In The Name of God Amen, I Thomas Smith of Wyanoke Parrish in the County of Prince George being very sick and weak, but of sound and perfect mind & memory praise be therefore to Almighty God, do make and ordain this my present Last Will and Testament in manner and form following, that is to say First and principally I commend my soul into the hands of Almighty God, hopeing thro' the merritts,Death and Passion of my Saviour Jesus Christ to have full & free pardon and forgiveness of all my sinns and to inherrit everlasting Life, and my body I commit to the Earth to be Decently buryed at the Discretion of my Executors hereafter named. And as touching the Disposition of all such temporall Estate as it has pleased Almighty God to bestow upon me, I give and Dispose thereof as followeth.- First I Will that all my Debts and Funeral charges shall be paid & Discharged. Item. I give and bequeath unto my son John my new Gunn, and my Sword, a Cow an yearling heifer, and a Cow Calfe, and three Sheep, with these Tools foll.viz; two jointers, two broad axes, one Drawing knife, and two Augors,and one hand saw and four chissells, two broad & two narrow. Item. I give and bequeath unto my son Thomas, my other Gunn, and Sword and a heifer with calf. Item. I give and bequeath unto my son Patrick, a cow and calfe, and two sheep. Item. I give and bequeath unto my son William, a cow & calfe and a young breeding sow. Item. I give and bequeath unto my son Richard, a Horse colt of two years old and a young breeding sow. And I do farther Will and Desire that my son John may bound apprentice to George Hamilton, and have his Legacy Delivered when he attains to the age of Twenty and one years, the Gunn not to be used, unless another Gunn of the same Dimensions and value be given him in Lieu thereof. and my Desire is that all the above _____ Legacys be Delivered to my sons as I have bequeathed them still as thay attain to the age of twenty & one years. All the rest and residue of my personal Estate, goods and chattels whatsoever, I do give and bequeath unto my Loving wife Judith Smith whom with my Brother Richard Smith I make joint Executors of this my Last Will and Testament. And I do hereby revoke Disannull and make void all former Wills and Testaments by me made. The above Written Last Will and Testament of Thomas Smith Dece'd. was presented into Court by Judith Smith one of the Executors therein named and Richard Smith the other Executor having refused to take on him the burthen of the said Testament, the said Judith made oath thereto, and it being proved by the oaths of Edward Prince & Francis Sheffeild witnesses thereto is by order of the Court truly recorded and Certificate is granted the s'd.
