These electronic pages cannot be reproduced in any format for profit or other presentation. --------------------------------------------------------------- DANIEL COLE LAST WILL AND TESTAMENT Prince William County, Virginia Will Book H, page 230-231 In the Name of God Amen this 20th September one thousand seven hundred and ninety seven I Daniel Cole of the County of Prince William and Commonwealth of Virginia being very low in health but of mind and memory the calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make constitute and ordain this my last will and testament and principally and first of all I recommend my Soul in the hands of God that gave it me and as for my Body I recommend it to the earth to be buried in a dessant manner at the Discretion of my Executors whom hereafter I shall appoint and touching such worldly estate wherewith in this life after my lawful debts is paid I give devise and dispose of the same in the manner and form following. Item I give and bequeath unto my son Benjamin one bay horse name prince and old saddle but this horse is to work in the crop as long as he lives with his mother but he shall find the horse out of his part of the crop. Item I give and bequeath unto my son Matthias one mare named Polly and new saddle to have persession when he comes of age but if this mare proves to have a colt next Spring I give the colt to my daughter Edier. Item I give and bequeath unto my three daughters Mary and Sarah and Edier all my beds and furniture to be equally divided at my wife's death also a cow and calf apeace. Item I give and bequeath unto my loving wife Sarah all my estate induring her natural life not menshened before but if she should marry what I have bequeathed her shall be taken out of her hands if my Executors shall see cause namely Richard Cole and James Cole and at my wife's death every thing to be equally divided among my Children. I acknowledge this to be my last Will and testament. In Witness whereof I have hereunto set my hand and fixed my Seal the day and year first above written signed sealed and acknowledged in presence of Thomas Homes Daniel Cole [seal] Rich. Cole James Cole Benj. Cole At a Court held for Prince William County the 2nd Day of October 1797 This last will and testament of Daniel Cole Decd. was presented to the Court by Richard Cole as James Cole one of the Executors therein named came into Court and refused the burthen of the Execution thereof and this Rich. Cole the other Exec. made oath to the same according to law and the said will being proved by the oaths of Benjamin Cole and James Cole is ordered to be recorded by the said Rich. Cole having performed what is usual in such cases Certificate is granted him for obtaining a probate thereof in due form. Teste, John Williams
