GOODMAN to Charles GOODMAN Zachariah GOODMAN June 24, 1843 Cumberland County, Virginia Book 16 page 71 - 72 (Located in the Powhatan County Court House) This Indenture made this 24th day of June 1843 between Littleton B. GOODMAN of the first part, Charles GOODMAN of the second part and Zachariah GOODMAN of the third part all of the County of Cumberland and the state of Virginia. Whereas the said Littleton B. GOODMAN is justly indebted to the said Zachariah GOODMAN in the sum of One thousand and twenty eight dollars and 67 cents ($1,028.67) to be paid on or before the first day of November Eighteen hundred and forty eight (November 1, 1848) as bond bearing even date with this deed fully proves which debt with the legal interest that may accrue thereon the said Littleton B. GOODMAN is willing and desires to secure. Now this Indenture therefore Witness that for and in consideration of the premises and also for the further consideration of One dollar lawful money of the United States to the said Littleton B. GOODMAN in ______ paid by the said Charles GOODMAN at and before the sealing and delivery of these presents the receipt whereby is hereby acknowledged be the said Littleton B. GOODMAN hath given, granted, bargained and sold and by these presents give, grants bargain, sell and convey unto the said Charles GOODMAN his heirs and assigns forever a certain tract or parcel of land lying and being in the County of Powhatan and the state of Virginia and containing by estimation two hundred and fifty five acres (255) be the same more or less and being the same tract or parcel of land purchased by the said Littleton B. GOODMAN of James P. FRENCH and being a part of the estate of Hugh FRENCH died and known in the division of said estate as Lot No. 3 to which deed from said James P. FRENCH to the said Littleton B.GOODMAN and to the division of said Hugh FRENCH estate, referenced is here made for a more particular description of said land with all and singular the appurtenances the said tract or parcel of land belonging or in any wise appertaining and all the estate right title and interest of the said Littleton B. GOODMAN in and to the said granted or indented to be hereby granted tract or parcel of land and premises. To have and to hold the said hereby granted or intended to be hereby granted tract or parcel of land and premises with its appurtenances and the said Charles GOODMAN his heirs ____ _____ forever and the said Littleton B. GOODMAN. And the said Littleton B. GOODMAN for himself _____ ______ and ______ the foresaid tract or parcel of land and premises with their appurtenances unto the said Charles GOODMAN his heirs ______ ______ and assigns against all persons whatever shall and will warrant and forever defend by these presents. Upon Trust Never______ that the said Charles GOODMAN his ____ ____ and _______ shall permit the said Littleton B. GOODMAN to remain in quite and peaceable possession of the said tract or parcel of land and premises with its appurtenances and take the profits and rents there of to his own use until default be made on the payment of the said sum of One thousand and seventy eight dollars and 67 cents either the whole or in part and then upon this further trust that they or either of them their heirs or assigns shall and will as soon after the happening of such default of payment may think proper , or the said Zachariah GOODMAN his survivors, or assigns shall request sell the said tract or parcel of land and their property, or such part thereof as the Trustee hereby authorize to act shall think sufficient for the purpose and shall think proper to sell to the highest bidder for money at public auction after having fixed the time and place of sale at their own discretion and given thirty days previous notice thereof in one or more of the Newspapers published in the City of Richmond and at the Courthouse door of Powhatan County on same Court day previous to the day of sale and out of the monies arising from such sale shall after satisfying all legal charges attending the premises pay and satisfy the debt aforesaid intended to be secured and the balance (if any) shall pay to the said Littleton B. GOODMAN, but if the whole of the said sum of One thousand and twenty eight dollars and 67 cents with the interest that may have accrued or such part thereof as may remain due and unpaid and the balance if any pay to the said Littleton B. GOODMAN but if the whole of the said sum of $1,028.67 shall be fully paid off and discharged to the said Zachariah GOODMAN on or before the 1st day of November 1848 when the same is payable so that no default of ayment of the said sum of $1,028.67 or any part thereof then this Indenture to be void or else to remain in full force and virtue.
