is willing and desires to secure. Now This Indenture thereof Witnessed that for and in consideration of the premises and also for the further consideration of One dollar of lawful money of Virginia in have paid by the said James H. And Charles J. GOODMAN to the said Littleton B. GOODMAN and Ellen T. his wife at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, they the said Littleton B. GOODMAN and Ellen T. His wife hath given, granted, sell & convey to the said James H. and Charles J. GOODMAN their heirs and assigns forever all that tract or parcel of land, lying and being in the County of Powhatan in the state of Virginia. Containing by estimation two hundred and fifty five acres be the same more or less and being the same land that portion of the estate of Hugh FRENCH deed as was allotted to the said Joseph L. FRENCH in a division of the said Hugh French’s Estate, which can be fully seen and described by references to said division recorded in the Clerks office of the County of Powhatan with all and singular the appurtenances to the said tract or parcel of land belonging and all the est. Rights, title and interest of the said Littleton B. GOODMAN and Ellen T. His wife in and to the said grantees or interested to be hereby granted tract or parcel of land and premises also the following salve by the name of Albert. To have and to hold the said hereby granted or intended to be hereby granted tract or parcel of land and premises with its appurtenances together with the aforesaid slave Albert unto the said James H. And Charles J. GOODMAN and their heirs and assigns against all persons whatever shall and will warrant and forever defend by these presents. Upon Trust Nevertheless that the said James H. And Charles J. GOODMAN their heirs shall permit the said Littleton B. GOODMAN his heirs to remain in quiet and peaceable possession of the said tract or parcel of land and premises and slave Albert and take the profits thereof to his own use until default be in the said sum of $1876.44 either in the whole or in part, and then upon this further Trust that they or either of them their heirs or assigns shall and will as soon after the happening of such default of payment as they or either of them or the survivor of them may think proper, or the said Zachariah GOODMAN his survivors, or assigns shall request sell the said tract or parcel of land and their property or such part thereof as the Trustees hereby authorized to act shall think sufficient for the purpose and shall think proper to sell to the highest bidder for cash at public auction after having fixed the time and place of sale at their own discretion and given thirty days previous notice thereof by advertisement to be set up at the front door of the Office of said County of Powhatan on some court day previous to the day of sale and at least two other public places in the neighborhood of the premises and out of the money arising from such sale shall after first satisfying and paying all legal charges attending the premises pay and satisfy the debt aforesaid herein intended to be secured and the balance (if any) shall pay to the said Littleton B. GOODMAN and Ellen T. His wife or their assigns. But if the whole of the said sum of $1876.44 shall be fully paid off and discharged to the said Zachariah GOODMAN or his representatives on or before the said first day of July 1857 when the same is due and payable, so that no default of payment happen, then this deed to be null and void, also remain in full force and virtue. GOODMAN in Trust for any benefits is to be considered and taken as a release of all their deed, writings or contracts executed to me by the said Littleton B. Trueheart Justices of the peace in the County aforesaid in the state of Virginia do hereby certify that Littleton B. GOODMAN a party to a certain deed bearing date on the 23rd day of July 1846 and hereto annexed personally appeared before us in our County aforesaid and acknowledged the same to be his act and deed, and desired us to certify the said acknowledgment to the Clerk of the County Court of Powhatan in order that said deed may be recorded. Trueheart Justices of the peace in the County aforesaid in the State of Virginia do hereby certify that Ellen T. GOODMAN wife of Littleton B. GOODMAN parties to a certain deed bearing date on the 23rd day of July 1846 and hereto annexed personally appeared before us in our County aforesaid and being examined by us privately and apart from her husband and having the deed aforesaid fully explained to her, she the said Ellen T. GOODMAN declared that the she has willingly signed sealed and delivered the same and that she wished not to retract it. Given under our hand and seals this 24th day of July 1846 J. B. Tinsley SEAL C. S. Trueheart SEAL Powhatan County Court Clerks Office September the 7th, 1846 The foregoing Deed of Trust which has been duly acknowledged by Littleton B. GOODMAN and Ellen T. His wife parties to the same to be their act and deed before two Magistrates of this County and Certified was this day received in the said office and with Certificates of the acknowledgments aforesaid and of the privately examination of the said Ellen T.
