Northen, Lefevre Kennan February 15, 1847 Note: William Porter was Robert F. Northen's father-in-law. Lefevre Kennan may have been Robert Northen's uncle or cousin, since Robert's mother was Sally Kennan. This Indenture made this 15th day of February 1847 between Robert F. Northen of the first part, Fereol Lemoine of the second part, and William Porter and Lefevre Kennan of the second part and Robert F. Northen of the third part, all of the State of Virginia. Whereas the said R. F. Northen is desirous to secure the said William Porter and Lefevre Kennan who are bound as his securities in the following named obligations severally and individually. Viz: One bond for $102.40 due January 1847 payable to Alexander Bryant, One bond for $102.40 due January 1847payable to William Bryant, One bond for $61.66 due January 1947 payable to Margaret S. Bryant subject to a credit of $12.80 as of 3 November 1846, One bond for $65.00 due January 1847 payable to R. H. Syell, One bond for $65.00 due January 1848 payable to R. H. Syell trustee for the heirs of Charles E. Brown, deceased, One bond for $17.50 due 16 September 1847 payable to Moses Self, One bond for $7.90 due 16th September payable to Moses Self, administrator of Daniel Hardwick, deceased. One bond for $70.00 due 1 January 1848 payable to E, Jeffries, trustee for E, S. Saunder's children, One bond for $34.15 due 3 December 1846 payable to William Webb, administrator A. Rains, One bond for $35.00 due 1 January 1847 payable to Maria Clarkson, One bond for $10.92-1/2 due 20th May 1847 payable to Robert Clark, administrator Fleet C. Clark, deceased With the legal interest on which has and may accrue on the same. Now this indenture. Witnesseth that for and in consideration of the promises and also for the further consideration of one dollar of lawful money of Virginia to the said Northen in hand paid by the said Lemoine at or before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, he the said Northen hath given, granted, bargained, and sold and by these presents doth give, grant, bargain, and sell to the said Lemoine, his heirs and assigns forever, the following property to wit: 2 beadsteads, 3 beds and furnishings, 1 round mahogany and 2 square walnut tables, 9 windsor and 3 flag chairs, 1 dozen china cups and saucers, 3 dozen plates, one half dozen dishes, 1 dozen knives and forks, 2 pots, 2 ovens, 1 tea kettle, 1 spider, 2 wagon horses, wagon and gear, 1 yoke oxen, 1 odd ox, 1 cow and calf and their future increase, 2 ox carts, 10 heads of hogs and their future increase, all my interest in the cord wood and wood cutting business as carried on the past and present years in partnership with Lefevre Kennan and also all my right title and interest, it being an undivided half of the tract or parcel of land purchased by said Northen and Kennan as sold by William S. Northen, commissioner, under a decree of County Court of Richmond and in conformity with the last will and testament of Alexander Bryant, deceased, which land lies in the parish of Farnham and adjoins the lands of Sally Jenkins, James L. Packett and others and contains in the whole one hundred and eight acres more or less. To have and to hold the said property and the increase of the said stock unto the said Lemoine, his heirs and assigns forever and the said Northen for himself, his heirs and assigns doth hereby warrant, promise and agree to and wish the said Lemoine, his heirs, administrators and assigns in manner and form following. That is to say that the said Northen, his executors, heirs and assigns the aforesaid property together with the future increase of the stock unto the said Lemoine, his heirs and assigns against all persons whatsoever shall and will warrant and forever defend by these presents. Upon trust nevertheless that the said Northen to remain in quiet and peaceable possession of the said property hereby conveyed and take the profits thereof to his own use until the expiration of twelve months from the date of this indenture and then until default be made in the payment of the said several sums of money either in the whole or in part and then upon this further trust that the said Lemoine, his executors or assigns shall and sill so soon after the happening of default of payment as aforesaid as the said Porter and Kennan or either of them , their heirs, assigns or administrators shall request in writing sell the said property hereby conveyed and the increase of the said stock or as much of it as shall be sufficient to pay the said several sums of money and interest and to the highest bidder for real money at public auction after having fixed the time and place of sale at his own discretion and given ten days notice at least thereof by public advertisement and out of the money arising from such sale shall after satisfying the charges thereof and all other expenses attending the premises par to the said Porter and Kennan, their heirs, executors, administrators, or assigns the said several sums of money with the interest which may thereon lawfully have accrued and the balance of any shall pay to the said Robert F. Northen, his heirs, executors, administrators or assigns. But if the whole of the said several sums of money shall be fully paid of and discharged twelve months after the date of this indenture sp that no default of payment be made then this indenture to be void or else to remain in full force and virtue. In witness whereof the said parties to these presents have hereunto set their hands and affixed their seals the day and year first above written. Northen to Fereol Lemoine in trust for the benefit of William Porter and Lefevre Kennan was this day presented, acknowledged before me in my office aforesaid by the said Robert F.
