RICHMOND, VA - DEEDS - John Allen and Joshua West to Robert M. Pulliam and John H. Price, Dec 1807 --------------¤¤¤¤¤¤-------------- THIS INDENTURE made this ____(blank) day of December 1807 between John Allen and Joshua West both of the City of Richmond of the one part and Robert M. Pulliam and John H. Price of the said City of the other part. WITNESSETH that the said John Allen and Joshua West, in order to secure their respective debts due to Thomas White, that is to say, John Allen's debt amounting to ninety six pounds sixteen shillings and eight pence with interest therein, from September 1804 due by account, Joshua West debt amounting to fifty five pounds twelve shillings and four pence with interest thereon from March 1807 due by judgment in the Hustings Court of the City of Richmond, and for the further consideration of one dollar in hand paid by the said Robert M. Pulliam and John F. Price at or before the ensealing and delivery of these presents, there receipt whereof is hereby acknowledged, they, the said John Allen and Joshua West, the former having the equitable title to the property hereby conveyed the latter the legal title, hath granted bargained and sold and by these presents do grant bargain and sell unto Robert M. Pulliam and John F. Price that piece or parcel of ground lying and being in the City of Richmond and known in the plan of said City by lot No. (blank) being in the same whereon the said John Allen now resides and the reversion and reversions remainder and remainders yearly and other rents, issues and profits thereof and every part and parcel thereof and also all the estate right title interest trust property claim and demand whatsoever, both in law and in equity of them, the said John Allen and Joshua West in to or out of the said land, tenements, hereditaments and premises. TO HAVE AND TO HOLD the said lot or parcel of ground herein before mentioned to be hereby granted with their and every of their appurtenances unto the said Robert M. Pulliam and John F. Price, their and each of their executors, administrators and assigns forever. Upon trust nevertheless that the said Robert M. Pulliam and John F. Price or either of them, their or each of their executors or administrators shall proceed to sell the said demised premises any day after the first day of January one thousand eight hundred and nine, they or either of them giving fifteen days preview notice of the time and place of sale, in some newspaper printed in this City to the highest bidder for ready money and out of the money arising from the sale, in the first place, pay and satisfy all reasonable charges attending such sale and the cost of this instrument and then the debts above mentioned with interest thereon as herein before mentioned, untill paid and the residue of the money arising from such sale as afore said to the use of either of John Allen or Joshua West, their or either of their executors, administrators or assigns or such other person as they may by writing under their hand appoint and in default of such appointment to such person or persons as would be thereunto entitled by virtue of the statute for distribution of intestates estates, and the parties do by these presents further convenant and agree that should the said John Allen and Joshua West pay and satisfy their respective debts before mentioned and all the interest due and and granting? due thereon, and the cost of this trust on or before the first day of January one thousand eight hundred and nine, then this deed to be cancelled and of no effect, otherewise to remain in full force, power and virtue, but it is well understood by the parties and so agreed that if the property should be sold that the said Allen and West shall join the trustees in the conveyance. Price, parties thereto and proved as to John Allen and Joshua West, other parties thereto, by the oaths of John H. Strobia and Samuel White, witnesses to the same, and on the fourteenth day of the same month, the said Indenture was further proved as to the said Allen and West by the oath of Charles Wills, alwo witness thereto and ordered to be recorded.
