First: I give and bequeath unto my dear wife JANE COLE, in testimony of my sincere regard and affection for her own absolute use and benefit, and at her disposal, One Third (1/3) of all my personal property including my bonds and money, and in addition to the said one third, also here choice of beds and necessary bedding for said bed, one table, half dozen chairs, the cooking stove, and half dozen silver table spoons. And I also give and bequeath unto my wife JANE COLE the Home place on which I at present reside, to hold for and during her life, and at her death to descend to my heirs. Out of the said Home place I except the land hereinafter given to MOLLIE C. HOWELL, also one half of an acre known as the TANSILL burial ground, and also one half an acre between said burial ground and the road, on which said latter half of an acre I desire and direct that I shall be burried and that said one half of an acre shall be forever retained a family burying ground. Second: After deducting the one-third (1/3) of my personal property and the various articles enumerated, which I have given and bequeathed unto my wife JANE COLE, I desire and direct that the remainder of my personal property be divided into four (4) equal parts. One of which said four parts I give and bequeath unto my daughter EDNA A. LYNN, wife of JOHN LYNN. I also give and bequeath unto the said EDNA A. LYNN the tract of land, on which she at present resides, and known as the LEWIS COLE tract. Also the tract of land known as the CHARLOTTE WILLIAMS tract, and containing about 53 or 54 acres, and so much of my _____ as is sufficient to make the said EDNA A. LYNN’s land bound on the North side of the Brentsville & Dumfries road, commencing at the intersection of the Hayfield road with the Brentsville & Dumfries road & running with said Brentsville & Dumfries Road to a large persimmon tree in a pond, and running North east about two hundred yards to intersect with line of the CHARLOTTE WILLIAMS tract once containing about twelve acres. The property both real & personal I give & bequeath to my daughter the said EDNA A. LYNN, I give & bequeath unto her entirely free of and clear from all debts and encumbrances of her said husband JOHN LYNN. Third: I give and bequeath unto my daughter SARAH JOSEPHINE FOSTER, wife of THOMAS FOSTER, living at present in the State of Missouri, another one fourth of my personal property including bonds and money. After deducting the personal property given unto my wife JANE COLE, as hereinafter described. I also give and bequeath unto the said SARAH JOSEPHINE FOSTER a tract of land containing between one hundred & forty two, and one hundred & forth three acres, and known as the SULLIVAN tract, being the land on which WM. H. SMOOT at present resides. The property both real & personal that I give & bequeath unto my daughter SARAH JOSEPHINE FOSTER, I give and bequeath unto her entirely free of all encumbrances and debts of her said husband THOMAS FOSTER. Fourth: I give and bequeath unto my son JAMES L. COLE another one fourth of my personal property, including bonds and money after deducting the personal property given unto my wife JANE COLE as hereinbefore described. I also give & bequeath unto JAMES L. COLE the tract of land known as the JOHN L. DAVIS tract & containing one hundred & ninety acres less seven acres sold by JOHN L. DAVIS to GEORGE GRAYSON. I also give & bequeath unto the said JAMES L. COLE the tract of land known as the CARNEY tract & containing forty four acres, less one acre which I give & bequeath unto A. S. DAVIS being the family burying ground on said CARNEY tract. Fifth: I give & bequeath unto the children of my daughter MARTHA W. ASHBY, wife of JOHN A. ASHBY dec’d, the remaining one fourth of my personal property including bonds and money after deducting the personal property given unto my wife JANE COLE as hereinbefore described, the said one fourth of my personal property to be divided into three equal parts, one of which part I give and bequeath unto GEORGIE A. LYNN, wife of JAMES B. LYNN and one of which parts I give & bequeath unto MOLLIE C. HOWELL, wife of S. B. HOWELL, and one of which parts I give & bequeath unto WILLIAM J. ASHBY. Sixth: I give and bequeath unto GEORGIE A. LYNN, wife of JAMES B. LYNN in addition to the personal property hereinbefore described Sixty five acres of land adjoining the land of JNO. G. TAYLER on the South and the lands of S. B. HOWELL on the North. I give & bequeath unto the said GEORGIE A. LYNN one half of a tract containing eleven (11) acres & laying at HOWISON’S ford near ASHBY’s Old hill, the property both real & personal bequeathed & given unto GEORGIE A. LYNN is given & bequeathed to be free of all debts and encumbrances of her husband, the said JAMES B. LYNN. Seventh: I give and bequeath unto MOLLIE C. HOWELL, wife of S. B. HOWELL, in addition to the personal property hereinbefore described, the tract containing ten acres, including the two enclosed lots & containing the line from the said enclosed lots with the Brentsville road so as to include the building known as the Office, and then running from the west end or corner of said Office to a large White Oak at the Blacksmith Shop & including said Blacksmith Shop; and then running from said Shop with the line between my land, and the land of HORACE COLE, running by the Township Hall to the Store House and including the said Store House and then running to my corner on the Brentsville road. I give and bequeath the said real estate and personal property unto the said MOLLIE C. HOWELL free of and clear from all debts and encumbrances of her said husband S. B. HOWELL. Eighth: I give and bequeath in addition to the personal property hereinbefore mentioned unto WILLIAM J. ASHBY my interest in the tract of land known as the W. P. COLE land, and located near the Store House. Ninth: It is my desire that should any of those mentioned in this will contest the same in any manner, that the said person so contesting this Will shall receive none of my property whatsoever. Tenth: I nominate & appoint my wife JANE COLE Executrix of this my last will and testament, and request the Court to require her to give no security. And I do hereby revoke & make void all former and any other will by me at any time heretofore made, and do declare these presents to be and contain my last will and testament. In witness whereof I the said testator LAWRENCE COLE have set my hand and seal, on this the twenty fifth day of September in the year 1882. ACEAL Whereas I LAWRENCE COLE of Prince William County have made and duly executed my last will and testament in writing bearing date Sept. 25 1882, now I do hereby declare this present writing to be a codicil to my said will, and direct the same to be annexed thereto and taken as a part thereof. I give and bequeath in addition to the property hereinbefore described to my wife JANE COLE one roan buffalo cow four years old last Spring, and one (Jersey?) calf, about one year old. ACEAL At a County Court held for Prince William County Oct. 6th 1884. The true last will & testament of LAWRENCE COLE de’d was this day produced to the Court for probate and the signatures thereto being fully proven by the Oaths of GEO. W. TANSILL and JOHN L. KEYS subscribing witnesses thereto and ordered to be recorded. And on motion of JANE COLE the Executrix therein named who made Oath & entered into bond in the penalty of $5,000.00 conditioned according to law (no security being required) which bond is ordered to be recorded. Certificate is granted the said JANE COLE for obtaining letters of Administration (from?) the estate of LAWRENCE COLE in due form. Teste, L. A. COLE the Executor therein named who made oath (re security being request) entered into and acknowledged a bind in the penalty of $____ conditioned according to law which bond was ordered to be given ___ Certificate is granted the same Cole for obtaining a probate of said will in due form.
