And whereas ye said proprieto’rs have thought fitt under there hands & seals to Depute me Phillip Ludwell Esqr w’th full and Lawfull power & authority to Act in ye premisses pursuant to ye powers Graunted by there said Maj’ties as fully & amply to all Interests & purposes as they ye said proprieto’rs might or could doe if they were p’rsonally present. Now Know Ye therefore I ye said Phillip Ludwell Esqr by ye power & authority to and given & Granted doe heareby und’r ye Condetions and provisions after Mentioned Convey make over & asssigne unto John Wright of Westmoreland County Blacksmith a Certain Tract of Land Lying Scittuate & being in the aforesaid County Contayneing two hundred & fifty Acres in Yoacomaco parrish neere unto a Devident of Land belonging to M’r Robt Middleton & boundinge North West upon ye Land sould to George Harrisson, South West on ye Land sould to William Read/ Beginning at a White Oak Corner tree standing in George Harrisson’s Land & Devidinge this Land from ye Land of William Reade afores’d from thence Extending south East two hundred & twelve poles to a Red Oak by a Branch, Thence Extending North East one hundred ninety four poles to a Hickory Corner tree, Thence Extending North West to ye said George Harrisson’s Corner tree three hundred poles, Thence alonge ye said Harrison’s Line South West to ye BeginningTree/ The which said Land was formerly taken up by M’r Robt Chamberlain surveyo’s & by him sould to ye said John Wright, as by Deed of Sale und’r ye hand of ye said Chamberlain & sould dated ye ninteenth Day of April 1688, ______ appeared & Recorded in this office und’r this Conveyance, Togeather with all Woods, Waters, Timbers & other Trees w’th all with proffits Comodityes Emolluments & Hereditaments whatsoever to ye said Land belonginge or in any wise apperteyning w’th all Rites & priviledges of Hawking, Hunting, ffishing, ffowling, w’th all Mines & all Minerals on ye said Land Excepting one fifth part of all Gold Mines or Gold Oare & one Tenth part of all silver Mines or silver Oare arrising or if shall heareafter be found on ye said Land Reserved by his Maj’tie, As also Excepted & Reserved to & for ye use of ye proprieto’rs there heirs & assignes one fourth part of all Gold Mines or Gold Oare & one fifth part of all silver Mines or silver Oare as aforesaid besides what his Maj’tie hath Excepted & Reserved, Togeather w’th one third part of all Tinn, Copper, Irons Lead Cole Mines or Oare if shall be found as aforesaid. To Have Hold & peaceably to possess occupy & enjoy all & singular ye before Resighted(?) premisses & all & singular ye Rites Members & appurtenances that do belong to him ye said John Wright his heires & assignes for Ever, Yieldinge Page 109 & payinge yearely to ye said proprieto’s there heirs & assignes for Ever, ye sume of two shillings Sterling money per Every hundred Acres hereby Graunted ye which payments to be made from yeare to yeare & being payed at or upon ye feast day of St Michael ye first Augest or after upon all Demands either in money Sterling as abovesaid or in good Spanish money after ye rate of five shillings for a peece of Eight or in Case money Cannot be had as good tobaco as any is or shall be made upon ye said Land w’th Casks after ye Rate ye Quitrents now are or shall heareafter be made paid in ye other parts of Virginia, As also well & truly payinge after ye Rate of five shillings as a fine for Every hundred Acres for all quantityes of Land/ if shall be taken up above one hundred Acres to six hundred Acres & for all quantityes of Land above six hundred Acres after ye Rate of tenn shillings for Every hundred Acres ye which said money is to be paid w’thin six months after ye signeing Sealeing & Deliveringe ye Conveyance for the Land, Either in money Sterling Spanish money after ye Rate of five shillings for a peece of Eight or in good tobaco after ye Rate of six shilllings p’r hundred, Always provided if ye quitrents above Mentioned of two shillings p’r hundred Acres or ye fines for Lands heareby Graunted shall be either Omitted or Refused to be paid by or for ye Span of two whole yeares at any tyme, That then it shall & may be Lawfull for ye proprieto’s there heires & assignes to Reenter & take possession of ye said Lands w’thout ye Hindrance or Molestation of any p’rson or p’rsons for Neglecting or Refusing to pay ye said quitrents or fines as abovesaid, And Lastly it is provided if it shall & may be Lawfull for ye Proprieto’s there heires & assignes at any tyme to Admeasure ye Land heareby Granted whereby ye have Contents thereof may bekumme all which dues being well & truly paid & all other Causes & promises hearein performed he ye said John Wright shall & may by force & virtue of these p’rsents from tyme to tyme and at all times for Ever heareafter Lawfully peaceably & quietly, Have Hold & occupy Enjoy & possess said Lands & other ye above Bargained p’rmisses w’th ye appurtenances to ye only proper Uses behoof of him ye said John Wright his heires & assignes for Ever w’thout any Lawfull _______ Troble or Disturbance of or from these ye said proprieto’s there heires or assignes or by them or Either of there _______ & consent or precusement, In wittnesses hereof I’ve und’r written Philip Ludwell Esqr in ye Names & on ye Behalf of ye said proprieto’s by Virtue of a General power & of procuration by ye said proprieto’s to me Graunted to ye party aforesaid have heare unto selling heareof ye _____ Clerk appointed by ye proprieto’s to this purpose this 4th day of Septem’r 1691.
