Persons or organizations desiring to use this material for non-commercial purposes, MUST obtain the written consent of the contributor, OR the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ****************************************************************** ****************************************************************** This Identure made the twenty eigth day of April in the nineteenth year of the reign of our Sovereign Lord George the Second and in the year of our Lord one thousand seven hundred and forty six between Cuthbert Harrison of the Parish of Dettingin in the County of Prince William INNHOLDER of one part and Andrew Beard of the Parish of Hamilton in the County of Prince William Planter of the other part Witnesseth that the said Cuthbert Harrison for the Rents and Agreements herein after mentioned expressed the said Cuthbert Harrison doth for himself his heirs by these presents hereby grant set and to farm let unto the said Andrew Beard his heirs or assigns all that parcel of land which the aforesaid Cuthbert Harrison purchased of Christopher Holmes lying on Luckey Run in the Parish of Dittingin and County of Prince William aforesaid containing One Hundred and Thirteen acres of land with all houses and appurtenances whatsoever belonging (all mines and mine oar only excepted and foreprized) for and during the term of ninety nine years next ensueing the date of these presents to begin from the twenty day of November now next following & fully to be compleated paying therefore yearly and every year next after the first year the yearly reserved rent of five hundred and thirty pounds Tabacco according to Law on the Twenty Day of November in every year and aforesaid Cuthbert Harrison doth agree for himself to and with the said Andrew Beard his heirs and assigns to pay a Carpenter for building a Dwelling House and himself agree to plant an Orchard of one hundred fifty Apple Trees on the said premises within four years next after the date of these presents and the same to keep in good order within good fence and it is further agreed that if said yearly rent should happen to be behind and unpaid on the Tenth day of November every year that then it may be lawful for the said Cuthbert Harrison for his Attorney lawfully authorized to enter into said premises and destrain for the said yearly rent or any part and the distress then & there to take and carry away to satisfie the said yearly rent and lastly for the due performance of all and singular the clauses and agreements herein before mentioned and which ought to be kept on the parts of each of the parties the said Cuthbert Harrison and Andrew Beard aforesaid doth bind themselves & their heirs and assigns each to the other in the sum of Ten Thousand Pounds of Tobacco to be paid by the delinquent to the other.
