ITEM: I give and bequeath to my son John on his arriving to the age of twenty-one years or on his marriage, should that event first happen, the sum of five hundred dollars, provided that sum can be raised from my estate without distressing my wife and youngest son Benjamin. ITEM: I give and bequeath to my son Benjamin on his arriving to the age of twenty-one years, or on his marriage, should that event first happen, the sum of five hundred dollars, provided that sum can be raised from my estate without distressing my wife. ITEM: It is my will and desire that my sole executrix hereafter named shall have at all times full power and authority to sell, exchange, or in any other manner to dispose of my estate, real and personal, as she may think will best conduce to the interest of my estate, and the advancement of herself and children, as fully and as effectually as I could myself were I alive. ITEM: It is my will and desire that all my estate of whatever kind, after the death of my wife, be equally divided between my two sons John and Benjamin to them and their heirs forever; and should either of them die before their mother, then to the survivor and his heirs forever. ITEM: Should both my said children die before their mother, it is my will and desire that my estate, as it shall stand at the time, be divided into three equal parts, one third part to be at the disposal of my wife, in fee simple: and the other two thirds I give to be equally divided after the death of my said wife, between my brother Archer Bolling Baugh, my Sister Nancy Eggleston, and my beloved friend Edward F. Baugh, to them and their heirs forever. ITEM: I hereby constitute and appoint my beloved and trusty wife Anna Baugh sole executrix to this my last will and testament, hereby revoking all other and former wills and testaments. Given under my hand and seal this thirty first day of March in the year Eighteen hundred and seventeen. Cardozo At a Court of Monthly Sessions holden for the County of Powhatan on the 17th day of December 1817. This last will and testament of John Baugh, deceased, was presented in Court and proven by the oaths of Colin Clarke and Isaac M. Cardozo, subscribing witnesses thereto, and thereupon the same was ordered to be recorded. And on the motion of Anna Baugh, the executrix therein named, who took the oath prescribed by law, and entered into bond with security, conditioned as the law directs, a certificate is granted her for obtaining probate of the said will in due form.
