That Sarah Mitchell was still living. That John Hill was deceased and had devised his part of this land to Davis Hill, James Hill, John Hill and Thomas Hill and that Davis had purchased the others' portions. That Davis had also "purchased under a sale made by J McDearman DS for J Booker shff of Prince Edward by virtue of an act of the General Assembly of Virginia entitled 'an act to amend and explain the act entitled 'an act concerning taxes on lands" twenty acres of the aforesaid tract of land." 0003: That William Hill had died intestate leaving children Dosha, who married John Thurmond; Betsy, who married Clement Davis; Polly [Mary], who married Joel Watkins; Rhoda, who married Richmond Statham; Johanna, who married Gresham Thornhill; Martha, who married Josiah Williams; and Samuel D., now an infant. 0003, continued: Davis Hill's prayer: that the defendants be made party to the bill including a specially appointed guardian to represent the interests of the minor Samuel D. Hill and that the portion of land due to him be laid off and assigned to him. (Signed) H.E. Watkins for Compt. 0005, 0006, 0007: Joint answer of Sarah Mitchell; Clement and Betsy Davis; Joel and Polly Watkins; Gresham and Johanna Thornhill; Joel Watkins, guardian for Samuel D. Hill – they admit to the allegations, except they do not admit to his having any exclusive right to the 20 acres because the rents of the land while in Davis Hill's possession would have been amply sufficient to pay the taxes and but they have no objection to the land being divided according to his prayer if he will consent to release any exclusive claim to the 20 acres 0008: November Court 1819: It was ordered that Robert Kelso, Rezin Porter, Samuel Watkins, John Daniel and William Gray or any 3 of them lay off and assign to Davis Hill his proportion of the land except for the 20 acres which he relinquishes and the other parties release all rights of action against him for rents or profits while he was in possession; commissioners to report to court for final decree 0010: Davis Hill gave oath 21 Jun 1819 that Josiah and Martha Williams and John and Dosha Thurmond had left the county and probably the state some years before (and so could not be served with notice). 0011: Commissioner's report: per County Court of Prince Edward, 42 1/4 acres laid off as Davis Hill's 1/3 part of the tract, signed by all five of the commissioners. 0012p: plat map showing Davis Hill's tract laid off on 24 Dec 1819; adjoining landowners shown on plat are Davis Hill and Thomas Jennings; Philip Matthews; estate of Stephen Bell decd; Josiah Giles; Josiah Gibson & est. of Wm Hill decd; Sarah Mitchell & other parties 0013, 0014: Sarah Mitchell, Prince Edward County, signed acknowledging summons to appear in court 3rd Monday in August, dated 31 Jul 1819 0015, 0016: Richmond and Rhoda Statham, Campbell County, signed acknowledging same summons, but the signatures look to be in the same hand 0017, 0018: Joel (as J) and Mary Watkins, Clem and Elizabeth Davis, and Gresham L. and Johanna "Thornell," Buckingham County, signed acknowledging receipt of summons – again, looks like for each couple, one hand signed for both spouses File at: http://files.usgwarchives.net/va/princeedward/court/hill563gwl.txt This file has been created by a form at http://www.genrecords.org/vafiles/ File size: 4.7 Kb
