Will of John Livesay, 1720 - Prince George Co. VA (Deeds etc. 1713-28, page 415, Prince George Co.VA.) In the Name of God, Amen I John Livesay of Prince George County, being by the Blessing of God, in a good State of Health, and of Sound and disposing mind & memory, and calling to mind the uncertainty of Life, and being desirous to Settle and dispense of my Estate, do therefore make and ordain this my Last Will and Testament in manner following, and first I humbly begg of Almighty God, for pardon and remission of all my Sinns and transgressions for the sake of Jesus Christ my most blessed Lord & Saviour, and do order my Body to be decently interred according to the discretion of my Executrix, and for my Worldly Estate, I give and Dispose of the same in manner following.- First. I give and bequeath unto my Sonn John Livesay that part of my Land on which he now Liveth, Lying to the Southward of Hogpen runn, containing one hundred and fifty acres of Land, be it more or Less, being near the one half of the tract of Land on which I now Live, with all the buildings and Improvements thereon, both where he Lives and the plantation on which his brother William Lives, which Land and plantation I give and bequeath unto my said Son John Livesay and to his heirs forever. Secondly. I give and bequeath unto my Sonn Thomas Livesay and his heirs for ever all the remaining part of my Land and plantation on which I now live, containing one hundred and fifty acres, be it more or Less, Lying on the North side Hoggpen run with all the Improvements thereon, and I do hereby order and Direct that the said Hoggpen run shall be the division and bounds of the said Lands between my s'd Two Sons and their heirs for ever, and my further will is that my said Two Sons shall have full and free Liberty for themselves to get timber upon each others Lands before given for the use of their plantations, as they have occasion but not for any other use or purpose whatsoever. Thirdly. And whereas my intent and design was to have given one third part of my said Lands unto my Son William Livesay, and his aforesaid Brothers haveing in Lieu thereof, agreed to pay the purchase mony of other Lands for him in another place, and that it may appear that I had not forgotten him in my Will, I do therefore give and bequeath unto my said Son William Livesay all my wearing cloaths & apparrell. Fourthly. I give and bequeath unto my Daughter Elizabeth Ledbetter one shilling current mony in Lieu of all claim to my Estate. I give and bequeath unto my Daughter Mary Livesay one shilling Current mony. I give and bequeath unto my Daughter Rebecca Livesay one shilling current mony. I give and bequeath unto my Daughter Sarah Livesay one shilling current mony. I give and bequeath unto my Daughter Hannah Livesay one shilling current mony. I give and bequeath unto my Daughter Susannah Livesay one shilling current mony. Lastly and for the remaining part of my Estate consisting of crops of Grain Tobacco, Stocks of Cattle, Horses, Hoggs etc. and of Debts and Household Goods I give and bequeath the same unto my Loveing wife Joan Livesay to use and dispose of as she pleases, hereby nominating and appointing my said wife whole & sole Executrix of this my Last Will and Testament, revokeing & making void all other Wills and Testaments heretofore made, and declareing this to be my Last Will and Testament. The above written Last Will and Testament of John Livesay dec'ed, was presented into Court by Joan Livesay his Executrix who made oath thereto, and it being proved by the oaths of John Scott, Bethyer Scott & John Scott Jun'r. the witnesses thereto, is by order of the Court truly recorded.
