The second day of February and in ye year of our Lord 1732/3 I John Holms of Hamilton parish in Prince William Co. & colony of Virgina being sick and weak in body but of perfect mind and memory thanks be given to God therefore calling to mind ye mortality of my body & knowing yt it is apointed for all men once to die do nominate constitue appoint & ordain this my last Will & Testament principally & first of all I give & recommend my precious & immortal Soul into ye hand of God yt gave it me and as for my body I recommend it to ye Earth to be in a Christianlike & decent manner att ye discretion of my Executors (whome hereafter I shall appoint) nothing doubting but at ye general Resurrection I shall receive ye same again by ye mighty power of God and as touching such worldly Estate wherewith it hath pleased God to bless me in this life (after my just debts and funeral expences are paid) I Give devise & dispose of ye same in ye following manner and form Vizt. Imp. I Give and Bequeath to my loving son James Holmes one hundred and fourteen acres of land (it being part of a greater tract of three hundred and forty acres lying upon ye branches of Luckey Run & Johns Branch) to him and ye heirs of his body lawfully begotten and for want of such heirs to my son Christopher Holmes and ye heirs of his body lawfully begotten and for want of such heirs to my son Edmund Holmes and ye heirs of his body lawfully begotten and for want of such to ye next heir at Law, my son James to have his part land off (quantity and quality alike) where he is now Seating. Item. I give and bequeath to my loving son Christopher Holmes one hundred & thirteen acres of land (it being part of ye above sd greather tract) to him and ye heirs of his body lawfully begotten and for want of such heirs to my son Edmund Holmes and ye heirs of his body lawfully begotten and for want of such heirs to my son James Holmes and ye heirs of his body lawfully begotten and for want of such to ye next heir att Law my son Christopher to have his part laid off (quantity and quality alike) where he now lives. Item. I give and bequeath to my loving son Edmond Holmes (after ye decease of my wife Mary Holmes) one hundred & thirteen acres of land it being ye remainder of ye above sd remainder of ye above sd greater tract) to him and ye heirs of his body lawfully begotten and for want of such heirs to my son James Holmes and ye heirs of his body lawfully begotten and for want of such heirs to my son Christopher Holmes and ye heirs of his body lawfully begotten and for want of such to next heir att Law my son Edmond to have ye planation where I now live and his land laid off convenient to it quantity and quality alike. Item. I give and bequeath to my loving wife Mary Holmes (whome I likewise appoint my only and sole Executrix of this my last will and Testament) all my personal Estate both within doors & without during her natural life and after her decease my will & desire is that my three sons before mentioned choose three men and they three men equally to divide it quantity and quality alike as near as possible amongst my three sons James Christopher & Edmund Holmes’s and I do hereby utterly disallow revoke and disannul all and every other former Wills & Testaments Legacies Bequests and Executors by me in any ways before this time will’d or named, and my will and desire is yt my Estate be not appraised Ratifying and Confirming this and no other to my last Will and Testament. In Witness whereof I have hereunto sett my hand and Seal ye day and year first above written. Sign’d Sealed publish’d and declared his Signum to be his last Will and Testament John J Holmes in ye presence of us Vizt mark John Metcalfe John Maden John Whitledge At a court held for Prince William County March 24, 1739. This Will was presented in Court by Mary Holmes the Executrix therein named made oath thereto & the same being also proved by the oaths of the Witnesses to it Subscribed was admitted to Record. And on the motion of the said Executrix & her performing what if usual in such cases Certificate was Granted her for obtaining probate thereof in due form. Test Catesbly Cocke Cl Cur Know all men by these presents that we Mary Holmes Christopher Holmes & John Whitledge are held firmly bound unto Denis McCarty Gent. the Juatice in the commission of the peace of Prince William County for & in behalf & their______ in the sum of two hundred pounds to be paid to the said Denis McCarty his Exeres. Admes. & Assigns to the which payment well & truly to be made we bind our selves & every of us our & every of our heirs Exeres. & Admes. jointly & severally firmly by these presents. Sealed with our Seals dated this XXIV day of March 1739. The condition of the Obligation is such that if the above bound Mary Holmes Exer of the last Will & Testament of John Holmes deced. do make or cause to be made a true & perfect Inventory of all & singular the Goods Chattels & Credits of the said deced. which have or shall come to the hands possessions or knowledge of the said Mary Holmes or into the hands or possession of any other person or persons for her & the same so made do exhibit or cause to be exhibited into the County Court of Prince William as such time as she shall be thereto required by the said Court abd tge same Goods Chattels & Credits & all other Goods Chattels & Credits of the said deced. at the time of his death which at any time after shall come to the hands or possession of the said Mary Holmes or into the hands or possession of any other person or persons for her do well & truly account of her actings & doings therein when thereto requiered by the said Court. And also do well & truly pay & deliver all the Legacies contained & specified in the sd testament ae far as the said Goods Chattels and Credits will thereunto extend according to the value thereof & the Law shall charge.
