Ewell vs. Ewell Collection: CR-SC-H Dated Ended: 1827 ID# 95-6 Plaintiff: Charles Ewell Defendant: Charles Ewell, Jr.; John Taylor; Jesse Ewell; Mildred Ewell; Joseph Janney; Edmond [?]; John Leachman; George Williams; John Gibson, Jr.; John Rollins; Charlotte Ewell Whereas a Treaty of Marriage has taken place between Lieutenant Jesse Ewell Jr. of the United States Army of the one part and Mildred Beale spinster Daughter of the late Thomas Beale Gentleman dec’d formerly of the County of Richmond on the other part. But solemnization of the said Marriage remains yet to be performed and whereas the said Mildred Beale is entitled under the last Will & Testament of the said Thomas Beale Gen’t decd to a considerable Estate in Slaves and other Personal Property. Now know ye that The said Mildred Beale by the full & free consent of ye said Lieutenant Jesse Ewell, Jr. and for the better purpose of securing the above said Estate from all prior encumbrances and eventual circumstances to the advantage of the said Mildred Beale and her children She might have by this intended Marriage the said Mildred Beale doth more over for & in consideration of five shillings in hand paid at or before the sealing & delivery of heir Presents by Jesse Ewell, Senr. the elder of the County of Prince William. Have given, granted, bargained & sold declare & confirmed and do by these presents give grant bargain sell declare & confirm unto the said Jessee Ewell the Elder all my eight titles & interest of every kind whatever in fee simple in & over the slaves, money & other Personal Estates, that I the said Mildred am & may be entitled to either in Law or Equity by Devices in the said will & Testament of Thomas Beale my later Father dec’d. To have & to hold up above said Slaves, Money & other personal Estate in fee for the use and Trust alone, for the benefit of ye said Mildred Beale & Her child or children that she might have by the above said intended Marriage with the said Lieutenant Jesse Ewell, Jr. and that in case of the Death of the said Mildred Beale without child or children. That she shall have full power of Disposition of ye above said Estate by will or otherwise before her Death as She may dream proper & convenient. In Witness Whereof We have hereunto set our Hands & affixed our Seals this fifteen day of November 1799.
