This indenture made the twenty-ninth day of July one thousand seven hundred and sixty seven and in the seventh year of the reign of our Sovereign Lord King George the third by the grace of God King of Great Britain, france and Ireland, Defender f the faith and Between Benjamin Smith and Jane his wife of the County of Richmond and Parish of Lunenburgh of the one part and William Northen of the County of Richmond and Parish aforesaid of the other part. Witnesseth that the said Benjamin Smith and Jane his wife for and in consideration of the sum of thirty five pounds current money of Virginia to him in hand paid by him the said William Northen at and before the ensealing and delivery of these presents the receipt whereof the said Benjamin Smith and Jane his wife doth own themselves and therewith fully satisfied, contented and paid and there from and every part and parcel thereof doth fully and absolutely acquit, exonerate and discharge the said William Northern, his heirs, executors hath given, granted, bargained and sold and by these presents give, grant, bargain and sell enfeoff and forever confirm unto the said William Northen and his heirs forever all that piece or parcel of land situate, lying and being in the aforesaid County of Richmond and binding on the Branches of Totuskey Creek. Bounded as followeth: beginning at a white oak corner to Landmanor orphans, thence down to the mouth of a branch, thence up the said Branch to a hickory, thence along the line of the said orphans and William Barnes land, thence a line of marked trees to a red oak corner to this land standing in Robert Smiths' line, thence along a line of marked trees to a cedar corner to this land and the land Robert Smith standing in William Northen's line, thence along a line of marked trees to the beginning white oak containing one hundred acres of land, the reversion and reversions, remainder and remainders, rents, fees, and profits and all the estate, right, title, property, claims and demands whatsoever together with all houses, out houses and all timber and timber trees, woods, underwoods, ways, water courses, all orchards and fences and gardens thereon touching the premises all and every part and parcel thereof of to the same belonging or in any wise appertaining. To have and to hold the before granted premises and every part and parcel thereof and all privileges and appurtenances to the same belonging hereby granted, bargained, and sold or mentioned or intended to be hereby bargains and sold to him the said William Northen and his heirs forever to the only proper sole use and behoof of him the said William Northen, his heirs and assigns forever more to be holden of the Chief Lord or Lords of the fee or fees by rents or services due and accustomed to be payd and the said Benjamin Smith and Jane his wife for themselves and their heirs and assigns so covenant, promise, grant and agree to and with the said William Northen, his heirs and assigns the said land and tenements in free and clear from all incumbrances what ever and doth further warrant and forever defend the same from the claim or claims of all manner of persons whatsoever to the end the said William Northen and his heirs shall be and may from time to time and at all times have, hold, occupy and possess the same for ever doth further covenant and grant that at any time written thirty years next ensuing to do, suffer and execute such further act and acts, thing and thing, device and devices, conveyance and conveyances of the said William Northen, his heirs or their council learned in the law shall be advise or devise for the suremaking and conveying the said lands and tenemence to the said William Northen and within six months ensuing do acknowledge these presents so that he same may be recorded in Court. In witness the parties to these presents hath interchangeable set their hands and affixed their seals the day and year above written. Signed, sealed and delivered: Benjamin + Smith {his mark} Jane + Smith {her mark} In the presence of: George Landman Catherine Purcell Elizabeth + Landman {her mark} Memorandom that quiet and peaceable possession now delivered by the within named Benjamin Smith and Jane his wife on the twenty ninth day of July 1767. By turf and twig on the within land in the name of the whole lands and tenements unto the within mentioned William Northen. In the presents of us: George Landman Benjamin + Smith {his mark} Catherine Purcell Elizabeth + Landman{her mark} 1767 Then received of William Northen the sum of thirty five pounds current money duly received by me At a Court held in Richmond County this 3rd day of August 1767, this deed of feoffment from Benjamin Smith and Jane his wife of the one part to William Northen of the other part with the memorandum and receipt thereon in dost was acknowledged in open court by the said Benjamin and admitted to record, previous to which the said Jane being first privately examined she freely relinquished all her right of dower in the premises hereby conveyed.
