Walker/Rhea Recount, 1898 As required by law, provided that said W. F. Rhea may also have an inspection of said ballots as hereinbefore provided, upon giving like notice to said Walker or his attorneys, and the order heretofore entered at a former day of this term in respect to this matter is hereby set aside and annulled. Walker by his attorney, and it appearing to the Court that said James A. Walker is contesting the right of William F. Rhea to a seat in the 56th Congress of the United States from the Ninth District of Virginia. On motion of said Walker by his counsel it is ordered that the Clerk of this Court do open the ballots cast at the several precincts in this County at the Election held on the 8th day of November, 1898 and the he allow the said Walker and his counsel in his presence to inspect and count the same and to use them as evidence in said contest. Whereas on the 24th day of December, 1898, I served notice on you that I would contest your right to a seat in the Fifty-sixth Congress of the United States as a Representative from the Ninth Virginia District; and whereas the official ballots cast in Pulaski County at the election for Member of Congress from said District, held on the 8th day of November, 1898, now in the custody and control of the Clerk of the County Court of Pulaski County and sealed up as required by law, contain important and material evidence in my behalf in said contest--- You will take notice that on the 12th day of January, 1899, I will move said Court to enter an order authorizing and directing the Clerk of the said court to break the seals enclosing said ballots and open them and permit said parties to said contest to inspect the same and take copies thereof, and otherwise use them in taking depositions in said contested election case.
