Will of Francis Mallory, 1718 - Prince George Co. VA (Deeds,etc.1713-28, page 346, Prince George Co.VA.) In The Name of God, Amen, I Francis Mallory of the County of Prince George in Virginia, being very sick and weak but of sound memory, thanks be to the Almighty God for the same, and calling to mind the certainty of Death, and the incertainty of this transitory Life, do make this my Last Will and Testament in manner and form following. Imp'rs. My Soul I comitt into the hands of Almighty God my maker, hopeing & assuredly trusting in the merrits of my blessed redeemer Jesus Christ for remission of all my sins, and to Inherit ever lasting joy and felicity, in the last day, when I stedfastly hope for a joyful resurrection. Item. I will that all my Debts be punctually paid and Discharged. Item. I give and bequeath to my Dear and Loveing Wife Elizabeth Mallory one third part of all my Estate, both reall and personall, to her and her heirs for ever. Item. My will and Desire is that the other two parts of my Estate be equally divided between my children (thay is to say) my Daughter Elizabeth, Ann, John, Mary, Martha, and Francis Mallory and the child wherewith my wife now goes, to them and their heirs for ever, to be divided in this manner, viz. All and every part of it to remain together with my wife and children, till they arrive to the age of twenty one years, or day of marriage, which shall first happen, and then I request my Loveing friends John Hamlin, John Woodly in the pasture, and Edward Goodrich, and the survivors of them, to make a just Estimate of my said Estate Left my children and to divide the same according to their judgement, and this my will, and to assign such negro's or other part of my personall Estate to such child or children as they think fitt so that all of the negroes may not Decend to my heirs at Law, and in case either of my children should happen to dye before or after they come of age, or marryed, without Lawfull issue, then and in that case his or her part which shall so dye shall go and Descend to survivors of them, and their heirs forever. Item. I give and bequeath to my Dear and loving Wife Elizabeth Mallory, the Land and plantation whereon I now Live,for and dureing her naturall Life, and after her dec'd. I give and bequeath the same to my son John, and to his heirs for ever. Item. I give and bequeath all the residue of my Lands both in Prince George and Surry County's, or elsewhere, to my son Francis, and to his heirs for ever. And Lastly, I do hereby nominate my Loveing wife Elizabeth Mallory Ex'rx. and my friends John Hamlin and Edward Goodrich Ex'rs. of this my Last Will and Testament hereby revoking all other Will or Wills by me heretofore made, and do desire my Dear Loveing, and my said Ex'rs. to see that my children be goodly and virtuously brought up in the fear of God, and to see that this my Will be justly and truly Executed according to my desire.
