Bill Vangover vs. Trower To the Worshipful Court for the County of Princess Anne sitting in Chancery Humbly complaining shew unto your Worships Your Orator John Vangover an infant under the Age of Twenty One years by Caleb Vangover his father and next friend and your Oratrix Mary Trower an Infant Orphan of Robert Trower the elder deceased by the said Caleb Vangover her next friend: That the said Robert Trower the elder by his last Will and Testament bearing Date the 29th Day of March … [1794] among other Gifts and Devises made the following – Viz I give and bequeath unto my Son Robert Trower the Eastward part of my Plantation whereon I now live to a Ditch running down a Branch near North and South from the Main Road to Jacob Whites Line, the sd. Ditch being partly cut I desire the remainder that’s to cut to be about five feet bearing toward Joseph White, I also give him fifteen acres of Wood Land adjoining Olds’s Creek and Mr. John Cornicks Line … As by the sd. Will duly proved and recorded in the Court of this County reference being thereunto had will more fully appear … further shews … that the s’d Robert Trower the younger departed this life in about the year 1798 in his minority intestate and without issue leaving two Sisters, to wit Anne (the Mother of your Orator John) who is since dead, and your Oratrix Mary, and a Brother named Henry, his collateral Heirs and only legal Representatives, to whom the s’d Lands with their Appurtenances descended in fee simple That your Orator John is the only child of his Mother the said Anne, and that by an Act of Assembly … Your Orator John and your Oratrix Mary were [heirs] of the whole Blood with the s’d Robert Trower the younger dec’d, being the children of the same father and Mother, and that the said Henry Trower is only of the half Blood to the said Robert he being the son of the same father, but by another Mother … and only intitled to half as much of the afores’d Land as they and each of them are intitled to [Here follows prayer for relief asking that land be divided with John and Mary each receiving 2/5ths of the land and Henry receiving 1/5th.] 2. Summons Summons dated 16 February 1799 to Henry Trower ordering him to appear before the Chancery Court of Princess Anne County “on the first Monday in April next to Answer a Bill in Chancery exhibited against him by John Vangover an Infant Orphan by Caleb Vangover his Father and next friend 7 Mary Trower an Infant Orphan of Robert Trower dec’d by --- her Guardian and next friend. 3. Answer The Answer of Henry Trower to the Bill of Complaint of John Vangover and Mary Trower exhibited against him …. This Defendant in Answer to the Bill … doth say That He admits the several Allegations therein to be true so far as he knows or believes, and that He had no objections to offer against a Division of the Land being made … provided the same is consistent with and in conformity to the Law of Descent …. 4. Decree At a Court of Quarterly Session Held at the Court House for the County of Princess Anne the 4th day of March 1799 IN CHANCERY John Vangover an Infant by Caleb Vangover his Father & next friend & Mary Trower an Infant Orphan of Robert Trower dec’d by the said Caleb Vangover her next friend, Plts Against, Henry Trower Deft. This Cause was this day heard upon the Bill and Answer … and … it is Adjudged Decreed and Ordered, That Adam Keeling, Lemuel Cornick, Joel Cornick and Endiniam Cornick Gent. Or any three of them together with Thomas Walker ... Surveyor … meet on the Lands that was devised by Rob’t Trower the Elder to his Son Rob’t Trower lately dec’d which by the death of the said Robert the younger descended to the said John Vangover as Heir to his Mother Anne Vangover dec’d and to the said Mary Trower & to the said Henry Trower, the said Anne & Mary being Sisters of the whole blood to the s’d Robert the younger & the said Henry a Brother of the half blood, and after ascertaining the Number of Acres in the Lands devised as aforesaid Divide the same in the following manner to wit, By assigning and setting apart to the said John Vangover & the said Mary Trower each two Fifths and to the said Henry Trower one Fifth part thereof, and make Report thereof to the next Quarterly Court in Order to a final Decree. Report Vangover vs Trower Report for division of Land Returned Aug’st 1799 & [ordered](crossed out) to be recorded In obedience to an Order of Court of Princess Anne bearing date 4th March 1799 to us directed, we the undersigned have met on the Lands set forth in the said Order and have divided them as follows to wit To John Vangover [torn] as Heir to his Mother Ann Vangover dec’d [torn] North part of 60 ½ Acres & to receive from Henry Trower the sum of Forty Eight pounds [torn] to Mary Trower Inf't. Orphan, the South part [torn] 60 ½ Acres & to receive from Henry Trower [torn] sum of Thirty three pounds the s’d Mary’s part taking the kitchen which was valued at Fifteen pounds reduced her division that was to be received To Henry Trower the Middle part with the Improvements of 30 ¼ Acres & to pay as above mentioned A detached piece [torn] Land containing fifteen Acres from the [torn]anor place we have divided in the following manner to wit To John Vangover Inf’t Heir as aforesaid the middle part of 6 Acres To Mary Trower the North part of 6 Acres & to Henry Trower the South part of 3 Acres and this is our Report Given under our hands this 5th day of June 1799 /s/ Adam Keeling /s/ Lem’l Cornick /s/ Joel Cornick
