Will of Frederick Temple (Will Book 1, 1865-1898, Page 40, Prince George Co.VA.) I Frederick Temple of the County of Chesterfield, Virginia being of sound mind and memory do make and publish this my last will and testament, hereby revoking and annulling all wills or testamentary papers by me, at any time heretofore executed. 1. I give and bequeath to my son James A.Temple the sum of four hundred dollars. 2. The residue of my estate after paying all legal debts, I desire shall be sold and the proceeds divided into six equal parts, the same to be given as follows; that is to say, one part to my daughter Cleora__ A. B_______, a second part to my daughter Bettie Thomas, a third part to my son James A.Temple, a fourth part to my son James A. Temple, in trust, for my two grand sons James R. and William A. Temple during their minority, and the fifth and sixth parts to be given to my daughters Mary A.Thompson and Fanny T.Branch; and in order that those two last fractions may be secured to my said daughters free from all debts claims or demands of their husbands, I hereby appoint my son James A.Temple Trustee for my two said daughters Mary A.Thompson and Fanny T.Branch, and bequeath the two shares of my property intended for them to him in trust, for the sole separate and exclusive use of my said daughters and their children, to be invested in real estate as my said daughters shall desire; In the event of the death of either of my grand children without heirs before the division of my estate I desire that his portion shall go into the estate, and divided among the legatees in the same way as the residue of my property; That is to say, one sixth of such portion be given to each of my said legatees. In the event of the death of my daughter Bettie Thomas without heirs before the distribution of my estate,I desire that the portion intended for her shall be equally divided as herein before provided for the rest of my estate among the surviving legatees, subject to the provision of this will. I constitute and appoint my son James A.Temple the Executor of this my last will, and request that no security be required of him. Witness my hand and seal this 26th day of October 1865. At a Court held for Prince George County at the Courthouse of said County on Thursday the 9th day of January 1868. This last will and Testament of Frederick Temple deceased was this day proved by the oath of Abram Burton a witness thereto; and having been proved by E.D.Merritt the other subscribing witness at the October 1867 term of this Court the same is ordered by the Court to be recorded. Sealed with our Seals, and dated this 9th day of January A.D.1868. THE CONDITION OF THE ABOVE OBLIGATION is such that if the above bound James A.Temple who hath this day qualified as Executor of the last will and Testament of Frederick Temple deceased in the County Court of the County of Prince George, shall faithfully discharge the duties of his said office or trust, then the above obligation to be void, or else to remain in full force and virtue.
