Northen, Peggy Jesper and Samuel Williams October 21, 1822 Peggy Walls was the daughter of Richard Walls. She first married and outlived George Jesper. This was a second marriage for both Edmund N. Northen and Peggy Jesper on October 21, 1822. Edmund N. Northen was first married to Rebecca M. Dobyns on January 28, 1812. Peggy Jesper is shown in the 1820 Virginia Census for Richmond County, page 228 with two young sons and one older daughter. In that same year, Edmund N. Northen is shown with one young son, three young daughters and his wife. This indenture made the 21st day of October in the year 1822 between Edmund N. Northen of Richmond County of the first part, Peggy Jesper widow and relict of George Jesper late of the County aforesaid of the second part and Samuel Williams of the third part. Whereas a marriage is shortly intended to be held and solemnized by the permission of God by and between the said Edmund N. Northen and the said Peggy Jesper and whereas the said Peggy is in possession of a considerable real and personal estate consisting of two hundred and thirty two acres of land lying and being in the County of Richmond, also Negroes Suzah, Ned and Frances together with 18 head of sheep, 5 head of cattle, 1 horse, 3 beds, 3 trunks, 1 cart, 4 wheels, the interest of the said Peggy in the estate of Richard Wall deceased together with all and every description of estate what dower and where as it has been agreed that the said Edmund N. Northen should after the said intended marriage hold receive and enjoy during their joint lives of them the said Edmund N. Northen and Peggy Jesper the interest and occupation of the said personal estate and also that the same and the interest and profits thereof, from and after the decease of such of them, the said Edmund N. Northen and Peggy Jesper as should first happen to die, should be at the sole and only disposal of the said Peggy Jesper notwithstanding her coverture and whereas it hath been also agreed that incase the Peggy Jesper should after the said intended marriage has happen to survive the said Edmund N. Northen that she should no have or claim any part of the real or personal estate whereof the said Edmund N. Northen should be seized or possessed or entitled unto at any time during the coverture between them by virtue of her dower or title of dower at common law or by virtue of her being adminstratrix or entitled to administration of the goods and chattels, rights, and credits of the said Edmund N. Northen or otherwise however. Now this indenture. Witnesseth that in pursuance of the before receited agreement and in consideration of the sum of ten shillings of lawful money of this Commonwealth, to the said Peggy Jesper in hand paid by the said Samuel William at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged, she the said Peggy Jesper was apart and privily examined and in agreement with the said Edmund N. Northen testified by his being made a party to and his sealing and delivery of these presents hath granted, bargained, sold, assigned, transferred an set over and by these presents doth grant, bargain, sell, assign, transfer and set over with the said Samuel Williams executors, administrators and assigns all the said property consisting of 2 hundred and 32 acres of land in the county aforesaid, also Negroes Suzah, Ned and Frances together with 18 head of sheep, 5 head of cattle, 1 horse, 3 beds, 3 trunks, 1 cart and wheels, the interest of the said Peggy Jesper in Richard Walls estate together with all and every description of estate whatsoever. To have and to hold the said property hereby conveyed unto the said Samuel Williams and his executors and administrators and assigns upon such trusts. Nevertheless and for such interests and purposes and sunder such provisions and agreements as are hereinafter mentioned that is to say in trust for the said Peggy Jesper and her assigns until the solemnization of the said intended marriage and from and after the solemnizations of the said intended marriage then upon trust that they the said Samuel Williams and his executors and administrators and assigns shall and do permit the said Edmund N. Northen during their joint lives of the said Edmund N. Northen and Peggy Jesper his intended wife to have, receive, take and enjoy all the interest and profits of the said property hereby assigned to and for his own use and benefit and form and after the decease of such of them the said Edmund N. Northen and Peggy Jesper shall first happen to die then upon trust he the said Samuel Williams his executors, administrators and assigns shall and do assign, transfer and pay over all the said property to the said Peggy Jesper in case she survives the said Edmund N. Northen but if she die before him then unto such person and persons and at the time and times and ins such parts and proportion manner and form as she the said Peggy Jesper shall from tome to time notwithstanding her coverture by any such writing or writings under her hand and seal attested by three or more credible witnesses direct trust or to the intent that the same may not e at the disposal of or subject to the controls, debts, forfeiture or agreements of the said Edmund N. Northen her intended husband provided always and it is herby declared and agreed by and between all the said parties to these presents that in the case the said Peggy Jesper survives the said Edmund N. Northen or any other person or persons in trust for him shall be seized or possessed or entitled by virtue of her dower or title of coverture at common law or by virtue of her being administratrix or entitled to administration of the goods, chattels, rights and credits of the said Edmund N. Northen as aforesaid then and in that case the said Samuel Williams, his executors, administrators and assigns shall from time to time and at all times from thenceforth stat and be possessed of the said property hereby conveyed in trust for the only benefit of the said Edmund N. Northen, his executors, administrators and assigns anything in these presents contained to the contrary thereof in any wise notwithstanding. Peggy Jesper {seal} Edmund N. Northen and Peggy Jesper parties to a certain deed bearing date the 21st October 1822 and hereto annexed personally appeared before us in our County aforesaid and acknowledged the same to be their act and deed and desired is to certify the said acknowledgement to the clerk of the county court of Richmond in order that the said deed mat be recorded. Given under our hands and seals this twenty-second day of October in the year eighteen hundred and twenty two.
